Just to note, being arrested doesn't mean you're guilty. Someone can be arrested on suspicion of committing a crime, then released when they prove they literally couldn't have committed the crime (like the crime happening when they're on camera across town). People live to conflate being arrested with being guilty. In this case, odds are the guy was guilty of at least some of those, and the assaulting women ones are arguably the most important ones. I'd still like to see things go from "arrested 40 times" to " convicted 30 times", since those are times the person has been found guilty of a crime.
Reminder: Penny didn't actually kill him. When Penny released him, he was still alive. He didn't die until a day later. The cause of death was multiple drugs and preexisting conditions that were exacerbated by the choke hold.

It's not the police, if he had 44 arrests, the police were doing their job and putting him into the judicial system 44 times. The responsibility then falls to the District Attorney, prosecutors, judges, and lawmakers. If the prosecutors keep giving easy plea deals with no time, then he keeps getting out. If the DA and lawmakers are pushing for "catch and release" then he won't serve time.

It's illegal in tournaments and it was even on the list for consideration to be banned as an illegal torture technique by the Geneva convention. Because it was used as an advanced interrogation technique by the CIA down in quantanamo Bay. Just the fact that he even knew that hold says a lot. Then the fact that he decided to use it on a civilian? And then he kept doing it. After two other people had the person he was using it on restrained entirely? No, this was a murder. This was just a murder. Doesn't matter if he had a criminal record a hundred times or zero times. A murder is a murder. And then also remember all of those charges of him being an alleged criminal were for being a homeless vagrant. Hell. I have five friends that have a fucking seven-page background report and it's all just them being arrested and thrown in jail for being homeless.

Because virtually all of those arrests were for being a homeless vagrant which isn't actually a crime yet in New York. Yet is the key word there. And it is actually a known problem/phenomenon that the police will literally arrest homeless people to throw them in jail for a couple of nights to give them food. They had already removed the weapon and they already had him completely restrained and still this Daniel dude decided to continue with a chokehold. A chokehold that he knew was fatal. His trainer knew it was fatal. And he still persisted. That's murder. That is an intentional act. You don't accidentally keep squeezing somebody. That's an act you have to consciously make a decision. He made a conscious decision to continue choking to death, A person who is already restrained by two other physically capable grown ass men.
You'll notice the other two guys got immunity. Because in public court files and documents you'll notice that even they thought he murdered them because they were starting to think that they accidentally held this guy down while the other guy choked him out to death on purpose. Even they don't believe the guy. Daniel murdered someone on that train and no one cares because he's black and homeless and finally snapped after a decade of struggle with mental illness and homelessness and starving to death. Sometimes. Dude had been in the hospital twice for malnourishment.

Especially if you ask the homeless people. 40 times this man has been arrested just for being homeless. 40 times they rejected help because they have mental illnesses. This incident was only a matter of time and nobody tried to step in to stop it from happening because no one cares about homeless people and especially nobody cares about homeless black people. If you listen to any of the interviews with his friends and family that ever knew him. He was a very obstinant person and once he's heard of doing drugs he just left. He never came back. Everyone sitting there shit talking his dad but it's like his dad's just sitting there waiting for his son to come back home. You can't make people like that do something. He's a self-destructive person and he needed help and kept refusing all the help that anybody did give him. So eventually everyone stop trying.

Public records show that almost all of his arrests were for being a homeless vagrant. So he got let go because it's not actually a crime to be homeless. They just like make you stay the night in jail. In fact, sometimes the police will literally do that as an act of kindness to give you a warm place to sleep and a meal in your fucking belly. It's fucked up but that's the way our system works and that's what it leads to.

They are the ones doing the investigation and processing the paperwork that is used by courts to determine what should happen to a perp after arrest, so we can't really go separating police from the outcomes either.
Just to note, being arrested doesn't mean you're guilty. Someone can be arrested on suspicion of committing a crime, then released when they prove they literally couldn't have committed the crime (like the crime happening when they're on camera across town).
People live to conflate being arrested with being guilty. In this case, odds are the guy was guilty of at least some of those, and the assaulting women ones are arguably the most important ones. I'd still like to see things go from "arrested 40 times" to " convicted 30 times", since those are times the person has been found guilty of a crime.
