    The frustrating part is that even though the Judge gave Trump extra time to come back from a golf to testify and still didn't show up. Trump is still going to say the Judge didn't allow him to speak and people are still going to be stupid enough to believe it.

    I honestly don't understanding the screaming thing. I once dropped a sheet of glass on my foot and broke a few bones. Didn't scream just because I was in so much pain. Another time, I turned on the lights at night only to see a possum hanging off my window screen and hissing. Scared the bejeezus out of me, and I fell on my ass and gasped instead of screamed. There's so many different ways people can react to stress, pain and fright, and it's not always by screaming.
    I wonder if there's a correlation between vocalizations and the fight, flight, freeze response. I hypothesize that silent or near silent reactions are positively correlated with freeze responses, but this might be biased since I know my default is to freeze.

      If I recall correctly, the Old Testament's instructions on overseeing a rape case has the victim screaming as one of the proofs that it was a real rape attempt and that the woman had not consented to it. That is probably where the idea of "if she was raped why didn't she scream [for help or out of terror]" comes from.
      Needless to say it's garbage evidence since there are plenty of ways to prevent a woman from screaming even if she is genuinely terrified and would scream, but since when has that stopped the deplorables?

      Same, I had an A-frame of sheet rock roll over my foot an broke 2 toes and scream at all and didn’t think they were broken til I walked into the emergency room and the doc told me they were broken. The next day pure agony.

      I'm personally someone that goes into shock when something like that happens. I fractured a bone with high amounts of pain, and I could barely let out a word. My voice was gone

    A friend of mine was raped in high school. She didn't report it because she wasn't a virgin at the time. I had to agree with her. That was the time of "well, what were you wearing?" The fact she admited to flirting first would have doomed any criminal case and just caused her pain and ridicule. It's bad enough to do it now. I had to testify a few years ago against a man who sexually assaulted me. It was almost worse than the attack.

      I was sexually harassed a few months ago, and if I got quizzed in court about what kinds of acts he was proposing exactly while caressing my back, I'm pretty sure I'd throw up immediately. I go into flight or fight mode if I hear or read the date it happened. I can't imagine testifying about actual r*pe and not having a panic attack. I hope you have found or can find peace one day.

      I'm sorry You had to endure that. The fact that police and court system revictimizes victims even in first world country is incomprehensible. I thought me having to PAY to have an obduction (assessment of physical damage and evidence collection) after I was assaulted and too terrified to go to police after terrible previous experience when my friend tried to report a grabby teacher. I'm sorry, and I hope with all my heart that You heal fully.

    In about 40% of rapes (and an even higher number when said rapes are perpetrated by someone in a position of power) the victim does not scream. It is a mix of shock, shame and desire to get it over with as soon as possible. The fact that these women were even asked in court why they did not scream is absurd.

      I think there's a number of factors for why this is a thing.
      - Our legal system is not victim centered.
      - People do not understand what victims experience, especially if they've never been in that situation.
      - A lot of people spend a lot of time arguing to explain away rape accusations. So when people hear a rape accusation, they might just be thinking about arguments about why they aren't credible, rather than what the person is actually saying.
      I think identifying the problem will help to tackle it.

      Imagine being turned away from a hospital after a major car accident because you weren't sure you screamed when your femur shattered. The mind covers up violent trauma like rape as much as it can, victims only know for certain who it was & that it happened.

    I've been SA'd and I didn't scream either. In those situations you fight, flight, or freeze. I froze. It's a very common reaction and doesn't undermine claims of a sexual assault at all.

    The thing that stands out to me is that after this case, Trump ranted about everything during his CNN Townhall on Live TV... Which means that now E. Jean Carroll can sue him a third time for EVEN MORE MONEY! She has found an infinite money machine, which I didn't even know was possible.

    For me, the most jaw-dropping part was when he told the lawyer, umprompted, that she wasn't his type and he didn't find her attractive. That for me, even more than the confusing Carroll for his ex-wife, or the "unfortunately or fortunately," was the most telling part of his deposition. Just sheer disdain for women that ranking them solely by attractiveness and demeaning them comes as naturally to him as breathing.

      Jurors have been attacked and even killed in the past when their names became known. And those, not in as high profile cases as this, but frequently involving violent common criminals.
      So, their names remain sealed, lest our court systems fail due to a lack of responding jurors.

      There's no Mafia level hit man threat in this case at all and the case has ended and the results of the case cannot be undone only appeals can be made.

    I was seriously sexually assaulted twice, different assailants, (1990) & (1996) I didn’t scream the first time because I was too traumatised to do anything other than freeze, 2nd timeI didn’t scream, my children were in the house with me and you don’t want to put your babies in the line of fire. I reported the 2nd R word, it was completely brushed off, they didn’t do an R kit (UK) the bruises I showed them weren’t photographed and the police just said that my ex would say that I liked it rough. I completely understand why E. Jean Carroll would have left it until now to report. The absolute shit storm she is facing totally shuts me up. I’m so sorry.

    It's very unfortunate but sometimes it's just based on your location whether or not you can actually report r*pe. This happened to me in my senior year of high school. Even if I went to the police right after I doubt anything would've happened. But even after me coming to terms with what had happened to me and actually talking to somebody, the school counselor asked me if that's really what had happened or if I was just blowing things out of proportion. I had never met that lady before and this of course just made me super upset. It's hard because I know that that would've been her same reaction if I went to her right after it happened. The dude didn't even go to our school, she didn't know him so it wasn't like she was protecting someone. She just accused me of wearing inappropriate clothing. It was winter and I had a skinny jeans on and a long t-shirt but honestly that doesn't matter to people. They just want to give excuses for the other party.

You didn’t do anything to “deserve” that violence and no magical number of steps exist to prevent it. There is just one person who has to do just one thing to prevent sexual assault-the perpetrator just has to _not_ commit sexual assault. It’s their fault and their responsibility, exclusively.
      The US justice system is profoundly broken-especially when it comes to prosecuting, investigating, and convicting sex crimes. Only 20-30% of sexual assault victims ever report the event to the police. You’re absolutely not required to subject yourself to that process. Whether or not “anything would’ve happened,” you have every right to refrain from that stress and potential trauma. And if you ever change your mind and/or need the police in the future, you have every right to go to them.
      You sound like a self-aware and self-confident badass. And I am truly sorry that you were ever subjected to that kind of ugliness.

      Now, if it happens a couple times, usually the deposing lawyer will usually let it slide. However, if it becomes a habit, I have seen depositions stopped and the presiding judge immediately called there and then.

    For me, the assault occurred the second Saturday in February in 1982, I told nobody, I mean nobody until October 2019. I was in the Army, and even all those years later, the VA recognized my service connected disability resulting from the trauma, for which I am grateful. Can't get all those years back, though. But even now, I believe that nondisclosure was the best thing I could have done. It would have been so much worse.

It's worth noting that not even the jury in this case thinks Trump raped Caroll, just that he's liable for sexual abuse etc. I think it's interesting to discuss the context surrounding the trial, as well as what the verdict means for the public at large, but that's probably outside the scope of this channel's discourse.

    And honestly, it’s true. I’ve never been raped thankfully, but I have been stalked and assaulted by a coworker in the freezer of the casino where I used to work in the bakery. And I couldn’t tell anyone because it was his seniority word against mine. I would’ve likely either been reprimanded or lost my job. That’s just the sad world we live in. It’s no surprise women don’t feel like they can come forward because when they do, they just get punished for it. After I left, I was informed by another coworker that he actually tried to track down where I lived. Men who get away with this stuff feel like they can get away with anything, and since I had no physical proof of any of this, I couldn’t go to the police about anything. It makes you feel so scared and desperate. Like, what CAN you even do? Often times, nothing.

    Men think they there would always be screaming, but you don't know.... you don't know what your OWN reaction will be until it happens. We want to think we should scream and kick and fight with our last breath... and maybe some people do. But a lot of us don't and it isn't abnormal, at all. Every victim experiences a unique trauma response. No experience is EXACTLY the same.

    As a lawyer from another country listening to this was interesting.
    We don't have juries or depositions like in the USA.
    Normally in a civil trial (assuming a plaintiff led the necessary evidence to sustain a case), if a defendant fails to lead any evidence (to rebut the plaintiff's version) then the plaintiffs version is accepted.
    You also, when cross examining, cannot put a version to a witness if you don't call a witness who puts that version forward.
    If you do then the judge simply ignores any version you put forth in cross examination

    E Jean Carroll was a genial television star on a network that predated MSNBC who was such a nice person that I was not surprised she prevailed. She oozes sincerity and authenticity which was hard for Trump to defend against.

    I attended a good portion of the trial as a private citizen. Very credible witnesses were definitely key to success.

      @@nigelhickman2274 Carroll’s friend did supply the date that Carroll told her it happened. I think that Trump’s own comments supplied the preponderance of evidence needed to hold him liable for sexual assault. He has said he assaults women, and when you’re a star they “let you do it”. Several women have testified that he did just that. They didn’t “let” him do it through consent but because of fear of retaliation , which is why powerful men think that they can, and so often do, get away with it.

    the fact that she made jokes about him after the fact is NOT an inconsistency and is something that happens ALL THE TIME w victims of assault. i remained “friends” with the man who assaulted for months after it happened because i was gaslit into believing nothing bad happened to me. i am disgusted by these lawyers. they know NOTHING about abuse.

    I found this really helpful in explaining what could happen in a sexual assault case. Just because looking for examples yourself usually gives advice on what to do if you are the alleged perpetrator, not if you are the victim or witness. Wish there was a series somewhere either detailing modern cases or even letting people know what happens from initial report to sentencing.

    What struck me was that so many women said they didn't report the assault or rape because they were fearful of their career.
    And that such a horrific culture norm was accepted .....
    And he don't even know who the lady was? If true, it is probably because he did similar disgusting things to too many young ladies

    Jury deliberating for only 3 hours probably means they had one vote after a brief conversation after all the normal formal stuff a jury does. 3 hours is incredibly short.

      Ah yes, because past statements make you guilty of crimes in the future. It's uninformed comments like these that make me wonder to what degree this civil case was decided by Trump's past public remarks that don't relate to Caroll's story at all. If it were the case, it would be extremely sad for our justice system. But really, is it even possible for Trump to get a completely unbiased trial? I think everyone either hates or loves him at this point lol. So maybe that's unavoidable.

      Timing. The statute of limitations was up on the criminal charge. If she had tried this in the 90's he could have been facing jail time, but he also could have had his mafia goons murder her and throw her in the river.
