The person pushing the trespass was the property owner David Bernard Simmons…not the restaurant. 2/6/23 - Milledgeville Georgia. City of Milledgeville Georgia Police Officers enforce the feelings of a local business owner (David Bernard Simmons) over defending our Constitutionally protected rights to freedom of speech, freedom of religion and freedom of assembly on a traditional public forum. I was criminally trespassed from an entire city block including the public sidewalk. Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
I called the PD yesterday and asked for a supervisor to call me back. No call yet. I also called the city manager and the mayor. I had an extended conversation with the nice fellow at the mayors office. He was surprised that you Jeff would be asked to leave the side walk.
What makes these cops think the entire sidewalk is owned by the businesses ? I mean serious are they that stupid when it comes to public property? How dumb do you have to be? The light posts are city light posts the benches are put out by the city/ town I mean for god sakes these cops are defunding themselves and then you have a business owner go and do something like this that will cost him loss of revenue when it gets put out in the local papers on how he ran off a veteran for just saying god bless the homeless vets. Hell I may just take a ride to this town in Georgia with the maps of public property in my pocket and stand right where you did. Let them try and move me! Hell the cop admitted on his own body camera the property line is six feet from the building. So they knew they illegally trespassed you!
While military and police may use the same tools. How they are meant to use those tools is completely different. The U.S. does a great job at programming soldiers to kill on the battled field. But the U.S. is pathetic at reincorporating soldiers back into civilian life. SO using ex-military as police is a really bad idea.

That's why I was asking if you know of any laws or lawsuits about the subject. The cops certainly violated his civil rights by trespassing him. But soliciting a trespass is something they can do if it's not against the law. My guess is if a state ever did try to pass one of these laws, the police would fight it tooth and nail.

I left a one star review on their website stating that the other veterans that "trespassed" you from a public sidewalk should be ashamed of themselves. Jeff, you are the most calm guy doing audits I have ever seen. Please file a complaint with the mayor and the city's attorney. I would love to see their response.

By keeping the sidewalk clean it keeps crap out of your building. You don't have to clean the sidewalk. Unless it snows. I ran a very large janitorial service in Minnesota. In order to make it easier to clean I'd have my janitors sweep the sidewalks daily. It just crap out of your business. And just because you do it doesn't make it yours.
I didn't really get the impression that he thought he owned the sidewalk, just that he kept it clean. When the first cop was about to leave he told him that it was public and he seemed to accept that even if he didn't like it. The second cop was the one pushing that the whole walk was private.
Yeah, the warning is a nice way of putting it because Jeff had to make clear what the "warning" really was. It was a threat of arrest if he remained on the public sidewalk and the officer said it very clearly "you will be arrested if you don't move!"
The one officer seemed to understand what he was doing and where he was doing it. The second officer and the Sgt seemed to be a bit confused. The first officer even comments at the end about him being "on a public sidewalk" as sort of a hint to officer #2. He should have just openly said it.

So then the officer said ok let me go ask the business owner! as if the owner is the ruler of the public sidewalk and the officer was stupid enough to do the warning. Unless of course there is a third person that was not disclosed as the owner of the restaurant. But the building owner insinuated that he owned the restaurant. So it should be called out on their BS.

It doesn't. If he was on a public sidewalk, then the only thing they may suspect him of is aggressive panhandling (which is usually illegal). Of course he was not aggressive nor was he panhandling, so they pretended he was on private property, which is highly doubtful.

"Do you guys want this gentleman to be trespassed?" is a direct solicitation as opposed to "How's your day today? Everything going fine currently?" Get the name of the one "not wanting you" and check the city record of property deeds.

THIS NEEDS TO BE ADDRESSED IN COURT FOR TWO REASONS, ONE IS THE CITY ORDNANCE IS IN VIOLATION OF THE CONSTITUTION, AND TWO FOR THE BUSINESSES OWN SAKE, if they claim ownership of the sidewalk they also claim full legal responsibility, so if someone should slip and fall on THEIR sidewalk they WOULD be liable for all medical expenses time of work etc. Remember they chose this.
Should be addressing the fact that they don't pay utilities to the lights or maintain the property on the sidewalk, and I 100% agree they now assume all liability because they're deeming ownership, any case brought before court could use this as evidence.

Weirdly American thing is that the homeowner or business owner will have to pay to build and maintain the path around their property. This brings a sense of entitlement or ownership on something that is essential to public access. It’s an obligation on the property owner but they can’t control who uses it.
In some places the business does own the sidewalk but there is still a public easement and the business can't trespass people from that public easement. So regardless of ownership Jeff shouldn't have been trespassed.
Cop was trying to put 2 and 2 together but just couldn't quite do it. This is the state of LE today - they can handle a weapon but have not clue about cop 101.

@Mike Sarno::: The first cop wanted to get Jeff to move on but after talking to Jeff he somewhat backed down. When the first officer contacted his supervisor, he arrived on scene and you could tell right off the bat the supervisor disagreed with the first officer. Once the supervisor developed an exit plan he executed it.
At the very end during conversation about public sidewalk, the senior cop literally says I think they have about 6 feet. The jr. cop previoulsy says it is the entire sidewalk per his phone call to whoever. They do not even know, yet they still trespass him from what is generally considered public space. Unbelievable.

We are in a rural area but I worry the most for my friends and family in our cities because we all know that they are going to be like war zones when this kicks off. Stay safe.

Yep, the judge will throw out that citation quickly, and then I hope Jeff sues for 1st and 4th amendment violations. There is no way those cops keep qualified immunity over this, they broke every clearly established law on the books.

One of the responding officers showed up and solicited a trespass from the business owner not only was the trespass illegal, because it was a public sidewalk, but it was also illegal because it was solicited. It is police officers like this, that think everybody should just mindlessly bow to their perceived authority, that should never be allowed to be a police officer anywhere.
Thats because there is no such thing. In fact an officer pretty much has to ask if a business owner (or delegated authority) wants someone trespassed because they do not own the property and its open to the public. Now an officer cant threaten a property owner (either tell me to trespass this person or else..... ). Thats an entirely different thing though.

The owner of the building has no right to have jeff trespassed ,just as I could not have kids that walk on sidewalk (that is on my property) in front of my house that I shovel the snow off ,because sometimes they litter. At 11:50 the cops discuss how Jeff wasn’t homeless, wasn’t asking for money and the fact that they knew he had at least 6ft that he could definitely be on the public sidewalk. as a former vet it is appalling how little people care about former vets. a few places will give you a free cup of coffee or a discount off certain menu items. i think the old guy should be ashamed of the uproar he caused . i would boycott any businesses he owned.
It's not about honor. It's about compassion. Many vets inherit disabilities from their service, such as PTSD, which can become one of the factors for their homelessness. But it also has this John Rambo vibe. Amazing how little has changed since the movie. They still think they can ban people like him from an entire city (though it only was a sidewalk in this case).

I called the PD yesterday and asked for a supervisor to call me back. No call yet.
I also called the city manager and the mayor. I had an extended conversation with the nice fellow at the mayors office. He was surprised that you Jeff would be asked to leave the side walk.

What makes these cops think the entire sidewalk is owned by the businesses ? I mean serious are they that stupid when it comes to public property? How dumb do you have to be? Yeah, the warning is a nice way of putting it because Jeff had to make clear what the "warning" really was. It was a threat of arrest if he remained on the public sidewalk and the officer said it very clearly "you will be arrested if you don't move!"
The one officer seemed to understand what he was doing and where he was doing it. The second officer and the Sgt seemed to be a bit confused. The first officer even comments at the end about him being "on a public sidewalk" as sort of a hint to officer #2. He should have just openly said it.

Weirdly American thing is that the homeowner or business owner will have to pay to build and maintain the path around their property. This brings a sense of entitlement or ownership on something that is essential to public access. It’s an obligation on the property owner but they can’t control who uses it.
In some places the business does own the sidewalk but there is still a public easement and the business can't trespass people from that public easement. So regardless of ownership Jeff shouldn't have been trespassed.

When the first officer contacted his supervisor, he arrived on scene and you could tell right off the bat the supervisor disagreed with the first officer. Once the supervisor developed an exit plan he executed it.

At the very end during conversation about public sidewalk, the senior cop literally says I think they have about 6 feet. The jr. cop previoulsy says it is the entire sidewalk per his phone call to whoever. They do not even know, yet they still trespass him from what is generally considered public space. Unbelievable.
There smiles and confidence will be short lived when phones start ringing and they get served.

The cop not wanting to make it hard for Jeff is inside trying to encourage the manager to trespass him.
One of the responding officers showed up and solicited a trespass from the business owner not only was the trespass illegal, because it was a public sidewalk, but it was also illegal because it was solicited. It is police officers like this, that think everybody should just mindlessly bow to their perceived authority, that should never be allowed to be a police officer anywhere.
I have researched this issue for months. I have found NO Statute or Code in any State that forbids solicitation of trespass.
Thats because there is no such thing. In fact an officer pretty much has to ask if a business owner (or delegated authority) wants someone trespassed because they do not own the property and its open to the public.
Now an officer cant threaten a property owner (either tell me to trespass this person or else..... ). Thats an entirely different thing though.

The owner of the building has no right to have jeff trespassed ,just as I could not have kids that walk on sidewalk (that is on my property) in front of my house that I shovel the snow off ,because sometimes they litter. The police officers should know basic rules ,regulations and rights .if they don't know the easy one's what rights are they violating when things get complicated? At 11:50 the cops discuss how Jeff wasn’t homeless, wasn’t asking for money and the fact that they knew he had at least 6ft that he could definitely be on the public sidewalk.
Yet knowing all this they didn’t just say stand here and you are fine. Instead they pushed for a trespass and knowingly violated his rights. And shook his hand after.

as a former vet it is appalling how little people care about former vets. a few places will give you a free cup of coffee or a discount off certain menu items. i think the old guy should be ashamed of the uproar he caused . i would boycott

It's not about honor. It's about compassion. Many vets inherit disabilities from their service, such as PTSD, which can become one of the factors for their homelessness. But it also has this John Rambo vibe. Amazing how little has changed since the movie. They still think they can ban people like him from an entire city (though it only was a sidewalk in this case).
