Unfortunately getting the seller banned from Amazon is useless. They will just buy another account with lots of sales and good reviews and just repost all the same items again.
The way these sellers in countries without robust patent and copyright laws get away with this kind of stuff is just so disheartening. There's a company selling knockoff Carhartt with the actual Carhartt logo all over their products and website and they've been doing it for years. If a big established brand like Carhartt can't stop knockoffs then you feel like what chance do smaller independent makers and sellers have.
@Patman03004 yeah. Any invention you create, you are creating for the benefit and profit of the CCP. Regardless if you have patents or not. Patents only give you the right to sue. but the cost is on you to protect your inventions.
But it still creates headaches for the seller and that's better than doing nothing. If this ends up on reddit you can basically guarantee that the people on there will absolutely keep tracking them down no matter what account they buy and they will continue making them suffer even if only in small ways
@Patman03004I don't think it's the countries without good patent or copyright law being the problem. Then problem is the platform doesn't care, they just want to make their commission regardless of how.
That's where you also begin legal action to sue the person *behind* the account for copyright infringement, and absolutely destroy them in court, since the sharing of the file did not explicitly include commercial rights. Which means the revenue, not just profit, but entire revenue, of the product being sold on amazon illegally, becomes damages xD
Edit: I derped and thought he would have a patent claim in this instance, but he didn't actually register a patent that we know of, but as his friend mentions further into the video than where I was up to, he has a copyright claim due to owning the IP of the stand design.

Been a big fan of your content for a while now, so it’s been really wild to (1) see you make a post on the exact type of IP cases I’ve been working on for the past year or so now (and not long after launching my own channel to boot) and (2) actually get a mention in one of your videos (kinda star struck right now, ngl haha).
I’m really sorry you’ve had to go through all of this, but I’m glad to hear that the review bomb campaign was successful and it inspired you to make this awesome board mod!
Here’s to hoping a Canadian IP attorney reaches out to you, because if you bring a claim against this guy and he doesn’t engage in the suit at all (say because he’s based in China or because he thinks it’s just not worth it), then it is possible that the final judgment can result in his whole store being shut down which will help all those other designers whose 3D files he’s infringing upon and taking advantage of.
@nephicus339 In my experience, that isn’t uncommon, unfortunately. The way infringers like these tend to stop for good is when they wind up getting caught in multiple suits over the course of a few years. After a certain point the many judgments entered against them make their counterfeit operations a net loss and not just a cost of doing business.
But this seller is interesting, though, in that they are seemingly 3D printing their knockoffs themselves and aren’t working with some large manufacturer, so losing even a single lawsuit might be business ending for them.

I'd imagine the first thing he'll say is you can only patent something if it is novel, and undisclosed. Putting a wheel on something isn't novel, and posting it on the internet is the opposite of undisclosed. Oh, you'll also have to have at least started patent applications. (The "patent pending" wording is mostly useless though, as either you have a patent, or you don't.)

You don't need a back pack for the chain lock. You just get one long enough to wear as a belt or as a over the shoulder sling
Got a small fanny pack for keeping my locks and repair kit in when cycling. I always opt for the backpack instead, as it sits on me nicer when trying to keep my balance. 😅
Ugh, as a fellow victim of 3D model theft I am so sorry for your saga! I went and reported a few of this seller's items on Amazon and provided links back to the original models. The original models are very easy to find by reverse image searching, because of course the seller is too lazy to do their own product photography and just steals the images from the originals.

Not a copyright lawyer here - but my understanding is the patent is the CONCEPT and the copyright is the creative artwork (your custom creation).
The IP is that they CANNOT steal or reacreate your creation, similarly with the complex code of a custom function (yes, I'm in tech), if you say so - the patent simply stops anyone being able to recreate, remodel or recode your concept/idea in their own way.
You should have full legal rights however as people say amazon would simply listen to the lawyers but would not stop the new accounts from keeping popping up to sell it.

Morley, I love the fact that you are so passionate in what you do. I am a embroider crafter of many other kinds of art and one of my youtube creator has had many of her items stolen from her website and they use her tutorials to sell her things. Etsy won't do anything about it. Sad to say maybe you should leave out certain thing in your design so it's harder from them to make a knock off. Glad your watching out for your friends

It bothers me that the chain isnt just permanently attached to the one wheel somehow. Like where you can just detach one side of it and lock it to whatever with the other side remaining attached to the one wheel at all times
I was actually thinking of doing that, but that has two major downsides:
1. Wherever you attach the chain link to the one wheel, it’s a weak point that could be easily cut with bolt cutters or an angle grinder. The chain links are hardened steel, not so easy to cut.
2. You would never have the option to ride without a chain lock attached to the board (which would be nice for off road, etc.)

@2002william Thats something else. Etsy banned non-selfdesigned prints. There were Printsforms running on Etsy. My Guess is thats an American having such a Printsfarm and now uses Amazon instead of Etsy to sell his "products". With lot of bad Quality Prints. With the Bambu Printers lot of poeple thought: I buy 10 A1 Printer and i will be rich by selling 2$ prints for 10-40$ Bucks a piece. When you look at the "First day avaible" of the Goods he sells. Literaly the month of the Etsy Ban: June 2025

Patents only exist for big Corpos to bully others. If you're not a big corporation, then filing and defending your patent is gonna cost you wayyyy more than any benefit you'd get from it.
Also, the IP infringement happened as soon as he used the 3d file to print. That file is distributed under a license, which is equal to contractual obligation when you download and use the file.
So using a file for commercial use, that was licensed under a non-commercial license is considered a breach of contract.

Amazon is very guilty in the fact that they have been stealing competitor ideas, making knock off products then calling them "amazon brands" and they are legally allowed to get away with this. Other competitors have gone after amazon for making straight up clones of their products. It's called stealing and the only way it will end is if people start suing them or calling them out each time they do it.
It really depends on the patents here. Amazon lawyers are very good at skirting certain patents and making legal products for "Amazon Brands". This is not an "Amazon Brand" we are dealing with in the video.

@TheBaldr similar tactics though : pick a product created by someone else and profit from all the hard work they have done with zero effort at asking for permission or negotiating a deal.
It's not just Amazon. It's the entire industry that does this. They have legal experts that only exist to find ways to skirt patents and copyright issues for their masters.
And you can bet that if you were to do the same to them they'd bring in the full might of their lawyer strike force, because they can afford to litigate you into bankruptcy too.
Amazon 3rd party seller.. not Amazon. It's some fool with a 3D printer who knows NOTHING about engineering, product design, design verification, or quality control.
Unfortunately, this is a common practice long before Amazon even existed. Stores like Walmart, Target, etc have been doing this before Amazon was even a concept.

You should tell them to take down sellers of fake 925 sterling silver jewelry. It’s actually a crime and I’d love to see some revenge on it.
If they are using your exact same 3D model, then it is copyrighted; however, if it is just a similar design, then you are out of luck, and you would need a patent to protect that. If it is a seller on Amazon, the best you can do is have Amazon remove the product. Technically, due to Amazon's contract with merchants, Amazon shrugs off all responsibility for the listed items due to copyright and patent infringement. It would be a waste of time suing them. Small chance the seller is in the US and sueable. Most likely scenario is that the seller is not in the US and you'll just be wasting your time.
Sounds like its a chinese based company.

Copyright lawyer here!
There are two criteria for proving infringement :
Prior access and substantial similarity. Basically, you have to be able to prove that they likely have seen the product before, and that their version is similar to yours.
A cool added benefit for your case is: the stronger proof you have of one criteria, the less you need of the other. Meaning, if you can 100% prove they saw your video, you don't need to prove that their product is that similar to yours. Additionally, if theirs is identical to yours, you don't have to prove that they saw your video.
Most importantly, though, copyright is a defensive right and you can (as the owner of the IP) DEFINITELY stop anyone from using your designs!
(this is not legal advice for obvious reasons, but I hope it helps with giving some insights/context)
unfortunately copyright doesn't cover inventions. Patents do. and even then you still have to burden the cost of litigation.
@Shinobubuglad you brought that up! An argument can be made that this is "functional art" as it's primary purpose for invention was to entertain a youtube audience, and not *actually about inventing something. But yes you're right, if he were to prosecute, the burden if truth would fall on him...
(I'd also like to add that I'm south african, not American, and there could be very subtle differences in local laws that I'm not aware of.)
You are obviously not a copyright lawyer. Copyright covers things that could in some aspects be primarily considered art. It does not cover functional material. For example a recipe is a functional set of instructions. It is not covered. Products for the most part are not covered by copyright. A pot is a pot. If it is shaped a certain way for functional benefits then it can legally be copied unless patented.
This stand fulfills a need that wasn't otherwise acknowledged. That makes it a functional product. As such legally and ethically anyone can copy it unless it is patented. The files may or may not be protected but that is entirely irrelevant to the physical products produced from the files.

That's the whole point I tried making: it was made not as an actual commercial product, but as a means of entertainment. Where I'm from That's considered art. I agree that it is difficult to prove, and maybe even ambiguous, but a functional car can be art, a banana taped to a wall can be art even if it's technically not.
But maybe you're right, I'm entirely unsure if my opinion would hold up in court....

The exact likeness of a product can and has been copyrighted. So he can't stop anyone from making the same idea because there's no patent. The idea of a wheeled stand for a one wheel is not exclusive.
Copying the *exact* design though is more of a copyright gray area because the shape and form of a product most definitely are (often) artistic expressions. Apple sued to protect rounded phone screens. Not patented, a design choice.
The cheese wedge shelves brackets they also stole for example. Obviously he doesn't have a patent for shelf brackets. But the specific design of those is an artistic expression.
It may not win in court but you don't need it to. The moment there's a potential copyright violation Amazon wants no part of it and takes the listing down.
He's not looking to spend the 10s of thousands it takes to prevail at trial that damages won't come close to. He just wants to give the guy hell.

@Jack-cq9pvfor that, probably 10 minutes on a wax printer, another 30 for a silicone master mold, then an hour between every polymer resin casting. You can make like 10 of them in one day if you are fast about it.

Right? Evan and Kaitlyn are creators who do intellectual property appropriately. They invented something. Realized it didn't make financial sense to patent it so they put it out into the world so someone else couldn't patent it knowing full well it meant someone else could profit from it, and even said they were cool with that because it means others could get the product more easily then. That's a good thing!

If it's poor quality, then leave that review and don't buy it.
It's not about the file specifically.
He designed and invented the item. He is fine with people using it for themselves, but NOT selling it as their own.
It's like if your friend made a cake and gave you the recipe. If you then take this recipe and bake cakes that you plan to sell, all while claiming YOU invented this specific cake recipe, you're in the wrong.
As well, as he points out, it's low quality and unusable.
The seller has hundreds of listings of stolen prints, as well.
Now, here is the legal side of this thing:
The amazon seller used the 3d file, which was licensed. That license counts as a contract, and the contractual obligation was to use it for personal and non-commercial use only.
If the amazon seller was merely inspired by the video, and he made his own 3d file from scratch (that only roughly looked similar), then there is nothing Morley could do about it.
@Mothman_In_a_T-Pose The cake example is actually really really really bad from a law perspective. You cannot copyright a list of ingredients and portions - the recipes themselves are simply not able to be copyrighted in the US. That is why recipe sites and books are full of non-cooking fluff to bury the recipe in copyrightable content. In the cake example, if you give a friend the recipe, you can neither use copyright or patent law against the friend to prevent them from selling the cakes unless you first obtained a patent for the cake recipe - probably as a process patent - or unless you attached a contract (verbal or written) to the use of the recipe. Even if you had a contract, it may not be enforceable depending on the exact terms and circumstances.
"Stolen prints" is actually a complex topic, and an actual IP lawyer really needs to weigh in. The lawyer friend is sort of out of his depth here.

It was nice to see your excitement when you first pulled off that side piece. I love working on things, and i love seeing someone else experience the joy of doing exactly that!
Great job getting these things taken down. I often have problems with my designs being stolen from Makerworld or Printables and sold on Etsy, eBay, or Amazon. Legal action is too expensive, so the only option right now is to send an email pointing out that it's not okay (which works in about 10% of cases) or just to put up with it and accept it. It's just sad.
Love your energy, most people would get down and out on this, big respect, for anyone on here, please report all sellers that look like stolen ideas

To be fair, he specifically only build it for himself and didn't put the files or product out there to prevent this exact issue.
He didn't sell the designer chair or even provide a model though, he just built it. It's not infringing on someone's patent if you just build it for yourself.

Man I hate that the latest generations simply gobbled up this insane idea of Intelectual Property, and now it lives in the cultural zeitgeist like it's a legitimate thing. IP is nothing but disguised government protectionism. It has no ethical foundation, imagine if the first human who built a house said "you can't copy my idea". have a look at how Vanmoof did their lock on their first version of their bike. (I have one of those.) It is a chain lock with a ring on one side, that you will fit the other end thru and then mount the end on the frame a bit like a kensington lock.

You may want to print some sort of plug/cover where you insert the key or you may end up with debris caught in there and you're unable to insert or turn the key. You'd probably want to connect to a loop that goes around the chain so the cover doesn't get lost when the chain is in use.
