Maybe not. Just have your mom apply for you. Because your mom is a citizen, you will have a response very fast. Unless you committed some crazy crime, you should be approved. Even if you have to go back, you will only have to go for your appointment then be allowed back. If you are married to a US citizen then you won’t have to leave. And it would be better or faster to have your US citizen spouse file for you. You can apply and do everything here but if you have to go back, as the lawyer mentioned, you may be eligible for a waiver that you will get before you even get an appointment. Get a lawyer. Your mom is a citizen so apply asap- like he said you may be able to come back in weeks

As long as you have an immediate family member like a spouse or mother or father or a child over 21 who is a green card holder or citizen- you are 100 steps ahead of those who don’t have those options at all. But you have to actually send your information.
