Sir I didn't understand one thing as you said "agar usko lagta hain questions ka answer dene ke waqt uska upar criminal cases ho sakta hain or penalty or forfeiture of property ho sakta hain fir woh answer nehi de sakta hain" Aisa kyu?? I didn't understand this line.. please explain sir 🙏 aisa kyu? If he does so then the investigation won't be completed..
As no one be allowed to give answer to police if the answer given by him would make him accused. But he can't deny if he be called as a witness in court

Sir, I have one doubt in Section 176(5). In sub section 1A of Section 176, it is mentioned that in cases of custodial death or rape, only judicial magistrate or metropolitan magistrate has the power to hold the inquiry in addition to the police, but not executive magistrate. But, in sub section 5, executive magistrate is also mentioned besides judicial or metropolitan magistrate or police although it is not mentioned in sub section 1A. Does it mean that an executive magistrate can also hold inquiry in such cases of custodial death or rape under sub section 1A?
Hi Souvik The inquiry conducted under sub section(1-A) of section 176 is an additional inquiry which is conducted with the inquiry conducted under section 174 by Police & where further section 176(1) also empower EM(as word nearest and any magistrate is used as per the case)to hold general inquiry in other cases not related to death, disappearance, rape in custody. So broadly 176(5) is talking about 174(in case of police);Magistrate under section 176(1) holding inquiries apart from the matter relate with 1A and JM/MM under 1A.
