  • Excessive Pricing after Aspen: Towards Better Standards in Legal and Economic Analysis
    The inherent vagueness of concepts such as ‘excessiveness’ and ‘fairness’, the institutional challenges of devising appropriate remedies, and the ensuing propensity for errors explain why, antitrust enforcers and judges shunned the application of Art. 102 TFEU against excessive pricing. That is now changing with a significant number of cases, especially in pharmaceuticals - from Aspen and Pfizer/Flynn to Gazprom and Facebook. This edition of CCP conversations discusses to what extent the lessons from these cases are pointing us to clearer standards for the economic and legal analysis of exploitative abuses.
