If you serve a section 8 notice due to the tenants being in 2 months of arrers make sure to serve a section 21 notice too (if their fixed term contract wnds by the end of the notice), the reason being if the tenants pay enough rent to be less than 2 months worth of rent arrers then your section 8 notice won't be valid anymore so in that cause you can still go ahead with the section 21 notices assuming it ends after the fixed term contract ends.
I beg to differ...the Section 21 does not work as the tenant simply goes to the council (in my case Birmingham) and they tell (verbally as they won't put it in writing) the tenant that if they move out with a section 21 they will be making themselves 'intentionally homeless' so BCC tell them to stay put and wait for the bailiffs. At which time if they were paying before they will now stop paying rent and then you have to pursue them with a Section 8 which is very time consuming and extremely expensive. And I'm sorry but I will seriously question 2 weeks with a Section 8??It's only two weeks once its gone through the court system. In my experience it's taken months and cost me almost £2,000 that's without the eight months rent now owed to me and further court costs and bailiff costs in the near future. It only takes one bad tenant to ruin everything you've built up over years. That's why I'm selling up. Good riddance.

The easiest way is when they move in through an agency, just pay them a visit and make sure they know who you are, be like a bee. Be good to me you will get honey, be bad you will get stung, F the law, it's never on the genuine peoples side, it's always siding with useless people and scambags. Luckily sofar I haven't had any issues with my tenants and I manage them myself, I only use agency for rent collection. But as I said I'm a Bee. Honest to God my tenant has called me just to say thier to toilet has blocked or the light bulb has gone, although I know it's not my responsibility but I have been there and sort it out the smallest issues that has nothing to do with me as a landlord but I never tell them no.

We are thousands of pound out of pocket not to even mention the total stress this has caused us and my husband is recovering from cancer but the evil tenant cares nothing for this the court only takes into consideration the tenants 'well being'. Birmingham City Council told the tenant to stay until the bailiffs evict otherwise they will be classed as having moved out voluntarily. The tenant thinks that in being evicted she will get a council house but why would the council house her when she owes so much rent?? The whole system is broken and we can't wait until our last properties are sold and we are free from all of this.

If it's not mentioned in the contract there is nothing legally you can do. You're only option is to wait until the lease is up and not renew the lease with them.

I disagree, landlords are not protected at all in the uk. Our tenant has over £10,000 in arrears, we started the eviction process in July (section 8) and we still don't know when we will get our house back. Our tenant arrears now is over £14,000 which we will never see, while we pay for the house where they live AND our own rent. The law in the uk is ridiculous, my advice: DON'T RENT!!!
You forgot to add, if at the end of a S21 notice period the tenant doesn't move you need to serve S8, that is going to be a minimum of 2 months and could stretch out to double that. Plus how much is your time worth? Maybe cheaper to bung the tenant a few £k.

We have to move out of our home because my husband got relocated to a remote area. So we rented the only house we owned not knowing if we would have to return. We are still paying the mortgage of that house AND the rent of the house we are currently living. This person could potentially ruined us, make us homeless and make us lose the only property we own, while we have been only kind to them. It must be nice to live rent free, I don't know because I've never experienced it, I was always good to my landlords and paid for the house I was living in, I still do.

What if the letting agent has got someone else in without telling you, or the tenant as sublet for a higher rent. How do you get them out?
