A Khasra Girdawari is a legal document and a revenue record which is used to specify the land and its crop details. And partition of the joint property means dividing the land/property among the individual owners/sharers of the same. The revenue record i.e., Khasra girdawari may reflect as to who is in possession of the said land, name of cultivator, land/khasra number, type of land and its crop, etc. Therefore, solely on the basis of the same, no partition can take place. To partition an agricultural land, a proper case has to be filed before the revenue authorities which requires relevant documents pertaining to the land. The documents required to be attached along with the application for the partition suit are latest Jamabandi, Girdawari, Aksijra (Map of entire land to be partitioned), and Naksha Uda (documents showing the share of each party in the land to be partitioned).
After the order of the Revenue officer , the copy of the order has been applied but the copy is not issued because the order has not been written by the Revenue Officer and the opponent party manages to get the instrument of partition on 30th day by hook or crook what is the remedy for the party who wants to file the appeal
Insofar as the right to appeal is concerned, every person has the right to appeal against the order of any judicial officer within the limitation period. Regardless of the fact that the order has been procured by the opposite party. The limitation period for appeal starts from the date on which the parties receive the order’s copy.
