If you have a good attorney on the case, then he or she would know best the strategy to employ. If you have no attorney and the defense does, and you have a 0% report, I'd strongly recommend reaching out to a local attorney for a consultation.
Thanks for the video! The QME never responded to a supplemental report. After 90 days, I submitted it to the judge, who ordered to ask questions again. Now, it has been more than five months. The QME never responded to This. By law, now I can request another QME panel, correct?
It's a real pain in the neck when QME's don't respond to requests for supplemental reports. The problem is that there is no clear-cut fix for that in the Labor Code. If the QME doesn't issue a report within 30 days of an exam then a replacement panel can be requested. But there is no remedy for a late supplemental report. It's generally the type of thing that needs to go to a judge to seek an order that the Medical Unit issue a replacement panel. That may be an option for you which would be to file another DOR and explain the judge that yet again there has been no response and no compliance with the last Board order, and ask the judge to replace the QME with a new panel. You may wish to discuss your options with your local I&A Officer.
so my qme wrote a pretty favorable report. however he put 2 things that is confusing everyone. 1 that everything was done correctly, I was forthcoming and honest, yet 2 he says I'm not credible. o had another wme(not on the case) look at it. he was confused but said its not bad, but could be used against me in court if it goes to trial. have you seen this before?
It could be a typo, and he meant to say that you were credible. Or it could be that he felt you were not credible in certain areas. It's tough to say. You may want to talk to a local attorney for a consultation and to review the report to get the attorney's impression on the report itself.
@@michaelarmstrong9512 It's frustrating, but sometimes I get reports from QME's on my cases and I tell my clients that the report makes no sense, or the QME must have been confused, or maybe didn't explain what he or she was thinking for some reason. Best of luck to you.
