Uganda like many Commonwealth countries absorbed many Western principles of Justice which although suitable for implementation in Western countries and societies, they cannot be squarely applied to African societies. Some, like the issue of bail operate on the premise of trust i.e the accused guarantees to appear in court if granted bail. Without being long, my position is that there should be a review of legal principles in the Criminal branch of the profession because honestly speaking, positive law (man-made law) is not sacrosanct.
