NZYQ - Are the visa restrictions placed on released detainees valid?

  • The Australian High Court, in a case called NZYQ (see my earlier video), held that non-citizens who were being detained for deportation had to be released if their deportation was not practicable in the reasonably foreseeable future. This resulted in the release of over 140 detainees. Parliament reacted by imposing visa conditions on them that seriously restricted their liberty, including curfews and electronic monitoring with ankle bracelets. This video discusses that legislation, criticisms of it and the chances of success for the constitutional challenges to it. A later video will discuss subsequent legislation providing for preventive detention.
