    If I was in a car in that situation and saw a motorcycle filtering behind, I'd just change my lane position to allow them to progress more easily and safely. It's a total no-brainer. Sometimes you come across a police officer who's let their power go to their head a little, but there's nothing you can do about that.

      @@ChrisPatrick-q6k here in New Zealand the NZTA have identified that it is more dangerous for motorcyclists to wait patiently in the queue, and have put in place rules that keep motorcyclists safe, such as filtering, lane splitting, use of bus lanes and transit lanes. What this rider is doing is actually the safe option.

    Also a retired Traffic officer, there was not a lot of room but it wasn't the fact that the officer said to the rider( i Ride motorcycles too) It was how he said it!!!'Hang back please rider theres not a lot of room beside that lorry" would have been a better response and you probably not have been sent this clip!!

    I understand the argument but I ride a motorcycle and I had exactly the same situation on a road in Wales last year, the traffic officer in that situation moved over for me to pass.

    I would have filtered too. Once I was behind the lorry I would have stayed in view of his mirror and waited behind him. If he saw me and moved over all good, if he stayed where he was, I would have stayed behind him. Most lorry drivers are super respectful of bikers and would move if they saw you.

      100% agree.
      Was he filtering between the cars and the cones or was he simply overtaking as there was room and it was safe to do so.
      I've ridden on the road for almost 50 years.
      The cop clearly saw him coming and most traffic officers would have moved to the left and given him more room to overtake.
      This particular cop was being a complete dick and a complaint should be made to his force.

    2:44 naa loads of room, no need to cross the cones. The lorry is not going to jump sideways, you just take each pass at a time when it is safe.

    From a retired Traffic Officer, the police officer was in the wrong. Over bearing conduct that does the police no favours at all.

      Thanks for your honesty, and imo the traffic cop was just being very pedantic, and as a now retired artic truck driver of 35yrs, I always knew what was in my mirrors and not just in this instance, and always pulled to the left slightly (if I could obviously) and let motorbikes past, and then the bikers could keep rolling, rather than stop starting. Most bikers acknowledged the truck drivers 🚛🤝🏍

    I have filtered through traffic many times in the past without any pronlems. In fact, many motorists pull ove when they see a motorcycle in their rear view mirror. In this case I would argue that the cones were the outside line and there was plenty of room to pass. If the lorry was too close to the cones common-sense would prevail and the filtering would have stopped. I think the real problem is the cop didn't like the motorcyclist appearing to jump the queue.

      The cop was driving in considerately as he deliberately drove his cop car to the right of his lane when he saw the biker approaching from behind in his mirrors to prevent the motorcyclist from passing. How pathetic was that? He should be sent on a driver awareness course. The motorcyclist hadn't done anything wrong. Nothing.

      Also let's not forget the police officer became a distraction by flailing and shouting out. The cones are within the other lane, this a new broken lane line was created, he assessed the gap was enough, so he's taken reasonable steps to remain safe. I'm not a bike person and where I live in Bristol, they are quite often not as safe or polite about filtering. The only wrong I see is the ego trip wannabe in the car.

    The alternative question is having seen the motorcyclist cautiously approaching, why didn't the police car move over in the traffic lane in order to give the motorcyclist room to pass?

      Stupid ignorant reply from you, why did the motorcyclist not wait like every other road user what papers or laws, give it over everyone else ? Bet if a car or worse a lorry was within a foot foot and a half of you passing you would cry foul.
      The other lane ie the closed lane in practicality does not exist as it is officially closed for whatever reason. The motorcyclist has to observe the law and observe safety and be responsible for its own actions sick of people like you bey your the sort who loves the sticker "THINK BIKE" with no regard the sticker is better saying and more factually correct if it said "BIKE THINK" we do not know from this video why the other lane is shut, it could be debris it could be animals or works ongoing it might even be for work to start that night a few hours later etc, you don't need to know you need to follow laws and common sense re safety.

    I'm a retired UK area car driver. I would have pulled to the left to assist traffic flow. This H Youth 'roads policing officer ' needs to take a look at his behaviour. Policing is by consent in the UK. This officers behaviour is selfish and erodes public good will. Poor policing IMHO.

      That would have been my approach. In a queue of this nature, I would expect a motorcyclist would attempt to 'filter' through, and I would be prepared to move left to give him room.

    As a biker, I can say that we're taught to "make progress" which may require (careful) filtering, and I believe it's possible to fail your test if you don't make progress given the opportunity.
    Filtering is a skill and requires a great deal of care and attention, which I believe this m/c demonstrated well, and my experience over many years is that the majority of drivers will move over to allow m/c more room for filtering. As for the fact, in this instance anyway, there are cones to one side, that's irrelevant. From the admittedly limited view, the officer could easily have moved to the LHS to allow the m/c to move past safely and I'd even argue, from my estimate of the lane's width, that the officer was deliberately positioned to the RHS of the available lane, effectively preventing the m/c from passing - I hope I'm wrong about that. The fact that the m/c still believed he could filter safely, seems to have enraged the officer for no good reason as his attitude seemed somewhat confrontational and belligerent.
    I note you also mention that the m/c wouldn't have been able to pass the HGV safely, but again, in my experience, most HGV drivers are extremely considerate and will, assuming they see a m/c behind them in such a situation, move to the LHS and even indicate left or use a hand gesture to acknowledge the m/c to pass them. Many HGV drivers are also motorcyclists anyway, so that may explain it.

      Well put Phykell. Was there another part before this that we didn't see that irked the enforcer perhaps?
      I don't worry about filtering past police when I do it. Slowly and progressively past every obstacle that's what we're told.
      Do you honestly think an examiner would have an issue with this if this was your test, and you feel you are able to filter without putting others at risk. I think not. Any rider may not want to do a specific manoeuvre that they feel uncomfortable with.
      Risk and reward.
      Cones or no cones, it's still FILTERING past slow moving traffic.

    As a cyclist I can recognise an obnoxious car driver when I see one and I see one here.
    Some car drivers really hate being over taken by bikes and di what they can to stop them.
    Personally, I wouldn't overtake a police car as I don't trust the police not to be difficult and stroppy and cause a situation where none is needed.

    …..but he hasn’t reached the lorry and you don’t know how the rider would handle that because it hasn’t happened yet.
    Filtering is legal, there is space, it’s up to the motorcyclist to determine what he feels safe enough to do and until he does something actually wrong the police officer has no business trying to police his behaviour.

    We filter through because it's safer than sitting in traffic. Remember, we don't have crumple zones. If there was a pile up, the biker gets crushed. Better to get out of the way.

      I have heard such a ridiculous explanation of why motorbikes filter and I spent most of my early life on the back of bikes with friends... As the comment says above most of it is to do with being impatient. I have seen so many times when bikes are pushing such small and stupid spots.

    The lane is shut therefore this is exactly the same as if there was a queue of slow moving traffic on a single lane road. The biker is perfectly within his rights to slowly, safely, and carefully overtake the slow moving traffic providing he doesn't cross over into the closed lane to do so. And good practice would also be for other road users (including police) to move over to the left where safe and reasonable to do so in order to give the biker more room to safely pass by. So in the instance shown, the biker did not have room to safely pass without crossing the white lines so should have waited for the police car to move left which the police car should have done as soon as he saw the bike approaching in his wing mirror.

    Its legal and low risk, if it was a single carriageway it would be an overtake, again perfectly legal and low risk if done carefully.

    It isn't filtering. It is just overtaking. Motorbikes can overtake on a single lane road if there is space to do so.
    The reason there is a specific rule for filtering is because it involves undertaking, which is usually discouraged. Filtering is an exception to the rule against undertaking. There is no undertaking here, so we can just apply the usual rules for overtaking. Overtaking requires enough room to do so safely without crossing a solid white line. This looks safe to me as long as it is done at very low speed.

      Filtering is "overtaking" Slow moving traffic. Im not sure where you got the idea that filtering is undertaking, undertaking isnt filtering, its undertaking and shouldnt be done by motorists unless traffic forces you to do so.

    From the perspective of a motorcyclist, and one who has filtered many many times, there are two terms used in motorcycling, filtering and lane splitting. When discussing filtering on a training course the instructor asked if we would go down between the two vehicles, and suggested that he would use the area to the side of the vehicle closest to the grass, in this case to the left, but if the other lane was open to the right. His logic for this is that if a vehicle were to change lane position as he was approaching he would have a escape route.
    I came up behind a long tail back approaching an accident, and ran all the way along the line between the first lane and the hard shoulder and the police were totally cool with that.
    As for this police officer, as I said when I watched the original video, I would have suggested to him that sticking his arm out of his vehicle to stop a motorcycle passing was a sure way of loosing his arm, and that if he caused an accident that I would be looking to have him charged with dangerous driving. It's on the motorcyclist to ride safely not for the police to second guess what might happen.

    I am an ex-police officer. The officer was wrong, rude and aggressive. The motorcyclist was riding slowly and sensibly, no danger would've been caused. I honestly think the officer is thinking, "if I'm sitting in traffic and then so are you". What's the point of causing more unnecessary congestion and unnecessary pollution. If I had been the officer, I would've instead moved my car over a bit. But even without him moving over, he's perfectly entitled to pass you.

      You are not allowed to overtake if there isn't a gap to overtake into. No clear road ahead = illegal to overtake. It's also specifically illegal to overtake through roadworks. Section 167 of Highway Code.

    Sometimes as a motorcyclist you just have to sit in traffic with everyone else. Personally I wouldn’t be filtering if the traffic is moving in this case because there are too many clowns that will deliberately move over to block you. If the traffic was stationary I would do so at walking pace being extra vigilant. It can be decidedly unhealthy to sit still on a bike with all that gear on in the heat

      Yea, in Canada they aren't allowed to filter.
      The missus and me went there holiday as a recce as we were thinking of moving over there. In stand-still traffic we saw a poor guy on a bike in the sweltering heat trying to get as close as possible behind a u-haul the get into it's shade. Massive wide roads, no filtering and 55mph speed limits. Those two things alone killed the idea of moving there for me.

    Maybe the rules suggest that single lane filtering is not filtering. The difference in safety though seems backwards.
    With two lanes of traffic a rider creates a 3rd down the middle meaning intermittent reaction gaps to each side whilst passing vehicles. With a single lane like this the rider has an intermittent reaction gap to the nearside and a continuous one to the offside, (until the lane closure).
    The "what ifs" are the same in either filtering scenario. Be safe, be slow, keep distance. Not sure why having a wall of traffic to your right is somehow safer than having space....
    If the motorcyclist breached some law then the officer should have dealt with it accordingly. Otherwise, dont stick your hand out and rant at another road user for no (apparent) reason....🤷‍♂️

    I'd argue the assumption of two cars between two separate lanes for filtering is not the only use case of between if this went to court. He was filtering between the open lane and the closed lane that is still between two things and aligns with many other use cases of filtering. Between the pavement and cars for cyclists, between the pavement and cars for one way streets etc.

      And
      be aware of other road users, especially cycles and motorcycles who may be filtering through the traffic. These are more difficult to see than larger vehicles and their riders are particularly vulnerable. Give them plenty of room, especially if you are driving a long vehicle or towing a trailer. You should give way to cyclists when you are changing direction or lane - do not cut across them.
      Neither of which go against what I said, you can be filtering through the traffic without being between two active lanes still. Lane one is still traffic

      I'd have to disagree, in this given situation everything to the right of those white lines is essentially non existent. If he had done this on a motorway with a red X above it he'd be fined and potential points on his license. 167 of the highway code also 100% supports the officer here as well which specifically states "Do not overtake where traffic is queuing at junctions or road works".

    Filtering is completely legal in the UK and what the biker was trying to do is perfectly legal and safe. The copper is just upset that he has to sit in traffic. So he thinks everyone else should too.
    I bet his other car is a beamer. BMW drivers always throw a wobbler when another road user over takes them.

      If the cones were exactly on the line I would agree but they were foot or so beyond it so allowing room for motorcyclists, pedal bike riders, e-bike and e-scooter riders to pass safely whilst filtering.

      @@mikehipperson they are not on the white line because some vehicles are wider than others, this is also a duel carriage way so I can be 100% confident in saying e bikes/e-scooters (which are banned) and pedal bikes would not even be allowed on this road unless thats changed

      ​@123TheCloop It does appear to be a dual carriageway. But with the cones in place it's a single lane dual carriageway.
      With regards to differing widths of vehicles, there is a minimum requirement for shuttle lane width. In this case it would be 3m, allowing for HGVs. But it's normally better to give more if the road is wide enough. It means oversized loads don't knock over all the cones.
      Imo, just because there's space to overtake doesn't make it safe.

    I ride and have some rules I follow when filtering - 1 never do it on the approach to a roundabout - 2 never do it when the traffic is moving more than say 10 mph - 3 never do it when there's any road works.. I know I can filter in these cases, but I think its a high risk situation.

Nothing was coming from the other direction as it was what we call a dual carriageway, there being an identical carriageway on the other side of the divider for traffic driving in the other direction. Should the rider have come across the actual road works I'm sure he would have had the sense to merge to avoid any potential obstruction. It wasn't as if he was speeding past the stalled traffic so I guess he was very aware of what was happening. A pissed off cop with nothing better to do!

    The highway code talks of other road users needing to be aware that in slow moving traffic bikes may filter on EITHER side. As the edge of the lane is the only thing to the left side and passing that side is filtering, then the highway code's definition of filtering need not involve being between two lanes of slow moving traffic.
    Your mention of being rear ended and not always innocent reminded me of a contentious video on Ashley's channel where a car joins heavy traffic from a side road, putting the car where the cycle would have come to a halt, steeling a little of the large but necessary breaking distance the cyclist had given himself due to his speed, the rain and the downward slop.

    I'm not a motorcyclist, and I don't see an issue with the motorcyclist in that clip. I do however see yet another self-righteous police officer who can't help but throw his weight around!

    I am not a motorcyclist.
    There is more than enough road space for the police car to allow the motorcyclist to pass!
    The police car could have moved over to the left easily.
    They are just on a power trip and exercising their 'authority'.
    If the driver of the police car was paying attention, he should have been aware of the motorcyclist approaching for some time and been able to give him plenty of room to pass safely.
    Also, sticking his arm out of the window is quite possibly the most stupid thing I can think of for him to do!
    Clearly the motorcyclist was really paying attention to the road ahead of him.
    He was quick enough to stop when a totally unexpected event occurred without warning, or reason.
    Taking the BBB point about passing the truck in front of the police car.
    I used to drive trucks(over 30 years experience in the UK and Europe) and as a professional driver I was constantly aware of vehicles around me, particularly anything approaching from behind.
    Having been stuck in many similar situations, in trucks, vans and cars, I always keep a check for motorcyclists approaching.
    Were I the driver of the truck, I would have already moved to the left side of my lane before the motorcyclist had reached the police car.
    I would have done this to enable him to pass without need of being close to the cones or my vehicle (To be honest, I probably would have 'defaulted' to keeping over in anticipation of motorbikes doing just that).
    There are 2 reasons for this.
    First being, why hold up a vehicle in traffic unnecessarily?
    Be courteous and allow the rider to be on his way.
    The second being, I would rather he pass me on my driver side, where I can see him where it is safer for both of us and that also means, there is 1 less thing for me to concentrate on, knowing he has already passed.
    Another point, again from my experience of working for many years in highway maintenance, installing and repairing VRS (crash barriers).
    1 less vehicle stuck in traffic on a hot day, when exhaust fumes are probably hanging in the air is a definite bonus to a worker on the road.
    The only issue I could possibly have with the motorcyclist would be if I were in a maintenance vehicle, approaching a works access, with my beacons and indicator on, showing I was about to enter said access and THEN he passed me, but this was not the case here.
    So, despite my having been in either of the 2 groups of people who could have been potentially affected by the motorcyclist, I still believe the policeman was just being a dick, because he has power.
    I bet he would not have behaved that way had it been one of his colleagues trying to pass on a motorcycle!
    If there is room to allow the bike to pass safely. be courteous, move over and let him pass, don't be like this police officer.

    But what would the offence be? "Dangerous driving" (Section 2 of the Road Traffic Act 1988), "Careless, and inconsiderate, driving" (Section 3 of the Road Traffic Act 1988), or something else?
    AND, if the rider chose to ignore the direction and carried on filtering, would they have committed the offence of "Drivers to comply with traffic directions" (Section 35 of the Road Traffic Act 1988), and would they be guilty of 1 or 2 offences?
    My assumption is that for Dangerous or Careless driving, the milestone it is judged against would be the Highway Code:
    - Rule 162 advises that before overtaking you should make sure the road is sufficiently clear ahead, there is a suitable gap in front of the road user you plan to overtake, and that no one is overtaking you.
    - Rule 163 describes how to overtake safely, including not getting too close to the vehicle you intend to overtake, and ensuring that you can complete the manoeuvre without causing danger or inconvenience to others.
    My belief is that the road is sufficiently clear ahead, and there is potentially enough room to pass safely without putting the other road user at risk. However, the super power the police had in this instance, is "Drivers to comply with traffic directions" (Section 35 of the Road Traffic Act 1988), meaning the rider had to comply with the crappy direction.
    Inversely, the Police driver could be more courteous and move over for the motorbike to pass with ease. Considering the attitude of the police driver, and their refusal to move across, I would suggest the police driver is guilty of Careless, and inconsiderate, driving" (Section 3 of the Road Traffic Act 1988):
    - Rule 147: This rule explicitly states, "Be considerate. Be careful of and considerate towards all types of road users, especially those requiring extra care (you should give more space to cyclists, motorcyclists, horse riders, and pedestrians)."
    - Rule 148: Addresses safe and courteous driving behavior, advising against driving aggressively and reminding drivers that the road is for sharing.
    - Rule 168: This rule specifically advises not to hold up a long queue of traffic, especially if you are driving slower than the rest of the traffic. It suggests that if there is a safe opportunity to let vehicles behind you overtake, you should do so. This is particularly relevant on roads where overtaking is otherwise difficult or dangerous.
    - Rule 169: Also advises not to hold up a queue of traffic. Drivers should pull over where it is safe and let traffic pass if they are moving slowly and causing a build-up of traffic behind.
    It appears to me the police driver broke each of these 4 rules in the context of a motorcycle behind them, which means they should be reported of the offence of "Careless, and inconsiderate, driving" (Section 3 of the Road Traffic Act 1988).

      Yes. Dangerous/inconsiderate driving would be the offense. As soon as that bike hits any HGV he'd be forced to stop, and be precariously balanced in a 1/2' wide gap next to another vehicle unable to proceed. They can see its a traffic jam, they can see traffic is near stationary. The idiot endangered his own life by not moving to the middle of the lane and queueing with the rest of the people in the lane. Anyone with half a braincell can tell there won't be space to pass any wide load which is near 100% guaranteed to be at some point in the lane. Cop rude? I'd be rude too if I saw some moron endangering his life like that.

      Driving without due care and attention. RTA 1988. Overtaking rules are in the Highway Code with a DO NOT, meaning legal force. It's a minor infraction, so careless driving only, not reckless or dangerous.

      ​@@davcrav I fully appreciate the Highway code isn't law, but it can be used to underpin the definition of an offence. Specifically, Section 3 which is "Careless, and inconsiderate, driving" is defined as driving: "without due care and attention" OR "without reasonable consideration for other persons using the road or place".
      Section 3ZA(2) defines "driving without due care and attention if (and only if) the way he drives falls below what would be expected of a competent and careful driver", the highway code can be used to define competent and careful driver, as can the test standard as defined by the DSA (which is based on Highway code). So I hope we can agree that the Highway code has relevancy in this conversation.
      Regarding "inconsiderate", Section 3ZA(4) defines it as, "A person is to be regarded as driving without reasonable consideration for other persons only if those persons are inconvenienced by his driving". I think it would be hard to prove that filtering inconveniences another driver, so this element cannot be proved.
      So the offence would really come down to, "due care and attention". Considering the Constable would have witnessed the rider overtaking previous vehicles, if the constable felt the offence was made out based on filtering in a single lane alone, they should have reported him on that, but seemingly only would have if they had overtaken him as well, which is an odd position to take. Personally, I don't think the offence would be made out if they did overtake, but taking this to magistrates would be like betting black on roulette.
      However, once the direction had been made that the rider must not overtake the police car, then the superpower of section 35 RTA means that this offence would be committed by continuing to overtake, and judging by the attitude of the constable, they'd pursue that offence at least. However, I would also take the position that the way the constable stuck their arm out of the window physically impeding the overtaking manoeuvre was either inconsiderate, dangerous, or without due care and attention where the expected standard of driving is significantly higher for police drivers as per Section 3ZA(2B).

    Rule 168
    Being overtaken. If a driver is trying to overtake you, maintain a steady course and speed, slowing down if necessary to let the vehicle pass. Never obstruct drivers who wish to pass. Speeding up or driving unpredictably while someone is overtaking you is dangerous. Drop back to maintain a two-second gap if someone overtakes and pulls into the gap in front of you.

      Motorcyclists need to be allowed to filter in order to keep moving. This keeps them from overheating as they must dress for temperatures 20 degrees cooler than the people in a car. Other countries take the over heating of motorcyclists very seriously. Why not here?

    As a motorcyclist I’d politely explain to the officer that I’m going to filter through, indicate to cut in front of his car, pull over and take the ticket in order to see what happens legally. I’ve got and have never had a single point on my licence so I’d be quite happy to test this one out as I would think twice about filtering “through” in that position. The officer may be correct and I may be found to be correct but it would be worth the points to find out for every other motorcyclist.
    Imo the officer was being petty rather than safety conscious but that’s just me, I don’t think a police motorcyclist would think twice about filtering in that position and I don’t think the officer would stick his arm out to stop him/her.

      Some years back I was on the M11 when it was 2 lanes between Stansted and Cambridge and both lanes had slowed to about 50mph. The queues were so long I couldn't see The end so I decided to filter between the lanes. After about 15 miles I arrived at the cause of the holdup, one pig ignorant lorry overtaking another by driving 0.5mph faster. So, I rode between them and obviously had totally clear road ahead of me as far as I could see so I stoked the blade up and cracked on. Several miles along the road I could see a cop car on the hard shoulder so I slowed down to 69mph (ooer missus) plod gestured to me to pull over which I did, he caution me for "driving without due care and attention" now, I know that the legal definition of that offence is causing a danger or inconvenience to another road user and I hadn't. The copper did the usual faux anger and the old "I don't want to have to tell your parent's you've been squashed under the wheels of lorry" at this point I took my lid off and he was surprised to find a 40 year old bloke instead of a youngster. It seems that just prior to riding between the HGVs I had passed an unmarked car. I told the copper that the only person driving without due care and attention was the lorry driver in the offside lane. This was when the traffic came into sight and the queue was now about 20 miles long. I told the copper that the moment I was back on the road I was going to do the exact same thing again and thanks a lot for needlessly holding me up. He told me he was going "recommend prosecution" and let me go, I had been sat there about 45 minutes and I screamed out of the hard shoulder straight into the middle of the road and nailed it until I caught up the lorries again, still two abreast holding up the traffic for miles and I rode between them again. About 10 days later I received a letter saying "no further action" because I had done absolutely nothing wrong other than expose a copper as an idiot.

      wrong context, the definition has multiple meanings for different context. the one you are refering to as the definition is in relation to "something coming out from a single point" thats why the definition gives an example of "the players filtered out on to the pitch"
      However in the context of traffic which can have multiple lanes the term filtering changes to another definition which is "(of traffic) be allowed to pass to the left or right at a junction while traffic going straight ahead is halted" this implies a 2 lane road, with one lane halted therefor you "filter" into the next lane to get past in otherwards overtake/undertake. this also applies to bikers in the same context so yes, the implication is filtering "through" something which means between "2 lanes" in regards to traffic

    I'm not a motorcyclist, but the traffic officer does not display any rear sign that says stay behind or follow me or do not pass. Neither is he displaying any emergency response lights, so he is just another motorist. That traffic officer is required to provide the same driving standards as any other driver. The question I would ask is: Would a police rider undertake the same filtering manoeuvres and, should a member of the public stick his hand out and say no.. It's not happening. What would be the officers response? Should it be a case of follow by example? 🤔

      Pointing out the obvious. There is no police constable in uniform. I see an arm and a driver wearing sunglasses. Not that of a uniformed officercas i would expect to see stood infront or aside me (as a rider). There is a driver of a police vehicle, yes but mechanics drive police cars, community support officers can drive police cars, warranted civilians can drive police vehicles if authorised to do so and hold a current permit with that force. The traffic unit then proceeds without displaying do not pass, no overtaking or any other form of rear window matrix sign or emergency response lights. Would that officer equally stop another officer on a motorbike filtering? Same rules apply regardless unless there is justification, in which case the rider would becable to claim exemptions or it is safe to pass by stationary or slow moving vehicles. Not like the traffic vehicle can go anywhere in a hurry, so why unnecessarily detain a rider from making effective progress without just cause.. simply because "it's not happening" is not just cause I'm afraid.

      @@nagualdesign The point here is simple in terms of what the statute says... by a constable in uniform. Is any part of the driver's uniform visible where it clearly states police? [5.23 onwards]. Does the driver state he is a police officer? Do you see the officer's collar number? Do you see anything on his clothing that is visibly visible that states or identifies the driver as a police officer? I cannot see, not even using a 32" 4k Monitor. He was not clearly identified as a police officer; for all I know, that vehicle could have been a television/movie prop. Would you disagree that to undertake any traffic management or traffic stop, the officer must be clearly visible (usually hi-viz to comply with Health and Safety legislation). That or by utilising the vehicle matrix displaying do not overtake and displaying illuminated emergency lighting and not just sticking an arm out of the window and shouting at the rider, "Stop, you're not filtering in one lane, it's not happening". The stop did not comply with the stopping procedures. Had the 'officer' given a reasonable and lawful reason for directly refusing the rider to filter. As another former traffic officer stated, this clip would not be in debate, so back to my original point... unless that 'officer' was undertaking any lawful duty, which that clip does not demonstrate, he is just another motorist and must abide by the same standards as a reasonable driver which is the same standard as the court applies. Therefore, he must give way and provide room for motorcycles and cyclists to pass, abiding by the Highway Code and Roadcraft.

    I don't see the issue with the motorcyclist filtering here. He seems to be doing it slowly and with care. The police are obviously annoyed with having to sit in the traffic and to see the motorcyclist filtering must of upset them. There is plenty of space between the car and the cones, just as much as if you were filtering in 2 lanes with vehicles on both sides. There is also less of a hazard as there are no vehicles to the right hand side of the motorcyclist. Rules 88 for the motorcyclist and rule 160 for the police officer of the high way code.

      Policeman was correct and besides if the policeman asks you not to its on your head if you ignore him, generally in this situation your much better to play it safe, on the whole in my experience as a biker of 40 years the Police let bikers get away with way way more than they do car drivers, they turn a blind eye to a lot of things bikers do.

    Two BIG points here; firstly the other lane WAS open ... I can see at least 3 inches of the other lane The cone is placed on the far side of the line not on the inside of the line. Just because a car can't drive on 3" of road width doesn't mean a bike can't. Secondly, that white line up the left side of the road is meaningless. I'd just ride, cautiously, up the inside of them, because the truck is likely to be the problem ahead. No law not to afaik. Main danger is debris that might stick in your tyre.

    Filtering is allowed in a two lane situation because it is assumed that the vehicles the motorcyclist is passing are both within their respective lanes, are no wider than their respective lanes and therefore are able to provide the necessary space required for filtering. If a lane is closed, the road is to be treated as a single carriageway, where filtering would be dangerous but overtaking allowed under the usual safe circumstances. I have a motorcycle license too.

    the policeman was having one of those days ..it made no difference to him and the motorcyclist was being very cautious and aware …a lot of motorists actually make way on these sort of restrictions and lorry drivers are prob the best at doing it , they are generally more aware of their surroundings and don’t see progress of others as a personal slight . unlike a lot car drivers and in this case the copper

    The traffic was slow-moving/stationary, there was no oncoming traffic, there were no workers in the closed lane, and there was plenty of room in the empty outside lane should an emergency maneuver be required - no safety concern here. When the biker reached the wider lorry he'd simply have to stop. The policeman had him on something of a technicality only, ie. the road was in effect a single carriageway.

    I am a biker, and have been for many years. The policeman was correct in not letting the biker filter. BUT, if I was driving a car in the same situation I would move over to let the bike through.

    He's allowed to filter, just cannot be more the 10mph faster then the traffic an no higher then the speed limit. Number of lanes doesn't matter. What isn't allowed how ever is to stick your arm out of the moving vehicle in the path of another moving vehicle. The argument of its safter to wait on a single lane falls flat on face...

    Rough quote from the police officer "Stop, Stop here. You are not filtering in one lane. It is not happening, it is not happening. I will stick you . Stay there. Stay there."
    The police officer knows the maneuver is a filter and not a overtake, knows there is space between the traffic and the cones ( stop, stop .... stay there, stay there)
    If the codeway did not allow for filtering when a lane is closed ( You are not filtering in one lane.) it would say either SHOULD or MUST not. This was not "stop, stop. it is to dangerous to filter" situation.
    Hitting a police car when filtering, it will not just going to be a insurance claim you are dealing with.😅

    A police car was in front of me, and I was at a safe distance but I was keeping up with the police car and other cars behind me, then he put his lights on and siren and waved me past to pull me over…then proceeded to get on a massive power trip and said I was speeding, technically I was but not by much only because he was doing 40 I was only behind him keeping up with the flow, I think that’s a bit ridiculous because he’s a police officer and was not going to a crime, so are they allowed to break the law or speed. 😂 I told him that and he went berserk but told me to Fook off and just go, terrible behaviour and some have issues 😜

      I had something similar driving on a busy motorway once.
      Had a car right up my backside so i sped up a bit to let him past next thing lights come on and pulls me for speeding. Aggressive unmarked cop car clearly trying to entrap people by driving dangerously so people in front just want to get out the way and out of danger.

A car briskly caught up to me with 1 headlight very very dim and the other way too bright. Drive right up ma butt and then proceeded to tailgated me the whole way.
      I wasn't in the mood and just wanted to cruise, so I did my thing of flipping the lever on the rear-view mirror so I could hardly see him in it. He tailgated me the whole way and it was only when we got the small roundabout at the end of the road he flipped on his blues and swung left to go on another call.
      Unmarked car with knackered lights trying to force people into speeding.

      He is NOT allowed to speed without his blues, but equally keeping up is not an excuse. however, if you do intentionally accelerate to avoid an accident or safety a court may if supported with sufficient evidence be considerate.

      As a somewhat younger motorcyclist of just 48 years, I also agree. This is technically an overtake as the outside lane is closed off. The relevant distance to consider is between the white lines and the police car therefore a high risk overtake.

      No your wrong citizens have lost faith and respect because if a crime is reported, all they seem to do is hand out a crime reference number and that's it! I'm being terrorised 24/7/365 by a paranoid schizophrenic council tenant who only got a verbal telling off for being almost constantly noisy of any form (tv, stereo, stomping about etc). After the warning in may/june 20'16! And he has done in retaliation to that... Superglue'd locks ×6, ripped off letterbox ×6, ×2 attempted break ins, superglue on a self locking front door handle ×2 once in minus six weather, 3× brick through the window in middle of the night, placed microphones in the ceiling of frontroom & the hallway so no audio privacy, death threats ×6, killed off my rescue dog by causing it anemia just before xmas '23, & hacking my tv signal so it keeps being switched off (have had no tv since just before xmas) have reported every single thing crime reference numbers coming out my ears & yet STILL no punishable action has happened!! So I must be correct in saying that the council & police are aiding & abetting a mentally ill neighbour from hell, with seemingly no consequence 😳!! When's it going to be stopped?? And I have hereditary disabilities for life.

    I believe there was enough room to filter safely in that situation. There's no expectation for drivers to move out of motorcyclists way however rule 160 in the highway code does say "keep to the left, unless road signs or markings indicate otherwise." so the police should have been to the left of the lane, plus it's just polite and safer to move over to let them past. When filtering is done safely, it massively reduces the risk of rear-end collisions, helps congestion and reduces emissions as the journey time is shorter. In this situation there isn't much of a risk, slow moving traffic, no road workers and plenty of visibility of the motorcyclist in the driver’s mirrors. The lorry ahead would be a bigger risk and should be treated appropriately until it's safe to filter. I have to disagree with your view on this one

    I attended a bike safe course and showed this clip to the police motorcycle trainer and while he thought the police car driver was being a bit harsh he did state everything that you covered in your video, the lane was closed so no filtering is aloud.

      @waltersobchak1719 I agree (partly) No obligation to hog the nearside kerb, but Driving without Due Care has the associated offence arm of Without Reasonable Consideration for other Road Users. To pull over more to the left (when the opportunity arises) would be showing 'reasonable consideration' . Cones are there to stop traffic using THAT lane, no reason to stop a motorcycle doing a careful overtake.

    The Police Officer needs to ask himself why is he driving about a metre from the near side solid white line. He needs to move to his near side and then the motorcyclist would have an unhindered opportunity to safely ride past. The biker should report the Cop for driving without reasonable consideration for other road users.

    I had an altercation with a copper a couple of years back after filtering slowly through a long line of stationary traffic. He just didn't seem to know the rules and backed down when I got the highway code up on my phone.
