How to Notarize a Power of Attorney

    Power of Attorney Document:
    The person granting signing privileges to another person is called the principal. The principal signs the power of attorney document. The person given signing authority is called the attorney in fact.
    Notarizing for an Attorney in Fact:
    The attorney in fact personally appears before a Notary, so that should be noted in the notarial certificate and Notary journal. When signing, the attorney in fact should reference both their own name and that of the principal.
    Is it Necessary to Verify the Attorney in Fact’s Authority?
    Some state require you to verify that an individual has a power of attorney, so check your state’s regulations before you proceed. If your state does not specify, the NNA recommends you have the signer state out loud that they have the authority to sign on the principal’s behalf.
    Jurats: Taking an oath or affirmation in the name of another person is generally not permitted. So, if an attorney in fact requests a jurat, then they may only swear or affirm in their own name.
    Special Certificates: If your state does not specify attorney in fact wording, then just use the appropriate standard certificate.

    If the person does not have the power of attorney form, as a notary what do I tell them? To get the form online? Or from their attorney?

    Are these types of matters addressed on a state-specific level for prospective notary publics' when they complete their state-required training course? I have been spending the last few days inundating myself with these wonderful NNA videos since become a notary has truly gained my interest but feel perplexed as to how a newly commissioned notary can feel confident instead of intimidated, when faced with the various types of documents they are faced with authenticating especially when they see them for the first time.

    I'm a notary for mostly swearing people in for depositions. I rarely use my notary for documents. A friend of mine, is notarizing a doc and the wording is this "own free act and deed" with a line in front of it. What goes there?

    I have a question. I have a couple closing escrow on a home in CA. The husband just had emergency surgery and the hospital wont allow any visitors so we cant sign closing documents. How would we get POA notary inside to have finger prints and signature if no visitors are allowed? (We are scheduled to close escrow tomorrow.)

    I’m trying to refinance my car online and they want me to take the papers to my bank and sign the papers in front of a notary of attorney and I’m still so confused as to who I go to... I’m not sure who at the bank I have to do it in front, especially since I’m pretty sure the banks are only open with drive through

    Please I'm from Ghana West Africa,
    Please I applied university in slovenia(Europe) . They school told me to verify my certificates in slovenia embassy but there is no slovenia embassy in Ghana.
    The school gave me option that I can get power of attorney to someone so that can help me verify my certificates.
    Please my question is.....
    Do I need lawyers to write it or I can write by myself?

    This great but why don't you ever show exactly what kind of stamp to use on the documents? example: just the square stamp or the stamp with line to write in state, county, or the circle ink stamp, or an embosser!?
