    The apt. complex I live in has been sold to a commercial real estate company who closely resembles the North end of a South-bound mule. They strong arm tenants into comply with lease-breaking actions. They're respecting the length of the residential lease, so we assume they cannot cancel TV service that's included in the lease.

      If it's included in the lease and the lease is still in effect, then no, it can't be canceled. If you're month-to-month now, then it could be canceled with a 30 day notice.

    I’m in Northern California. I’m super ready to move. We were ready to give 30 day notice but noticed we had one more month, bummer. Few days later the realtor sent us a 60 days notice. They mentioned to us in the past they would only extend the lease this to May to prepare for the market. We have been semi packing. The realtor mentioned they will start marketing and showing to come.
    Is the owner able to have showings while we are at the very end of our lease?
    I really don’t want to flexible to an owner who treated the property and tenant poorly. There’s mold, water heater is bad, doors are not secure, plumbing and sewer problems. The owners would not like me being here during tours. I’m hoping we can find a new place before showing.

      Yes, the owner can put it on the market for sale with you in there, but agree that it's probably not best for all parties involved...better for them to wait until you're out.

    Your the only one addressing this issue on RUclips! I am a tenant, and their are very complex circumstances surrounding the sale of the property I have resided in for almost 10 years. I am on sec 8, and a protected class that has requested certain accommodations. Also, the owner/seller was indicted for massive Ponzi scheme and this property was part of a chapter 13 fire sale that specifically includes tenancy and security deposit only and nothing else including rental arrears, but the new owners are evicting me for non payment of rent during Covid , even tho I had filed declarations and even gotten first round rental assistance, but landlords were non responsive when the organization was attempting to pay much more. Can I call you? There are a couple other significant details to mention… please help

    I have paid my rent every month during covid. Landlord's other business is going under and now he wants to kick out my family to sell the apartment so he can get top dollar. Well in NJ you can't force evict someone. So we are going to have to go to court at some point. He doesn't know that yet.

      I’m in the same situation as stanley above me. I’ve paid my rent on time and the owner wants to sell to capitalize on the market condition. I received a 90 days to vacate and that’s fine but the landlord wants me to get my things out of the house before I even have to move can they do that?

Can he evict and how long do we have before that process starts? How soon could a landlord begin eviction if they are within their rights and are selling the home I'm in?

    My friend just sold a rental property, with a tenant that he couldn't evict and wasn't paying. The buyer was aware, and was fine with it and a deal was made.Now my friend doesn't have to worry about that tenant, the eviction process, or any of that. He also made a profit.

    I live in Florida and landlord texted me she was selling the house, then texted yhad a showing, when she came she slapped a vacte property in 15 days, my lease ends on April 7th that ends the 15 days notice

    I've been renting this house 2 years and so far have been through 3 different landlords. On December 5th I received a letter in the mail saying (short version) "we are your new owners and will be working on getting all tenants switched over" there was no details on how to pay rent or any contact information. Rent is usually due on the 1st and today is January 7th and I don't know how to pay rent and haven't been contacted. Every couple days different roofing crews come and climb on the roof without knocking first .. Everytime I go outside and ask the " random roofers " what's going on ..they don't speak English and all they tell me is "new roof "

    When I paid my rent this month 3/1/21 (here in California ) my landlord called me and said "I'm not your landlord any more your rent and deposit will be transferred to the new landlord. I have never been late or missed a payment! The new owner gave a notice this month to vacate in 60 days.. im disabled, my son has been doing zoom classes since the pandimic , this was a total blow to us. I never new they sold my house. I have now where to go. Is this legal?

      It _may_ be allowed under SB 91, but there are very strict guidelines that

      Along the same lines, can one be forced into a contract with someone? Buyers of rental properties are required to fulfill the previous contracts. But what if I cannot nor want to sign a contract with the new owner? The contract with the former owner is now defunct, and I have not signed any with the new owner. Does the new owner have any legal standing with a now defunct contract?

      @@danielluevano5324 You can get eviction ,and after a while not paying jail time.Covid laws went away a couple of months ago.

      @@danielluevano5324 from my understanding the contract runs with the unit. As long as you are within the contract you have to pay the agreed amount to the current owner. The contract should be updated between the owner you originally signed with and updated to reflect the new owners name but this often times goes neglected.

    And yes me and the other tenants were so worried we were going to have to move because the old landlord passed away and his wife didn't want someone to buy it and sell it she was trying to get a landlord to keep us all here well she don't know it but she did just that and God bless her and thank God for what we have gotten in a landlord it was a real big surprise to all of us and will be indebted to him for the rest of our lives

    My Aunt gave her renters a 60-day notice when the moratorium first ended last year 9/30/21 because the tenants practically destroyed her home. Currently the home is being repaired at her leisure. When the home is ready to rent and the prior tenants find that she re-rented to someone else can they try and sue her? They were not happy that they had to move is why I'm asking and seeing as how this system is on the side of the renters even though my Aunt's house is hers bought and paid for.

      Discuss with a local eviction attorney. If the property was exempt from AB 1482, then she didn't need to give them a reason for the termination of tenancy. Plus they've already given up possession.

    My landlord wants me to keep the suite looking perfect, (un-lived in) so potential buyers can view, and one can buy.
    I feel enraged and ready to explode at any moment. When it sells, I’ll have to move agh. I hate him.

      Right it's bad when I rented a house the owner texted me non stop because someone wanted to view the house and I didn't like it because it could be anyone not just some one who is buying the house it could be someone who want to see how you live are be a nosey neighbor

    What if they were paying to previous landlord but to the new owner now they don’t pay? Will seller get in trouble for that?

      As long as the seller is truthfully disclosing that the tenant has paid previously, then the seller shouldn't be responsible for nonpayment when no longer the owner.

    My landlord sold the property cash , the new landlord didn't know it still had tenants ( my & my kids ) with a senor. So they said would you take cash for key . Never got a number but I don't how much I can get offered or given . I'm a single mom

    I got a question. We was renting to own. And during that time I redid the attic my self. I sucked it out and blew it back. Now we decided not to buy and he is selling the home.Anyway I can get my money from him for doing the work to the home my self?

      You can always ask the owner for reimbursement, but it may be too late. In your defense, that's not a typical thing for a tenant to have to pay for.

    So Im recently closing on a house in a UT suburb but the tenents have been difficult/lazy even as I had my final walkthrough (seller did repairs i requested which is great) today they were barely moving out even though there month to month ended feb 28 so 4 days later they are finally getting out. My closing is tmrw and landlord said they will clean it out whatever left overs. So hopefully I ccan move in to my first home this weekend :) Im excited!! darn the lazy tenents though they had a month and a few days to move/find a new place to rent and theres plenty of townhomes they could go to already, i wanted a clean final walkthrough to show my mom who resides in socal but i can take pics later I guess...       So that is the legal document if the landlord wants to sell. Not a one page paper. And how should u reply if that's not the legal doc.

    What do you when the lease agreement ends and the tenant won't leave, and the signer of the lease agreement isn't living in the house and has other people living in the house.

      Sounds like there's a lease in place and seller can't break it, or it's a family member and they want them to be able to stay put. Not sure why hey put a tenant in and then decided to sell...any number of reasons.

    Our landlord didn't tell us the property we're living in until they already had a contract for sell to an investor... We're in CA. Feel they should have told us when they were thinking about selling, however, it is what it is...

      Just a heads up, since it's being purchased by an investor, there isn't much they can do to terminate your tenancy. Reach out to Legal Aid if they try to.

    My question is I was paying my rent and the owner decided to give me a 30 day notice to move and he terminated the contract I was living there for a 1 year and 5 months I cleaned and put new carpet in I did not have to do I moved out in October 6 of 2021 and I have not gotten my deposit back what should I do ?

    anyway when we met our landlord he got to know us cuz Miss candy made us seem like we were terrible people but he was looking to buy and sell but when he met us he changed his mind he knew we all paid a rent one time every month without hesitation and he realized we were all on social security and disability and he had compassion in his heart and also the rent that we did not give candy anymore we had cat and gave it to the real landlord when he come look for it so even then we did not live for free we gave all our money directly to the landlord after she ripped him off she didn't get that little bit of money he did so good for us for catching her and he appreciated that so much he refinance the house because she got enough money out of him so anyway he refinance and got everything up to code and fix everything up so wonderful it's beautiful now and we we appreciate it so much he is a wonderful landlord you couldn't ask for a better man

    In nc, on month to month basis. I’ve lived here 3 years, yearly lease ended after first two. Been on month to month for a year now, the owner put the house up for sale. But has not told me if it’s being sold as “rented” where I stay and pay another new landlord. Or if they are kicking me out to buy and live in. Upon completion of a sale, what are my rights in this instance that they sell and the buyers want to move in? How long of time to leave do I have legally? What does the landlord have to do to make me leave, and do they have to give me 60 days or what in written form? Pls help, thank you

      The house has been on market for 3 weeks to selll but my landlord won’t even respond, only the property manager so I have no clue what I need to do…

    If a tenant is in the process of being evicted from a property where landlord currently resides,(tenant has not paid rent since before covid started, still works but is claiming hardship), does landlord still have to pay utilities even if landlord moves from current property? Landlord is currently paying everything since tenant had not paid since December of 2019.

    My husband and I are buying a duplex with exciting tenants. The tenants in the back was not paying rent due to COVID-19. But are now paying per Agent. Can I gave the tenant a 60 day notice in order for me to move in. Or can I rent to a family member?

      Congrats! I am a big fan of buying a duplex in lieu of a single family home if it makes sense! Technically, the AB 3088 provision that allows a buyer to move in when buying does not apply to a duplex or bigger (in my non-legal opinion so please run all this by an attorney). Since you're moving in, you can use the excuse that it is being removed from the rental market...this may work better in your case. Good luck!

    Hello, i have a question so my landlord is selling my house and is doing open house while im still living here and im concerned that perfectly random strangers will be coming into my house my business and business inventory is all at home and i have 1000s of collectables that are easy to steal and will take forever to pack, i live in a very bad area with crime everywhere and i don't want random strangers from off the street coming into my house for open house i live alone and that would make me very concerned for my safety that random strangers now know the whole layout of my house and all the stuff i own it just opens me up to burglary. and also my landlord also does not want me to be there while they are doing open house, do they have the right to just let random strangers off the street into my house while im still living here?

      You should discuss this with Legal Aid in your area or visit lawhelp.org. In California, a landlord can potentially have an agent do this. But just because a landlord and agent CAN doesn't mean it's the best way to go....I take a different approach when listing and selling a tenant occupied property.

    My wife and I are in contract on our SFR with a ADU (we are the sellers). The ADU is tenant occupied. Between our agent and the buyers agent, we are a bit lost as to what documentation we need to provide to the buyers. Buyers want new lease, deposit prior to contingencies being lifted, criminal background check on the tenant.... is this legal? We have received zero guidance on this matter, and we want to do right by our tenant. Your response is appreciated.

      In general, when I represent a seller of a tenant occupied property, I make sure the seller passes along whatever info they have on a tenant. If the landlord doesn't have it, then they can't give it. Unless the purchase agreement required those items, then they aren't mandatory. Reach out to an attorney for guidance on this.

    Thank you for this video. I am a realtor in the Central Valley and I have a potential seller who wants to sell his home that is currently occupied by his family members. He needs to sell, but they refuse to move out. My understanding is that they have not signed a contract of any kind. Is a 60-day notice sufficient to get them to vacate or are there other legal avenues since it's family and there is an absence of a contract?

    My daughter landlord sold her duplex Sept.18 2020 in the mist with COVID-19 it sold Fast...She Was Not Behind At all I believe he didn't want to be caught up with her not paying...The realtor was not respectful came in her home on serval occasions with no mask...Yeah he offer to buy her out but she only had to Oct before her lease was up...Now she been without a place to live due to everything is so high...In Tn you have to make 3x your rent.Nobody here make that kind of money..I wish I could sue him cause he has put my daughter and grandbaby in a bad position.....

    Thanks so much for this super helpful video! If a tenant is on a month-to-month lease and the property sells, is the tenant required to sign a NEW lease with the new landlord, or is the old month-to-month lease with the prior landlord still in effect?

      The terms from the previous rental agreement are still in effect. It's not required that a tenant sign a new lease unless the landlord wants a new lease.

      In California, you would be able to deliver the 60 day notice if it's under contract with a buyer who will move in, then you can deliver the notice. Some areas do have relocation assistance that most be paid, but not all.

      Depending on where you are (discuss the local laws with a good attorney) you may be able to evict because they aren't cooperating with showings. Make sure the tenant is given proper legal notice before the showing.

    I live in Los Angeles. My landlord wants to sell. I pay rent on time. They served me a 60 day notice. I called legal aid and they told me the 60 notice is invalid and if they try to enter the property for showing to call the police. This started in October 2020 and I'm still here I found a new place but I'm taking my time moving in. L.A. stay in place orders gave me time to find a suitable place instead of rushing out to somewhere and I'm not satisfied. And legal aid told me that they can not serve me a valid 60 day notice until the emergency is lifted. I have an elderly mom that lives with me and thry thought I was going to let strangers in here for showings Ha! Screw them

      Definitely listen to the advice Legal Aid gives you...I concur with what they're saying in this case. My non-legal opinion on their advice on the landlord not being able to enter the property with a buyer...if they give correct legal notice the landlord can enter with a prospective buyer.

    How often do you sell to the tenant? (Obviously only someone is paying and not trashing the place)

      It's pretty rare, TBH, but it can happen. If the landlord is interested in selling, it's worth a discussion between the tenant and landlord, but usually there is a big gap in what the tenant and landlord think the property is worth. I should probably do a video on it. 😀

      That is an unique situation and you should reach out to an attorney to discuss. Ultimately it will probably come down to what the lease says and what local zoning laws and regulations say about growing in that location. Since you're not on the lease, your rights are probably pretty limited, but an attorney will be able to give you guidance.

    I have a question! I converted my garage into a two bedroom apartment to help me pay for my mortgage (I bought the house when I was 20). The apartment can only be accessible by going through a gate, a gate you have to walk the driveway to reach. I have a tenant who I’ve been trying to evict for the last two months (she only legally lived here a month before deciding renting the apartment to her had been a mistake). I’m currently in the process of evicting her through the court system. My question is if I can call the police when unwanted visitors come onto my property. I also live here and she has strange men coming and going at all hours of the day. Is it legal to do that? I have videos upon videos of strange people coming to her door, going inside for two minutes and then leaving. It’s a constant parade of people.

    I rent house with tenant for one year in California , and the contracts is over in the beginning of the year 2021. She refused to pay any rent for months and don’t want to leave. I can’t evict her.
    But can I still give her a 60 days notices for selling the house and tell her to leave. If she refuse it, can I evict her at this circumstance? I was still a little confused at this point. Thank you!

      Reach out to a good local eviction attorney on this one. You may be able to give a notice of nonrenewal since the lease is ending. If you're going to sell, you'll have to wait until the house is under contract and you know for sure that the buyer will be moving in, then you can give the 60 day notice. But again, get guidance from a good eviction attorney and good luck!

      Here's your diilemma. Court are not hearing evictions. When they do, there will be thousands of cases ahead of you. Hopefully the court will hear your case 2 years later and not 5 years. Meanwhile, after the 60th days of you handing the notice, the lease agreement is no longer valid because you terminated it (that notice), your tenant can pretty much do anything to you property like sublease while not paying rent. And there's a 99% chance that the court will take the side of the tenant (this is California) because of Covid.

    I'm under escrow and the house I'm trying to purchase has Tennant's that haven't paid rent. They signed a cash for keys agreement For 10k with current owner and agreed to leave at the end of September. I feel like they won't leave though and I'll be stuck making the Mortgage payments. What are your thoughts on my situation? Would you pull out? I'm scheduled to close next week

      Very tough call! Have an attorney review the cash for keys agreement to see if you can immediately move forward with an unlawful detainer if they don't move out (and make sure they aren't protected by an eviction moratorium in this case). Just to make sure, the tenants aren't getting the $10k until they move out, right? Hopefully they didn't do it wrong and give it to them...

      @@WIREassociates yes. Tennant's won't be getting 10k until they move out. My agent just informed me escrow will hold 20k in funds in case the Tennant's don't move out by September 1 to proceed with eviction. From what I was told, Tennant's have not paid any rent to the current owner

      @@josev6660 ok, good. Still would be worth paying an eviction attorney now to review the cash for keys agreement and make sure an unlawful detainer can move forward if they don't move out. Many seemingly "normal" evictions can't move forward under current eviction moratoria.

    Ive lived in the same rental for 11 years in Ventura county, California. Owner says she wants to sell asap and gave me a 60 days termination. Ive paid my rent however I have been affected by covid as Ive used savings and government aid to pay rent. My car is about to be impounded and Im behind in several bills along with ruined credit. The area is saturated with renters due to evictions.
    Can they give me a 60 days notice before January 31s when the moratorium is not up yet?
    My kids and I are going to be completely displaced....do we have any protections?
    They continue to try and send people here at the home to see if anything needs to be upgraded and staged before the property is sold but after 3 companies came by I had to draw a line with my kids here. Do I have to continue letting them in?
    Ive tried to contact lawyers but I cant afford to retain their services.

      In my nonlegal opinion, it doesn't sound like your landlord gave you proper notice. A landlord can't give a 60 day notice just because they want to sell. If the buyer is going to move in, then they could potentially give you a 60 day notice, but not until they know for sure that the buyer will be moving in (they won't know until they pick a buyer and the home goes into escrow). You should reach out to Legal Aid, which is free or low cost legal assistance for tenants for help. Try searching here for help: www.lawhelp.org/
      As for entering the property, run that by Legal Aid as well. There are very specific reasons that a landlord can enter and prepping for sale does not fall on the list in my nonlegal opinion. Good luck and keep me posted!

      That's the owner. 😀 By "buyer" I mean the person they sell to when they list it and sell the property. That person must be moving in for a 60 day notice to be potentially valid.

What about If the house is under "Escrow", the landlord has a buyer and they made a deal, but the tenants are still occupying the residence and they are month to month and have been paying rent all this time and the tenants fall high risk of covid and are based in Los Angeles where there is the no evictions moratorium happening? Can they still be trying to get them out ? And what would the tenants rights be in this case ? Thank you !

      Thanks for watching! LA's eviction moratorium is very strict, but the ways I mention may still apply there, especially if the buyer is moving in. The tenants would need the appropriate legal notice before being required to move out (60 days if month to month and there for longer than a year). Both landlord and tenant should always reach out for legal assistance in cases like these.

      You can definitely sell your property whether a tenant is paying or not paying...no matter what the reason for nonpayment. Just bear in mind that you'll have to disclose to the potential buyer and there is a more limited pool of buyers for this scenario.

    My lease is a “year to year” lease. It automatically renews at the end of the lease term unless either tenant or landlord provides a 30 day notice at the “end” or “renewal” of lease. If my lease automatically renewed in December 2020, can my landlord wait until mid of the lease term and provide me with a 30 day notice at the end of March? After my lease automatically renewed for a year.

    Thanks for sharing. I’m a month to month tenant that pays rent. House has been placed on the market, and sale is now pending. They did their optional inspection yesterday. I have not received anything in formal writing as of yet. We’re waiting for our own mortgage process to close and are about a week ahead of the landlords buyers but. I only know this from watching the realtor listing on the web. Again no proper paperwork or notices in writing has been given. Our mortgage is going thru the process quickly, but the seller of our new home has a close plus 30 days for when we can take possession. Can you give me a idea of how long we have in our current rental/pending sale before we must vacate? I’m a nervous wreck and unavailable to communicate easily with the landlord or their realtor. But again I’ve not received anything in writing from either party. Plz, plz give me some idea of my rights as a paying month to month tenant who needs around 45 to 50 days to get into our new home. We’ve been here for 4 years. We are in the state of Michigan.

      I'm in a similar situation too! I've been renting my home for 10 years, paid rent throughout COVID. This house was NOT on the market for sale, yet some lowlife P.O.S decided to make an offer to my Landlord. Well, he called me and told me. I offered to buy the hose. So we were in agreement to do so. Well, these low life P.O.S. made a second offer, my landlord turned them down for a SECOND time. The landlord was going to allow me to purchase the home via owner financing. All was going well. Then these lowlife P.O.S made a third offer. My landlord couldn't turn this offer down, yet he told me things weren't finalized with them yet. I got me a realtor and a mortgage company who is going in hard for me. Me and this P.O.S buyer are running neck and neck for MY home.

      As for selling with Zillow, do you mean accepting an offer from their iBuyer program? You can always ask and see what they will offer, if they will offer. You'll definitely net more money by using an agent who understands how to sell in this situation. As KG said, you may want to come up with another plan and see if you can figure out a way to keep it because you will have to sell at a discount.     What Happen’s if the Tent is trying to pay the 25% of the rent, and the owner is not taking it.
    Then the oner sends the tent a letter stating that there going to sell there house?
    Can the tent tell the landlord they have the right to look for money to pay back rent?

      That's odd that the owner isn't taking it. As for selling the house, an owner can do that, but you don't have to move out just because they are selling. You would still need appropriate no fault, just cause notice. Be sure to consult with your local Legal Aid office for your rights.

    Good information Christian. I'd like to sell my property in Sacramento but my tenant with a month-to-month lease hasn't paid rent. I was in escrow and the buyer was going to move in and a 60-day notice was provided to the tenant. The tenant did not move by the notice deadline and the buyer backed out. Would you know of an agent who I can work with?

Not moving out in this situation would make it an "at fault" reason to terminate tenancy (assuming the notice was lawfully given by you).

    We had to sell a home that the tenant trashed the home and was protected by COVID Laws. Owners did pay $10,000 for them to move out. Then found out the place was trashed. Costs to fix it $15,000. In this case it added a $100,000 value. The owners really wanted to keep it but because of COVID forced to sell.
