To answer that question at the end: If both players get 3 points at the same time, it does in fact result in a tie. Had this happen to me when playing one of the Expert solo matches. Not sure if the game takes extra points into account, though, since the cap is still technically 3. For example, if both players are at 2 points each and then both Player 1's non-EX and Player 2's EX are KOed at the same time, does the game treat it as 4 to 3 or 3 to 3? You do still get the extra points added to your point total for Versus Play or Solo missions, but score-wise, I'm not sure what happens.
