There's an old man in my town who everyone calls harmless but one time I took my girls to the store and he started petting their hair like they were puppies, I told him my kids aren't a petting zoo and he needed to keep his hands to his pervy self before he loses them, the manager told me I was overreacting and I told him that that was the most rapy thing he could have said and we never went back to that store. That is pretty gross. I do not understand why some people think it is ok to just touch other peoples hair. But I would like to point out that it is not just white people who do this, and it is not just ethnic hair that people find so appealing. I am a white guy with long, slightly wavy hair and I make an effort to take care of it. I have received many compliments for it over the years and unfortunately sometimes those compliments are accompanied by non-consensual touching. • @blankityblank4362
      @blankityblank4362 Год назад

      @@JohnH20111 Yes, it is. Kidnapping involves movement. She only touched the child’s hair with 0 intent to move the child. She /could/ be charged with assault. Since no harm was actually done, battery is off the table. And since there was no forced movement of the child, kidnapping is also off the table.
      Kidnapping: GS 14-39
      (A)Any person who shall unlawfully confine, restrain, or remove from one place to another, any other person 16 years of age or over without the consent of such person, or any other person under the age of 16 years without the consent of a parent or legal custodian of such person, shall be guilty of kidnapping if such confinement, restraint, or removal is for the purpose of: (6 points within ‘A’ followed by a subsection ‘B’ and ‘C’ but I’ll let you do some research on your own)

      So it cannot be construed as an attempted kidnapping or child abduction.
      I know that there is a common saying “aim for the moon, for if you miss, you’ll land amongst the stars” but you’re trying to aim for the next galaxy 3 galaxies over, only to miss and land in another universe.

      @CynthiaJohnston Год назад

      @@blankityblank4362 Ah, but you forgot the 'gripped her arm painfully' passage. At that point, she was guilty of 'restraining' the girl. And no matter what your opinion is, at that point even a law school drop-out can get a kidnap charge to stick. For information sake, all your research should tell you that when it involves children, the definitions are much looser than when they're 'adult'. Restriction of movement ALONE on a child is 'kudnap', whereas on an adult it's just 'unlawful detainment/arrest'.
      I know this as I have 20+ years in property security. You have to be VERY careful with that in my business.

    • @blankityblank4362
      @blankityblank4362 Год назад

      @@CynthiaJohnston Ah, I did miss some of it because I watch these things while doing other stuff. So I went ahead and watched it again. And after reading it again, it is not such a stretch as to reach for some other galaxy only to end up in another dimension, but it is still quite the stretch that the 2 mentioned previously would struggle to obtain.
      As a law school drop-out, I thought you would understand the need for correctness and accuracy when quoting something, perhaps that’s why you dropped out? She didn’t “gripped* her arm painfully*” it states “this broad quickly grabs* her arm by force*” followed by “Cousin shrieks and auntie backhands the woman clean across the face.” With force does not mean painfully, and the cousin shrieking could have simply been out of surprise and shock, not pain.
      Also as a 20+ year LE dropout, you should know that force does not mean painfully and shrieking does not mean in pain because /you/ /would/ have to be /very/ careful with force, as you really have no authority at all. Since you’re not LE, you don’t have arresting nor detaining powers granted by the government so at most what you could do would simply amount to a ‘citizens arrest’ which is not actually a thing and many have been charged and prosecuted with kidnapping and false imprisonment for trying to do a citizens arrest.
      Now, let’s just assume for sake of hypotheticals, it was painful and she shrieked in pain; BATTERY has been achieved. The reason why I said it’s not such an inter-dimensional, galactic spanning stretch is this crazy broad accused the aunt of child abuse and claimed she could take away the child “from that pain, baby” before she grabbed the child when the child backed away. That statement shows intent to move the child or at least restrain the child but where would she take the child? Her defense could simply be that she felt the child was in immediate danger and was going to take the child to law enforcement. There’s something called ‘good faith’ and while the crazy broad is clearly, ya’know… crazy, that would have to be taken in to account(along with her mental instability).
      Another reason I call it a stretch is because of the violence and force used by the aunt in the beginning. The crazy broad touched the child’s hair, thus committing assault. Then the aunt assaulted and committed battery against the crazy broad by using unnecessary force to remove her hand from the child and flung it -with force- in to the conveyor belt causing the crazy broad to “cry out in pain while clutching her hand”(as stated in the story). This is the reason so many people get in trouble with self defense claims or defense of others claims. If the crazy woman had stopped there, the aunt could have been the one charged with assault /and/ battery while the crazy broad could have just been charged with assault.
      Because of all this, the child was just collateral damage in a fight between adults. And the crazy broad /could/ sue for damages on the civil side even if she doesn’t press charges against the aunt. The crazy broad is just that though, crazy. She deserves a solid and straight punch in the face, not just a backhand. But don’t be an over-stretched Mr. Fantastic+Stretch Armstrong while flaunting your drop-out status from law school and BLET, it’s not a good look.
      I would be surprised if you even made it this far. Honestly though, while I still think it’s a stretch and it would be hard to get kidnapping to stick, I don’t see it as improbable. People have gotten stretchier things to stick before.
      And as far as my snarky and snide remarks go… just ignore the troll. It’s in your best interest. But, since anyone with 20+ years of experience in any field has certainly come across sticky situation, do you have any stories about situations relating to this that you have experienced first hand yourself or through an actual colleague, not just a random internet story/case study?

      @@blankityblank4362 Maybe in your imagination it's not 'kidnap', or in the red state you live in, but in the real world it CAN be pressed as such. The woman assaulted and insinuated that she is attempting to remove the girl from her mother. Ergo, Kidnapping.
      I have had (former) coworkers nailed when working as Loss Prevention with this exact charge, when detaining shoplifters that turned out to be 15. It is NO JOKE; it can be laid upon any one not a LEO who does so. Please look more in depth at what constitutes 'kidnap' in regards to 'minor' status vs. adult. The standards are easier to trigger when the targeted individual is under 18/16 (depending on jurisdiction) in most areas of the United States. It's a stretch, yes; but it's more of a 'basketball player blocking a shot' level of stretch; reachable by human means.
      (As a result, Loss Prevention workers are pretty much ORDERED not to detain, just to not trigger this very situation. Call LEOs in and observe ONLY.)
