Eric Busts It was a training drill and the woman screaming was part of it............it's not illegal for them to close down streets for training exercises. I don't know where you live but they do this all the time in CA. The streets are generally not arterial streets so not to impede traffic flow or congestion. Signs get posted for a couple of weeks before they even close down the street and then it only lasts for a short period of time. You have to have a drill in a real setting to be productive. If your going to make a statement like that you need to cite the ordinance.

It is a protection for you as a citizen. At what point during your filming did you NEED to see his ID? Was there any doubt that the persons asking you to step away were not officers? Did they ask anything of you that made you feel that you needed to be assured that he was a real officer? No. You were just doing it because you "can" - and at a time and place where they were training for emergency situations. But like I said, it was overshadowed by you being annoying. Steve Giles The first one by - Not IDing himself like he's suppose too. That is the law. Just like when a cop forces you to ID yourself a cop by LAW has to ID themselves to you when asked. Everytime the guy asked, the cop avoided the answer or said no. When the sgt walked up he did the same thing till the very end when he offered to give his ID(since he already won) but still didnt give up the other cops ID. As for the sgt, he broke the law by forcing them to leave a public place when they were doing nothing illegal or causing a public disturbance. It could be argued that they walked away on their own but he threatened arrest, so that would go under being forced to leave. The police cant just make you leave a public area because they say so. They have to have a good reason to make you leave. Which in this case it wasnt a good enough reason. Why you dont see "No trespassing" or "Do not enter" signs. Its because the police cant stop you from entering the area. However if you got in the way you could be arrested for it. but you Are allowed to be there.

yea, it's a public sidewalk, but just like Concerts, festivals and city events, they can be held to private permits that stop the public from entering without concent from the operating crew or management of said event. The Tape and traffic cones were clear indications of boundaries set, by the Training Team. They were trespassing on a controlled Street plain and simple for the sake of vilifying police.
Hire a private training facility if you don’t want the public to film... The right to film the police from a public space is well established in The First Circuit Court Of Appeals. Massachusetts is within that Court’s Jurisdiction.

I don't see the officer acting out of context. The cop isn't being an ass. There's obviously a issue going on. People need to use common sense and when to act on their civil right and when to be polite and courteous in certain situations. No ones getting slapped down by police or beating. I work in Boston as an ED nurse. I was called into work the day of the Boston Marathon bombing. I was almost strip searched before allowing access to the building. While the police were searching for the brothers the 4th amendment was suspended. Cops entered homes no warrants were issued. Homes were searched people had to come out with their hands on their heads.
Probably posted before, but searching for secondary bombs among "victims" meant to attack first responders is SOP worldwide. If the recording of this exercise isn't of public interest, then nothing is. Cop had no cause to escalate, and actually had a great opportunity to explain what was going on, not to say they should have had a PIO on site in the first case. In addition, this adds realism to what will happen in the event of an actual event.

I don't know where you live but they do this all the time in CA. The streets are generally not arterial streets so not to impede traffic flow or congestion. Signs get posted for a couple of weeks before they even close down the street and then it only lasts for a short period of time. You have to have a drill in a real setting to be productive. If your going to make a statement like that you need to cite the ordinance.

Normally, I am all for the freedom of press and all that, but this guy was actually in the wrong. the City had obviously sectioned off the area for the purposes of this "drill" which is obviously for the purpose of them being able to protect and secure people and areas during a disaster or terrorist attack.....all this guy was doing was disrupting things and interfering with LEGITIMATE public safety efforts, personally I have to commend the Officer on his level of Restraint because I would have arrested them as soon as they tried walking over to where the "drill" was happening since they had already been told to stay put...........this has NOTHING to do with the 1st Amendment, this has to do with some jerk trying to be an ass using the 1st Amendment as justification........frankly I see alot of these kinds of videos....

You were not standing up for anyone's rights. Any good point you had were overshadowed by the fact that you were just intentionally annoying the cops. They are taking part in training exercises. The Sargent was cordial and even humble with you. He even asked you kindly if you would step away and gave you a good reason.
Let me give you an example: I have the right to follow you around the street all day and walk 2 steps behind you. It is my constitutional right. lol. But why would I act like a nuisance? Just because I can? What you did in this video doesn't help your cause. It doesn't build working relationships between the community and law enforcement. It shows lack of respect for what they were doing - which in this case involved training exercises intended to protect YOU. Fine, asking the officer to show his ID is a valid right. It is a protection for you as a citizen. At what point during your filming did you NEED to see his ID? Was there any doubt that the persons asking you to step away were not officers? Did they ask anything of you that made you feel that you needed to be assured that he was a real officer? No. You were just doing it because you "can" - and at a time and place where they were training for emergency situations. But like I said, it was overshadowed by you being annoying.
I am all for "know your rights" videos. That's how I came across your video. But I believe we should treat officers like we would want to be treated and show a little more respect because they risk their lives for us. That doesn't mean I would let myself be bullied. There should be communication and understanding of situations. But this was not helpful. I hope you don't do something idiotic like this during a real emergency - just because you can.

Steve Giles The first one by - Not IDing himself like he's suppose too. That is the law. Just like when a cop forces you to ID yourself a cop by LAW has to ID themselves to you when asked. Everytime the guy asked, the cop avoided the answer or said no. When the sgt walked up he did the same thing till the very end when he offered to give his ID(since he already won) but still didnt give up the other cops ID.
As for the sgt, he broke the law by forcing them to leave a public place when they were doing nothing illegal or causing a public disturbance. It could be argued that they walked away on their own but he threatened arrest, so that would go under being forced to leave. The police cant just make you leave a public area because they say so. They have to have a good reason to make you leave. Which in this case it wasnt a good enough reason. Why you dont see "No trespassing" or "Do not enter" signs. Its because the police cant stop you from entering the area. However if you got in the way you could be arrested for it. but you Are allowed to be there.

yea, it's a public sidewalk, but just like Concerts, festivals and city events, they can be held to private permits that stop the public from entering without concent from the operating crew or management of said event. The Tape and traffic cones were clear indications of boundaries set, by the Training Team. They were trespassing on a controlled Street plain and simple for the sake of vilifying police.

Hire a private training facility if you don’t want the public to film... The right to film the police from a public space is well established in The First Circuit Court Of Appeals. Massachusetts is within that Court’s Jurisdiction.

He politely asked the guy to film on the other sidewalk as their clearly using the other sidewalk. He's not blocking their view or asking unreasonable demands. People need to use common sense and when to act on their civil right and when to be polite and courteous in certain situations. No ones getting slapped down by police or beating. I work in Boston as an ED nurse. I was called into work the day of the Boston Marathon bombing. I was almost strip searched before allowing access to the building. While the police were searching for the brothers the 4th amendment was suspended. Cops entered homes no warrants were issued. Homes were searched people had to come out with their hands on their heads.
Yeah, and that was really useful, too. They didn't find them in any of those homes. Security theater.

If the recording of this exercise isn't of public interest, then nothing is. Cop had no cause to escalate, and actually had a great opportunity to explain what was going on, not to say they should have had a PIO on site in the first case.
