You have ample evidence via the email exchanges that this individual was, in fact, seeking an interview with you, which lends to the argument of possible not so hidden agendas and motives. BTW, RUclips permits opinions and commentary by creators on other people’s content. RUclips does not permit the weaponization of the TOS and I don’t think the court system will react kindly when it finds out this creator is suing multiple creators AND was trying to secure an interview with you. The email exchange is quite telling of this other creator’s possible motives.. Talk about a waste of the court’s time. And even after they dont show up to mediation I would still have to go the route I am with the regular court case. All that just to say they refused mediation, in a case I believe I am pretty much sure to win in fair use seems like a waste of time and energy to me. i could see if this person had a leg to stand on and I was worried about losing then maybe trying other tactics would be worthwhile, but here imo it is not

Offer to set up a Zoom (or virtual) mediation session with a professional mediator. When plaintiff declines, you can use that against him in court.
