We also have to keep in mind that anybody can write anyone a cease and desist letter on anything. They don’t hold any legal ground it’s basically just saying hey we don’t like what youre doing so stop. If horror inc doesn’t hold the rights to Jason or Friday the 13th then that cease and desist means nothing.

This isnt the first game that died and got revived by fans only to be shut down for legal problems. Battlefield 2 had some fanmade servers that EA finally caught on to and shut them down. Not sure if the warhammer online fan revival called return of reckoning might still be running

Unless both sides come together and agree to let dbd use the license it will never happen. They already said they would love to put Jason in the game but the license is such a mess even after the lawsuit is over that they would need to jump too many hoops to get it.

I believe copyright should be a hard time limited. Ok, you invented a new IP, here's 20 years of profit, after that let's have people outside of corporations who can afford license to have some fun creating unofficial content. There would be so many cool franchises getting great movies and games again instead of being half dead with occassional cringy attempt to remake it for the "modern audience".
Only just now learned about the resurrected mod, and am now super sad that it got shut down. Idk how it was hurting the brand, it literally would've done the opposite. There's no good reason for them to shut it down. I hope the creators could/would somehow reskin and basically whitewash the game of any licensed content, and let it be a sort of spiritual successor, rather than just deleting it altogether. Rename it to Summer Camp Resurrected (in homage to F13's original title, before it became a F13 game), make the killer a generic burly mask guy named Jeff the killer, make the counselors look slightly different and have a different name and boom, there you go. Basically keep the gameplay the same, but avoiding legal issues
Edit: looks like every mod for F13 is getting shut down. Bro I f__ing hate these people. I wish I would've been aware of all these before the crap hit the fan. I miss F13 and just want to be able to play it (or a game like it) while I wait for killer klowns, without a ton of hackers messing up the game constantly and there being no content or updates

Ok the issue wasn’t the fact the mod happened. The issue was you were able to bypass buying the original game to play just the mod for free. Which is a big no no.

Actually I think they were able to remove it since the game engine and the content within the game was solely owned by Horror Inc prior to the suits ruling...meaning that they retained ownership over that particular thing...likely anything after the court ruling would be a joint venture (like the upcoming tv series)
I was playing the mods for the past year (uploading videos of it), and all of a sudden, it became popular and shut it down. 😢 They should have kept it hush hush more we would have still had it.
When I saw the modded game was getting a revival I was so happy and I don’t even have a PC but just bc what it meant as a fan of F13 and then it all came down 😞

Sadly, they have to do this. They can lose their copyright in the US if they dont. US copyright law is wild. Its crqsy so many people posting here have no clue what they are talking about. I dont agree with it, but thatw the law.
As of april 1st the resurrected team are still working on the mod/have said its still happening so im inclined to believe them
In total fairness, you can't really let people do what they want with your licenses. Resurrected may not have been harmful to the brand currently but it could easily become harmful and the license holders need oversight to prevent this from happening. It is a shame that they weren't willing to work with the community to keep things kosher but if they've got other preexisting plans then it makes sense.
I kind of get the cease and desist, but I mean COME ON! I don't even play Friday the 13th and I'm pissed at this result. I don't really know the Friday the 13th series that well, but like, if nobody is gonna do anything, let the fans do the work! Let licensing be ok! Ffs, they ain't hating the brand!
The series Crystal Lake is currently set for June of 2025. The people behind it aren’t going to want ANYTHING rocking the boat before that premiere, as that’s what they’re banking on to revive the brand.

its worth knowing that you have to protect trademarks and/or copyrights or else you are at risk of losing them, if they had willfully allowed the continued infringement, then they may have lost the very thing they fought tooth and nail to have the rights to, to begin with. further, i think the problem was letting people download new copies of the game the mod was for, I'm uncertain if the game is still available to purchase, but to brazenly advertise "hey we are helping you to pirate this game" is kinda a very clear 'we have to do something' signal to corporations. I can't speak on whether this situation would have transpired if the mod makers had a more 'figure out how to get the game yourself then come get our mod' approach, as if other bigger companies like nintendo cant stamp out fangames and romhacks (as much as they try to) then im not convinced legal action would have definitely been taken, but by offering copies of the game, you force the hand of the company that owns the trademarks/copyrights
its possible the cease & desist will get settled out of court, that way the company can show that they did defend their trademark/copyrights without putting too much squeeze on some of their biggest fans

Just another case for why IP laws need to be reworked to make older stuff public domain. It would solve a lot of problems with regards to abandoned works such as Go! Go! Hypergrind, scrapped projects such as Wily Coyote vs Acme, stuff that's in legal limbo such as Jason Voorehees, stuff you can't seem to obtain on streaming services such as the anime called Spirit of Wonder, untranslated works such as Mother 3, and plenty more if copyright durations weren't as long as they are right now. I'd say a 10 year copyright duration should be the standard with the way things are going, but that's just me. In addition, trademarks don't override the public domain. Just an extra precautionary measure in the event some company decides they want to use that to try to counter this.

Jason Voorhees stalk would have him say Ki Ki Ki A A A and it would allow Jason to fool players with the "Heeelp Meee line".... 💯 Adding Jason to Dead by Daylight is a Brilliant idea because it would show Jason how Friday The 13th failed to showed his perks and the way he is when killing.... 🙂 Im excited... All I know is I'm boycotting anything F13 in the future until horror inc or whomever the hell else makes things right for the fans. I will always support fan projects.
The fan films are probably fine as they're not using an existing item Horror inc could make money off of, unlike the game, which is at the time this happened. Now while you can't purchase the game anymore, the servers are still up and anyone who has it can still play the game until Dec 31 of 2024. And as somebody mentioned, the fact the mod allowed people to just get the WHOLE game for free with additional content is what most likely caused this whole thing to happen. Now, idk if the game had skins n such that you can buy with real money, I never got to get the game myself so, if you have, let me know, because it could explain why they stated it 'harms' them in the Cease & Desist letter. Or they just wanted to be like Toho/Nintendo for a day and make their fans angry at them... *Sigh* Oh well..
Forgot to mention it but another point for the fan films being fine, is that they don't make any money off them. Money is a big factor for taking fan made stuff down alot of the time, and if they know there's no money being made off em, no point to do anything about it. (Unless you're a Japanese company.) Who knows, maybe they are just saved by the timing of their releases being in the middle of Jason's legal hell.

Guys completely unrelated to the video but imagine if DBD adds the terminator to the game. I mean the name would be obviously The Terminator the flavored text would be an unrelenting killer that doesn't stop until its target(s) has been terminated. The only issue is the licensing but whoever owns terminator gave rights to mortal combat so they could probably be talked into giving DBD the rights. His 3 perks could be Unstoppable, Target Acquired, and Termination. With the perks flavored text being "I'll be back", "You have been terminated", and "Hasta la vista baby"

Don't blame Josh, he's doing what he was paid for. I mean, he's doing it wrong as there's no case against infringement unless proof that the IP is being damaged by the content, and or being sold-- neither of which have tangible evidence... but he is doing it.
For tangible evidence to exist, Josh and Horror Inc. in extension would have to prove the following:
1. "The intellectual property or the holder there-of is having reputation be damaged directly."
In this case, there is no tangible evidence. They cannot prove without the defense being able to viably call it hear-say, as there's been no direct defamation of the IP or the holders in this context. As for the public's opinion on the matter _after_ the Cease & Desist was sent out and revealed to the public is irrelevant, as it occurred at the IP holder's own actions.
2. "This version of the game is being made for profit, or undermining profits of the original game in some way."
In this case, they *do* have tangible evidence for the undermining of profits for the real game by GUN. As soon as he stated that the game would be free to download and not require purchase of the base game with a 'release date' before the game's effective termination of online service, it would be deemed as direct piracy and promotion of it, even if it is in a modified form.
If it was done as a mod without the option of gaining the full game and all its purchasable content, then there would be no issue, but there *is* an issue that it is essentially a stand-alone mode that grants all past paid content.
While they have a case against it for the idea of it being pirate activity, undermining the currently active Friday the 13th: The Game's profits, the defamation charges would be tossed out immediately.
To go about it better, whether it's for this game or a future game as a modder who just wants to keep a game you love alive and are willing to put in the work, you need to follow a very specific set of rules for the content added:
1. The content in the game must no longer be directly accessible by normal means. *Example:* The World of Warcraft private servers of Ascension. They always stay at least two expansions behind intentionally, as that content is no longer 'playable' or being 'sold' in its current form, avoiding the undermining of sales completely.
2. The content in the mod must differ from the original source material if it is to be made "stand-alone". That means, while some of the content may be exactly the same, a majority must be modified. This includes gameplay, systems, and even UI. *Example:* Again, I'll use WoW: Ascension as the example. In Ascension, you can still play as an orc, and a dark elf, or a dwarf, etc; however when it comes to classes, everyone is a "Hero" and decides their abilities after the fact, which is both unique in gameplay and in system mechanics. In addition, those abilities may visually have been changed, and even mechanically act differently to the original counterparts.
3. To be monetized, it must be completely unique, even if it would emulate the setting in the original game. This means that if you made a unique killer over top of Jason as a variant, and not in anyway called it "Jason Vorhees" or mentioned anything from existing media, you can claim it as your own content and even monetize it. *Example:* In Ascension, you can purchase skins and modes that never existed in the original content. This content is not based on any content from the 'real' game, and is entirely fan made from the ground up.
That said, if you were to do this for F13, the killer in question would have to actually be unique, and not just a reskin that could be given a side by side having the same animations, sounds, and interactions in the game.
4. You can bypass all of the above by going directly to the rights holders and coming to an agreement on a temporary or permanent use of licensing rights for the content in question. In this situation, you are fully at the IP holder's mercy, and if they say no, the answer is no and it ends there. Only *one* example of this has *ever* happened in gaming, and it was with City of Heroes: Homecoming. They approached the license holders and negotiated terms that would be agreeable to the holder, without fully purchasing the IP outright. It grants them access to continue to develop content for the game, and depending on the agreement details, may also allow for future paid content to be created. In a situation like this, all of the burden of maintaining the game falls upon you, and reputation must be upheld or the agreement could be void.
IE: If the original game didn't include nudity or gratuitous violence, but your mod does, and the IP holders deem that to be damaging the reputation, they can not only break the agreement but also sue you for potential damage to the IP's reputation.
The benefits of going about it this way vastly outweigh the possible negatives, as you could ultimately, legitimately, bring the game back to life and become the main developers, supported by the IP holder as a producer-- marketing and other costs may end up falling to the IP holder if they choose to expend it as an investment for the future of the IP in its new form. Essentially, you could become an official developer of a game that has no developer anymore.
TLDR;
The guy fucked up by talking about it on social media and being open about it becoming playable before the game's servers fully went down.
He also fucked up by not fully modifying its identity from being "F13, but good" to "Good like F13".
I’ve honestly gotten over the idea of Jason being in DBD. Yeah he would be amazing to have, but his license is such a pain in the ass.
All this just for him to get licensed to WB’s Multiversus lol
