    Myth: Reservations are to promote social justice.
    Fact:Those who really need them are actually unaware of them. Those who already had reservation benefits continue to exploit them. This has inspired vote bank caste politics since independence.

    Even though I come under general (no ews) I still think that this country is losing its best brains and best talent because of reservation ( in whatever means they are given ) I think educational institutions must come up with some threshold cutoff that's applicable for all categories and then give adequate representation based on social category this will ensure both quality and representation are adequately met....even US supreme court ( SCOTUS ) going to strike down affirmative action in college admission based on race as they discriminate asian Americans this goes against the very logic of civil rights act 1964 in USA...hope India strikes all quotas soon and let the country move meritorious...otherwise be happy with MEDIOCRE STUDENTS, TEACHERS , UNIVERSITY, INSTITUTIONS ETC

      Many people are sc,St, obcs have not that kind of social capital that general category persons get, in this category children are constantly taught how to learn, what to learn, they have loving parents and society loves them. So they ultimately fared better and learned better than the reservation candidates. Not remembering that many have owned business so they inherit all the benefits from the parents(though some are poor but 8 lakh ceiling is too much. Most of them are covered . Not mentioning how much St, SC, OBCs dependent on government due to socio-economic disadvantages. Such as not being able to have proper connection and information to get rich, education discrimination in private sector is well known) So if you calculate sc, St, obc income they may be less than 8 lac. So why are they excluded from EWS.
      BY THE WAY MARKS AS A SOLE CRITERIA FOR MERITORIOUS CANDIDATE IS FALSE, SINCE REAL LIFE IS NOT MARKS, ONE MUST SKILL, ATTITUDE, HONESTY, SOCIAL SKILLS AND I DONT THINK CLEARING A CUTT OFF SANCTIONS A PERSON AS MERITIOUS

      @@husky5912 yes bro you too speak logic in marks that they don't mean everything in life...career and opportunities should be evenly recognised on the basis of individuals talent and not about their background they com from rich or poor , rural or urban , male or female etc...if you keep allowing barriers like this then people with real talent can't succeed in their own country and have to move on...take china , Korea , Japan they were affected by devasting world war 2 , civil wars and communism etc they faced bloodshed than India and look where they are now and see India's performance we are far behind them just sayin india is a 5th largest economy is baseless unless per capita income is somewhere crossing 12k US$ according to leading international institutions to be fit in developed or middle income nation...if u think people can be happy with average performance can make best things then I'm sorry u are disappointed...our country needs to put right people at right place at right time without looking at their identity rather than individuality hope u understand it!!!     A monumental judgement. Just the other day I had written about alternate ways other than the current system of reservations for inclusive progress of society. We have to find better ways other than reservations and subsidies. But for sure we have to carry everyone. I do not by any stretch of imagination suggest that we must do things pronto. We have to find better ways over time….
    Tailpiece: EWS is one of them; skill enhancement, dignity of labor, appropriate compensation, improved primary and secondary education, equal positions in society etc… are some of the others

    This is Step 0. With Aadhar etc., they do have the data for a holistic metric. Access to good schools, income, region, urban/rural etc. Step in the right direction, but honestly could have done much much better.

    A good overview. But since you have focused more on the Descent Judgements and why they choose the same. You could/ should have also given the reasons for why the Majority judges upheld the ammendment in a bit more detail.

    One day EWS must be extended to all Indian citizens.i.e India focusing on last 10% of population with vibrant welfare & education/training systems. Others could compete on their own, not the last 10%. They need focused care! Definitely filling them in universities & governments positions without merits is flattening all developments. Only open merits based placed people can lead all including the weak. The last 10 percent EWS is generally broken in familywise, education wise and may be physically/mentally challenged too. India must take care of them! From rich & clever to poor & weak wants free things. (Welfare means not freebies but economic support for job trainings, job placements, and food-medicine-physical aids.) The people must be uplifted that they can live independently.

    my understanding is that this EWS reservation has a lifespan of around 30 years. After that it will be deemed unnecessary and removed. If this is to be challenged then it has to be challenged within this time-span. Else it will die on its own.

    Question arises how long will the reservation be continued ? Even though I am a OBC ( for disclosure ) I support merit based selection . With time the percentage of reservation should have been reduced but instead they have increased reservation percentage to more than 50 %. The fear is since the upper limit of reservation of 50 % is broken now the percentage of reservation is limitless . Now every political party will promise higher reservation for each n every caste/ language ( for example Marathi quota ) for votes. The extra reservation will be taken from the remaining 40 % of merit . Maybe in few years the whole 100 % will be divided under headings of reservation based on caste/ ethnicity/ language, etc . This will lead to social instability . People from every caste n every state will start fighting with each other for reservation after the whole 100 % or more than 90 % is divided under reservation ( I am talking abt future hypothetical situation ). This may lead to lot instability n left behind in the economic front to compared to other nations . Talent from India will be drained to other nation such as UK ,US , etc becoz these nations respect merit .

      I pity you that despite being from OBC, you struggle to understand the importance of backward caste reservation.
      What you are saying is coming out of shame that forward castes have repeatedly dumped in your brain that you feel bad about it.
      Just so you know, if caste-based reservation is scrapped, forget SC & ST, majority of OBC won't be able to make it to top educational institutions and it won't be becoz SC, ST or OBC are incapable lowly peeps (as forward likes to label) but becoz competition has never been fair between forward & backward despite reservation. resource / asset gap is so huge that even if they sit idle, you will need 2-3 generation to match them resources wise. (They btw won't be sitting idle)
      Plus their networking is way too powerful than you understand and it has its genesis in caste comradeship so forget that you will have better scope in job market in post caste-based reservation world.
      Do study about the political economy of Tamilnadu to understand how it has simultaneously ensured social and economic justice for its citizenry. It is very naive to say that social justice comes at the price of economic justice.
      Don't wish such thing. There will only be regret & pain if what you say, comes true in entirety.

    To note of other forward class people to get your 7 percent separately separate from that 3 percent community otherwise you won't get anything ..... file case look at all high institutions and everywhere you were no where ..... so get quota separately.... All states all do the same .... These only help poor in rest of forward class..... Suggestion from OBC

    Economic criteria should be tge sole criteria for upliftment of the poor. The poor are just poor. Poverty is like a disease ,which does not discriminate between one from another. All suffer equally. Further, the wily politicians and a certain section of leaders among reservationists promoted casteism for electoral gains. That completely twisted abd changed the outlook on reservation. Once let loose , the demand for reservation by more castes is bound to grow up. Where and how it would all end up,nobody knows. The politicians and the parties,however would co tinge to bake their bread in the heat of controversy. It seems that Pakistan and reservation are two issues ,which may perhaps long lives.

    This is nothing but a rather hasty Amendment (103rd) to say the least. There has been lack of deliberations and inadequate expertise to frame such a legislation in the Parliament. Atleast could have sent it to a standing committee for further introspection and evaluation of the reality prevalent in the society.
    There multiple aspects to ponder upon: ¶ Who is this EWS quota for??
    ¶ What is the parallel to those who are categorised under OBC creamy layer??
    ¶ Does this create a balanced approach in progressing the society keeping in mind Article 46??
    One of the main criteria for the creamy layer exclusion for OBC quota is income cap. Which has to be less than Rs. 8 lakhs p.a and u qualify for it (obviously along with listed OBC category).
    However what happens to a person who's parent earns Rs. 8.24 lakhs p.a? He automatically becomes a "General Category" individual. He cannot avail the OBC quota just because the income cap has been breached by 0.24 lakhs, and hence creamy layer is applied and exclusion from OBC quota takes effect.
    Now coming to the EWS quota, which has placed the income at Rs. 8 lakhs p.a. Who's is the beneficiary here??
    ~ A candidate who's belonging to a community that is non-SC/ST, non-OBC. In other words an 'upper caste' individual who's not breached the income limit of Rs.8 lakhs p.a.
    So we have Two individuals:
    a) An OBC, income: Rs. 8.24 lakh
    b) An upper caste, income: Rs 8 lakh
    The OBC individual here is automatically categorised as "General Category", while the upper caste individual here can avail the "EWS" quota.
    So who's doubly jeopardized here?
    ~ The OBC individual who is deprived of his opportunity which should have been given to him because of the 'social injustice' that had been plaguing his community for centuries.
    On the contrary, the EWS facilitates an Upper caste individual who is free from a history of 'social injustice' in the likes that had occured to the OBC.
    This is creating an imbalance to the progress envisioned in Affirmative Action. This legislation if anything is depriving the OBC and benefitting the upper caste. The judiciary 3:2 verdict seems an unbalanced verdict, nevertheless it is not a socially uplifting judgement!

      It actually benefits Muslims esp. they are likely to be the best beneficiaries of this quota reason being most of them do not fall under reserved category.. This will usher development where the poorest of the poor amongst Muslims but intelligent children have to join Madarsa instead of formal education. their disinterest in studying religious education lands them up in taking odd jobs .. the only way Muslims in India can become developed akin to their counterparts in Indonesia, China and Turkey is education. here i am referring to Urban poor among Muslims. we need to harness the demographic dividend... by formalizing education making a better nation

      @@srinivasvyasarao I'm talking in terms of proportional aspect here of the entire legislation of this amendment. That's why I mentioned it has been deliberated hastily. There are so many loopholes here. First and foremost, it's projecting an uneven competition, i.e, benefitting Forward class folks, the entire issue of social backwardness is brushed aside here. There is no level playing field for either the OBC in direct or those classified as Minorites within the general category now. I'm aware of the Ashraf muslims in General category and the ajlaf/pasmanda muslims in OBC and those with designated MBC. Thus far, even within general category there is a sub column for minorities but now when u create a 10% reservation under EWS and facilitate even the Forward classes to compete in that zone, the level playing field in terms of social backwardness is gone. Again i repeat, this whole amendment is not introspected well enough, it is criss crossing a number of issues, vertical and horizontal competition within this 10% will create an number of problems in reality

      @@dev7155g there are a wide range of specifications for OBC-NCL quota eligibility.. from the cadre level in government employment to income caps. The point I'm making is clear, how can we juxtapose Social backwardness of one section with the Economic backwardness of another section in the same general category? The whole concept of reservation came to be for social upliftment as priority, if we are complexing social backwardness and economic backwardness of two different communities under one zone of reservation then that's only making it complicated.

If not single caste comes out after 70 years reservation than reservation system is useless,

    Reservation is not a poverty alleviation program.. It is social representation scheme for all community...finally every community have reservation... So nobody will be speak about anti reservation

    Our beautiful country want casteless socity so they started giving caste certificate, want casteless socity so they demanded we need survay based on caste, we don't want our merit to go outside country but we don't give them justice based on merit .. we want want social justice so now we don't support merit .. if someone really want social justice then give free best education, free equipments for education but no we choose to give jobs based on caste no matter how much inefficient they are .. and we still confused why our best brains leaving country .. wah reee hypocrisy ..
