  • Legal malpractice in real estate transactions. Good afternoon. I'm Neil Burns. I'm a lawyer here at 6 Beacon Street in Boston. And along with my partner, Roshan Jain, we represent victims of legal malpractice and personal injury here in Massachusetts. I've been asked today to talk about legal malpractice in the context of real estate transactions.
    And we get a lot of these calls, we get a lot of these clients, all sorts of different real estate transactions, residential, commercial. The typical ones are, there's a screw up with the money, with the holding of the money. Somebody's holding it or somebody stole it. Someone took off with it.
    There's a fight over that type of thing. Sometimes it is malpractice. Sometimes somebody actually did steal the money and malpractice insurance may cover it. There may be another way to get the money for that. But there's also screw ups, negligence in the transactions themselves. We had one where a lawyer said, don't worry about this.
    Potential oil tank was buried under the ground and they signed the P and S. And then when they went to sell the house, the potential oil tank that was essentially known to the attorney said not to worry about it had to be dug up. And that costs many, many thousands of dollars. It's an environmental hazard and the attorney had to pay to get that fixed because he or she screwed up that transaction.
    It happens in many different contexts in real estate. Real estate is complicated, involves many steps, most of it has to be in writing with respect to transactions, but there's many different elements in it, there's many different actors, there's realtors, there's transaction attorneys, and there's banks, and we get these calls all the time, and sometimes they're complicated and sometimes they're very straightforward.
