    Also make sure you supply the tenant with a valid EICR (Electrical installation condition report) too!!!

    If you serve a section 8 notice due to the tenants being in 2 months of arrers make sure to serve a section 21 notice too (if their fixed term contract wnds by the end of the notice), the reason being if the tenants pay enough rent to be less than 2 months worth of rent arrers then your section 8 notice won't be valid anymore so in that cause you can still go ahead with the section 21 notices assuming it ends after the fixed term contract ends.

    I beg to differ...the Section 21 does not work as the tenant simply goes to the council (in my case Birmingham) and they tell (verbally as they won't put it in writing) the tenant that if they move out with a section 21 they will be making themselves 'intentionally homeless' so BCC tell them to stay put and wait for the bailiffs. At which time if they were paying before they will now stop paying rent and then you have to pursue them with a Section 8 which is very time consuming and extremely expensive. And I'm sorry but I will seriously question 2 weeks with a Section 8??It's only two weeks once its gone through the court system. In my experience it's taken months and cost me almost £2,000 that's without the eight months rent now owed to me and further court costs and bailiff costs in the near future. It only takes one bad tenant to ruin everything you've built up over years. That's why I'm selling up. Good riddance.

      this is so similar to what is happening to us... our tenant has already £14,000 in arrears and we served the section 8 in July... we had the hearing only yesterday and they delayed the case so it will go to court but still clueless when the court date will be... section 8s can take up to a year or more... it's disgusting.

      Yeah, most those youtubers "get rich on real estate" avoid talking about NEGATIVE aspects and potential losses, and sometimes losses are huge, even if you evict tenants, usually they can't pay your rent, they are broke, this and that.. And what if you have to pay mortgage AND rent AND lawyers for eviction....

      @@BZeeLife yeap, that's us... it's been a nightmare... but we didn't do it to get rich... my husband got a job offer outside London and we had to move. We charge nearly half-price of what currently cost a 2bed apartment in that area... she still didn't pay...

    The easiest way is when they move in through an agency, just pay them a visit and make sure they know who you are, be like a bee. Be good to me you will get honey, be bad you will get stung, F the law, it's never on the genuine peoples side, it's always siding with useless people and scambags. Luckily sofar I haven't had any issues with my tenants and I manage them myself, I only use agency for rent collection. But as I said I'm a Bee. Honest to God my tenant has called me just to say thier to toilet has blocked or the light bulb has gone, although I know it's not my responsibility but I have been there and sort it out the smallest issues that has nothing to do with me as a landlord but I never tell them no.

    can anyone tell me,.I have a council tentant, he doesnt work. he's paid his rent on time for 14 years., I've given him his deposit back, but deposit was paid in late, as i'm aware i might be fined. my main query is i want to serve sec 21 once ive done that will the council still advise tenant to pay his rent and will tenant still pay in full, or will council advise him not to so that i have to servce a section 8? the tenant also has points to gain a council property as he is unable to walk far, s \o im hoping council might house him..but doesn anyone know if tenats still pay the rent whilst courts going through . i dont really want to go down seciton 8 route

    We can't serve section 8's in Wales, whats the alternative? I have a tenant who has not paid since September'23 ! how can i Legally evict?

    I have an issue with my tenancy ever since I moved in till the end of the contract I’ve never owed and I’ve been following the rules ….. just a week into the new year I got a call saying that the landlord wants to sell the property….. I’ve never owed nor had issues… please what do I do???? I wasn’t given how to rent guide neither was I given a EPC….. and within this 2months should I continue to pay the rent??

    There is no quick way to get a bad tenant out and it only takes one bad one to ruin years of work. We have a tenant who has not paid rent for over a year which is how long it takes to get a property back. We have the bailiffs booked for this Friday but I have been watching videos where people have said they have had to get the bailiffs in three times and have still not managed to get the tenant out. We are thousands of pound out of pocket not to even mention the total stress this has caused us and my husband is recovering from cancer but the evil tenant cares nothing for this the court only takes into consideration the tenants 'well being'. Birmingham City Council told the tenant to stay until the bailiffs evict otherwise they will be classed as having moved out voluntarily. The tenant thinks that in being evicted she will get a council house but why would the council house her when she owes so much rent?? The whole system is broken and we can't wait until our last properties are sold and we are free from all of this.

      was your tenant working? i am just trying to establish if council were paying rent for her and council advised her not to pay? as i am same situ. im LL - i want to serve sec 21 on a tenant who gets rent paid by council and im trying to find out if when i give notice will they still pay the rent >/? (If its council tenant )

    Does any one know, if a EPC with incorrect “house type “ should be middle terrace but was shown as end terrace!
    Is that invalid the EPC? So invalid the s.21 notice???

    Great stuff Samuel! Very well explained. You didn't mention how to go on about this if say an EPC was not served or valid when the tenancy began and you want to serve a s21 notice. Is there a way around it or can you never ever serve a s21 on that tenant. Does anyone else know? Thanks

    What if the letting agent has got someone else in without telling you, or the tenant as sublet for a higher rent. How do you get them out?

      If it's not mentioned in the contract there is nothing legally you can do. You're only option is to wait until the lease is up and not renew the lease with them.

    As a Tennant in a HMO I'm being harrassed and intimidated by the agent. When signing the agreement i was advised to tick all boxed for me to be housed (homeless prior) which I needed. No certificates given at that time. Hmmm. Been given an annual update on e over the past 2 years.

    I disagree, landlords are not protected at all in the uk. Our tenant has over £10,000 in arrears, we started the eviction process in July (section 8) and we still don't know when we will get our house back. Our tenant arrears now is over £14,000 which we will never see, while we pay for the house where they live AND our own rent. The law in the uk is ridiculous, my advice: DON'T RENT!!!

    You forgot to add, if at the end of a S21 notice period the tenant doesn't move you need to serve S8, that is going to be a minimum of 2 months and could stretch out to double that. Plus how much is your time worth? Maybe cheaper to bung the tenant a few £k.

      We haven't increased the rent since 2021, we rented at the lowest price and STILL our tenant don't pay.

      @@DanTheMan221 Well the factors surrounding people can also be that some people are bad and they have no issue in scamming and robbing others as the law allows them. We have to move out of our home because my husband got relocated to a remote area. So we rented the only house we owned not knowing if we would have to return. We are still paying the mortgage of that house AND the rent of the house we are currently living. This person could potentially ruined us, make us homeless and make us lose the only property we own, while we have been only kind to them. It must be nice to live rent free, I don't know because I've never experienced it, I was always good to my landlords and paid for the house I was living in, I still do.

      @@DanTheMan221 I gave them the section 8 eviction in july, yesterday was the hearing and nothing happened, it seems now we have to go to court and we don't know when that will be... I have a disabled kid and also need to take the LA to the tribunal for his provision... this is a nightmare, I don't know where I'm going to find the money. I feel completely let down by the whole system.

    Dont buy investment property in UK. Worst law to protect landlard. My partner hasnt collected rent for a year. Got the possession order, eviction order etc, tenant still lives there and wont move.
