      Of topic question if you have time please, I am being taken to court by a debt collector about a ESTIMATED electric bill from 5-6 years ago ignoring the fact I personally think it was past 6 years the fact the debt it based of an estimated reading as far as I can see can not be done is that correct or can they take me to court based on an estimated bill?

      @@tooldtoplay5892 Estimates are often accepted by a court regarding quantum (value) - but you might want to check what you've paid within that time in order to dispute it!

      This video should have said..don’t talk to the goons..the end 😂. They can’t just rock up to the court demanding a warrant unless they have concrete evidence I.e video of you watching Eastenders. It’s a scam.

      Don't even open the door. Just saying no thank you is contact and can be put down as an interview on door step. Like collection letters, emails, phone calls or agents. Just saying your name is contact and an admission that you owe them money. Never respond. Unless you intend to pay.

    I have had quite a few of them over the years and they always start by asking your name, they do not introduce themselves. I just reply asking them who they are and when they say TV Licence, I just say no thanks and shut the door, that's it. I get letters on a regular basis which are binned immediately. I also refuse to inform them that I do not need a licence, I know some people think it's better to do that but I don't, that is giving them your personal details, something I am not prepared to do. None of their business who I am. I am not bowing down to threatening and intimidating behaviour because they are going to send some sales rep to my door.

      I get letters off them addressed to Mr P Occupier occasionally, I did force them to remove my details under GDPR though... Gives me pedantic little chuckle now and then.

      I once heard a story (probably apocryphal) of someone involved in theft of mail who'd found his haul included cheques to the taxman, so he opened a bank account (this was so long ago that there were no AML regulations, and no proper ID checks when opening bank accounts) in the name of Mr. I. N. Landrevenue.

      @@scottsound4711 if you invoke their implied right of access you are then asking for a court to grant them a warrant to search your house because the court will think you have something to hide, better just blank them and don’t speak to them at your door just close your door on them then they have nothing further to investigate.

    One tip: don't open the door to them. If you do inadvertently answer the door, close it once they identify themselves without saying anything to them.

    I can 100% confirm that TV Licence do pursue convictions after you've bought a licence to the doorstep. I used to work in the magistrates court and this was one of the things we dealt with most. Also the agent very rarely told the individual that they would be convicted.

      Purchasing a licence on the doorstep in and of itself is not evidence of evasion. The householder may have just decided that they wish to start viewing broadcast tv after they became licensed so their would need to be some other issue such as an admission of guilt.

      @@twig3288 Normally the householder has already admitted unlicenced usage, and is trying to avoid being reported for the offence. A licence purchased at the door is only valid from the beginning of the that month. In some cases, such as minimum unlicenced use, the householder is not reported for prosecution; instead their licence is 'backdated' to the appropriate time period (this is notified to them via letter).

      The problem is the government will almost certainly fund the BBC via another tax that we'll be forced to pay making it even worse in some ways. People need to campaign for the BBC to stand on their own two feet in fair competition rather than just for the licence to be scrapped.

    Tip Number 4 is very important ... I would not say it is widespread, but I did know someone who worked for TVL who did fill in details after the fact... He was an old school friend and I caught him doing it! He had not been in TVL very long and did not last as he was caught by his bosses and was fired! So it is also NOT something that Capita knowingly encourage... It is something they will happily turn a blind eye to though!
    Much like a wrestling Referee... If they dont see it, They cannot call it!

    I answer the door, they ask "is Mr.X there?", I ask them who are they, they would invariably just repeat what they said, and I would ask "But who are you???", they respond "tv licencing" , I then say "have a good day" and then close the door on them.
    That is the ONLY conversation you need to have with them, and at no point would that be grounds for warrant being issued, which is rarely issued in any case.
    Dont try and be clever and entering into a debate telling them "i dont need to because x reason", once you know who they are, you just shut them down and close the door.
    What happens?
    Those TV licence letters keep on coming, but they no longer have your name, merely "The occupier" on them.
    They've lost at that stage, because they dont even know who you are, because you didnt confirm anything with them, and didnt give them even the slightest hint or detail.

    What I simply fail to understand is how the BBC/Crapitas continually get away with the kind of harassment that would land me and you in court very quickly. And if repeated, surely enjoying a custodial sentence.
    The TV licence isn't just wrong - it's profoundly stupid. And we can always tell a stupid law by how rigmarolic and desperate the measures needed to support it become. In 2023, this one is as logically unsupportable as the Window Tax.

      Because it is state sanctioned &, in general, the public are apathetic, ignorant of their rights & consequently passive. People care more about how crucial their credit score is to that ikea kitchen than they do about their civil freedoms.

    I am most certainly stubborn by nature. Especially when faced with blatant bs. Many thanks for making these videos. The law is a minefield and normal people end up not knowing their fundamental rights. I live in NI, not sure if the laws are the same, however I have not owned (or live streamed their shit shows) in 15 years so I literally ignore all letters and house calls. They can knock all they like

    Question-how do we ,the public, recognise a warrant with the certainty that it is genuine ? . By far the majority of people ave never seen one - which invites the possibility of underhand behaviour - does it not ? Especially with ‘tricky‘ people

      If it doesn't have a proper county court seal and must be signed in wet ink by a judge, not a clerk to the justices..pp..the police are not allowed to assist in any forced entry to do so is to act at the paid behest of a corporate entity and can be sued as third party interlopers.

    I made a 2 year declaration for not needing a TV licence. I had no letters for 3 months. Then, they started coming. I've now received 29 of them.

      @@GryffsterI made the declaration because stupidly I thought it might prevent their bullying behaviour. I now know better. It's been about 3 years now since I stopped watching live TV and I've not made any more declarations, I've learnt the error of my ways and how pointless the declaration is. They appear to ignore them anyway.

    Another great video. Thank you for doing these. It's also worth noting, for those worried about the threat of going to prison is that, to my knowledge, the only way that a prison sentence is handed down, would be in the case of a refusal to pay the fine given if you do have to appear in court, not for non payment of the licence fee.

      Highly unlikely to get sent to prison at the moment for no tv licence seeing the lack of prison space in the country at the moment

      @@TheBigfatmattAgree. And it's historically such a rare event anyway, the chances are pretty much slim to none. I read an foi some time ago and I'm sure it said back then it was only around one or two a year in the whole country.

      A few years ago there were a couple who did if I remember right 28 days in prison, but they were persistent offenders with the licence and not paying the fine. Likelihood of contempt of court at the moment would result in suspended sentence and community work 😊

    No doubt there are some watching 'live' TV without the necessary license ... which is wrong.
    The problem is that those of us do not pay the TV Tax because we do not need to are presumed guilty of breaking the law. This is plain wrong.

      So what do you propose should be done? Those that do not pay for a TV license but do watch TV or use BBS iPlayer are guilty and are getting away with it. That is also wrong.

    Happened to me, many years ago when I forgot to renew. Sold licence on door, letter changing the date of the licence to follow on from previous one, and then still prosecuted. In court they gave "protection of revenue" as the reason for the backdating, but I still got fined. Ever since, I will do everything legal to obstruct them and cost them money.

      That only happened because you agreed to enter into a contract with them and broke the terms of the contract you agreed to, then agreed to pay a fine. If you had declined from the outset there would be no contract, and therefore no fine. I have never paid for a TV licence, because I have never agreed to pay for one.

    You do not have to speak to them. You do not have to even answer the door. Even if they have a warranty don't answer the door. Use a ring door bell. And if you want to let them in as they come in you leave and go shopping. That way you are not obstructing them. You also do not have to identify yourself or be Interviewed by them

    Do not open the door, do not have your curtains open of an evening; just ignore and get on with life. Must be about eleven or so years since I had a visit from the leeches, though it makes me laugh as I have no tell a lie vision, would not have one in the house, and refuse to go into places where there is one on.

      But u have I presume a device that can watch live broadcasts and iPlayer, u can have devices including tv it's them having to prove u disobey the law, as bbb says don't just let it go to court, single justice, you'll be found guilty, challenge it bring those prosecutions down, state to judge u can own a tv or device, tv licensing have got to prove u broke the tv licensing laws

    I have lived here for over 40 years and do not own a tv nor use a computer to do so. They used to send a form asking why I had no tv licence which I sent back without a stamp. Now they just accuse me of being guilty have sent letters in red envelopes and threats. I decline togive them either my phone number or email address. Crapita are no doubt on a bonus system so when they do turn up I will just ask them to leave pointing at the neighbourhood watch displayed notice of no business conducted at the door.

    If you are confident enough, do talk to the agent that turns up at your home and politely ask how they got there, if it turns out to be a private vehicle which it almost certainly will be, then ask if they are here on business and do they have business insurance 😂

    I used to get so many love letters when I didn’t need a license. I had some terrible crapita visits also. No one ever got my name or entered the premises no matter what they said.

    When filling in any written form I always line through / cross out anything which is not either filled in by myself or applicable to whatever I'm filling the form in for - that way if anything is filled in later it has to be explained why the area was crossed out and then filled in (if a genuine mistake happens, sign, not initial, sign next to the correction). Also sign each page of the form and in your own writing label each page "Page n of nn" - saves any extra sheets being inserted.

    Tell them to sod off, just like I did. There is no contract and they have absolutely no power to prosecute. If they contact you two or more times, without your consent, it is actually a criminal offence and you can prosecute them.

    I called them about 8 years ago when I moved in, gave them my address but not my name, told them I have removed their implied rights of access, and let them know that if anyone ever turned up, I’d take a picture of them and post it on the internet with the words ‘paedo supporter’ on it, as that’s what they are. Haven’t heard from them since!

    I think if someone were really cynical they might be lead to believe the website confusion and pressurising letters are part of the way they maximise the dwindling number of licenses that they sell. Would be really interesting to see the grounds on which these single justice procedures are found guilty.

    You are only evading the tv licence (as you but it) if you are watching something you shouldn't be watching, the same as You wouldn't be evading a driving licence if you do not drive.

    Point 6, one thing I can say is this.
    They will not want that warrant showing in a real court, for how it was obtained and the false perjured evidence presented to obtain it is the last thing they will want to be examined.
    So the obstruction threat, is mute, plus there is no record of it ever happening.

    I find it funny that they keep sending me letters saying they're going to send someone round (which never happens) but when I lived in the run down part of town in my first ever flat they did almost immediately. We had a TV yes but it wasn't plugged in we didn't watch TV nevermind have the ability to but yet they managed to persuade me into buying a licence that day ... Never again!

    Well my issue is I have an 8x10 foot window through which you can clearly see my 65 inch TV screen from 20 yards down the street showing all the live sport I love to watch… Now I could leave my large living room in my large detached house and move the whole lot into a small box room I have but that seems a little extreme. 😂😂😂

    What I would like to know is how civilians, and that's what Captta are, civilians, is how they can be issued with warrants. In Scotland they are not allowed, so why are they given warrants.

    If you get a notice of prosecution under the single justice procedure should it be in your name or can it be addressed to the occupier of the property and would you only get this before or after a warrant has been issued?

    Let's face it, the TVL should be regarded as an unlawful forced subscription.
    However, I'm a willing subscriber as I believe the BBC produces some of the best programs in the world and it can't do it for nothing.
    However, why anyone else has to go through all these legal hoops to avoid prosecution is ridiculous.

      I would hate for the BBC to have to be paid for by awful intrusive adverts. Because the BBC does not have to have advertising revenue it is able to put out programmes that might be unattractive to advertisers but are very important nevertheless. In that way the BBC sets the standard that the other major broadcasters mustaspire to. Abolishing the license fee and making the BBC dependent on ladvertising revenue starts the race to the bottom.

    What if you just say no thankyou and close the door but they lie about speaking to you and make things up to get you prosecuted. Unless they record any conversation then it is their word against yours. If you do speak to them and reveal that you do watch or record broadcast TV without a licence, and they have no evidence of the conversation, how can they possibly get you prosecuted when it's their word against yours

    I just called them and explained that I don't watch Live TV. They cancelled it, gave a refund and documented that the property does not need a license for two years.

    I find it quite insidious that TVL/BBC/Crapita are now using the wording that defendants are have been 'found to be in possession of equipment capable of recieving TV programmes' rather than simply 'watching' said equipment! It's a bit like owning a pair of scissors but not using them to cut your hair or using a microwave oven to dry your socks!

    If they turn up with a search warrant, before they gain entry, can you ask what evidence was used to get the warrant?
    Do they have to tell you?
    If they said 'i saw the TV on through the window' and you can prove it was impossible to see a TV through the window from the front door or garden can you challenge the validity of the warrant and refuse entry?
    This would mean the TV Licence goon lied to get the warrant - what happens then?

      Yes. The warrant states the 'evidence' that was presented to the judge/magistrate by TVL.
      You are within your rights to demand to see this.

    Fortunately ? I have a diagnosis of PTSD and responded accordingly to the Agent that I was in fear of Authority
    Additionally the Agent had falsely claimed that I had invited him in, which fellow PTSD sufferers will know is EXTREMELY unlikely. Nonetheless I signed his electronic form...Don't sign anything

    I haven't looked at BBC iPlayer since Clarkson got sacked but I remember seeing YT vids mentioning iPlayer now requiring users to login and confirm they have a TV licence against the database. I really don't think a VPN is going to help in that situation and, since nothing else that anyone does on the internet is of any interest to TV licensing, not really seeing the relevance of the NordVPN advert. I may be wrong on that though as, as I say, I haven't seen iPlayer in years.
    However, I'm also dubious that TV licensing (private company) could legally request my internet history from my provider, or even find out who my provider is, or have a reason to in the first place as iPlayer already logs users. I suppose if someone was watching the live stream of GB News via youtube, they'd need a TV license but is someone really going to go through every single youtube link the history says someone has been to to check it's not a TV channel? I mean I know they're getting desperate but that's clutching at straws. Please clarify.

    I just told the Tv licensing company I don’t need a license. I haven’t watched Tv in years now. Netflix, RUclips, Disney and Prime ensure I always have something to watch.
    They have been sending me letters every month and it’s getting annoying, specially within the way they word their letters and what fonts they use etc.
    would have been nice to tell an inspector to pîss off lol

      Annoyingly, if you watch any RUclipsr (or Twitch) do a live stream you need a licence. That is, if the strict letter of the law is followed.
      Likewise if you watch a RUclips stream of a Nasa rocket launch in the USA (while you're in the UK) for example, you still need a licence.

    There is NO requirement by law to purchase a tv license.
    It’s only required if your watching live broadcast emissions from a television company or i player, that’s it. The rest does not require you to purchase a tv license or even prove that you don’t require one....
    You could own as many TVs as you wish and not require a tv license....

    Surely the BBC are in breach of RUclips's terms of service (Permissions and Restrictions, clause 1) when they upload videos to their RUclips channel that requires a statutory licence to view? Or (if not the case) RUclips can be held liable for any fiduciary loss you suffer by watching a video that there is an implied licence that you haven't been reasonably notified of???
    In my opinion, it's an absolute joke from the BBC. You either have:
    1.) the TV licencing legislation, but with viewing online carved out from the legislation, or
    2.) you don't have the carve out and you accept you can't licence content which you have elected to also upload to third party websites.
    It is totally absurd and outdated.

    Can we be even more clear about your first point... BBC TV Licensing have adopted a 'protocol' (for want of a better word) that mimics Statutory Off Road Notice (SORN) for vehicle taxation purposes - the key point here is that SORN is Statutory, i.e. proscribed in Law. The BBC TV licensising engagement model is not prosribed in Law and the BBC are wrong to adopt it or to try to use it as a mechanism for coercion. The Law is plain - if you watch live TV or use BBC services you need a license. The Law does not say that you have to engage in the BBC's made up business practices or sign up to a 'I do not need a license' scheme. Moreover the business practices of the BBC are misleading, threatening and bullying and should, themsevles, be challenged as at least unethical and potentially unlawful.

    We need some public service TV.
    The BBC is an iconic part of our culture - along with the NHS it’s one of things that defines the uk around the world.
    BUT it’s understandable that some might not be able to afford a licence. Or they might just be tightwads.
    So.
    We need to pay for public service broadcasting. That could be a number of ways BUT if we abolish the licence fee then it’s likely the cost will fall to general taxation meaning we ALL pay towards it. Furthermore being funded essentially by the government of the day would mean an even less independent network.
    Sometimes, something imperfect is better than nothing at all - which is what we’d likely end up with if the TV licence deniers get their way. I believe most people trying to evade the licence are actually watching TV illegally and are just looking for lazy, snide way out.

    Black belt barrister - Are these letters from the BBC (Capita), not bordering on illegal. Laws around debt collection protect the individual from misleading or inaccurate communication. When they define dates of a visit, I believe they are lying, hoping to pressurise honest people into buying something they don't need. Is this not harassment? Or even stalking?

    I'm just waiting on them to prosecute me. I am NOT filling out yet another form saying I don't need one because every year or 2 they feel like sending harassing, embarrassing red letters made to look like debt collectors, basically saying 'how bout now?' and expecting me to fill out the same form for the 10th time saying no, I still don't need one. They're not getting a response, they're not coming in my flat and I will not be communicating with them in any way. I made it VERY clear last time that I would not be doing another form and I would let THEM know if my circumstances change and I need one.

    If you purchase a TV licence on your doorstep, it is valid ONLY from the beginning of that current month. In other words, if you have evaded the licence fee for [say] 4 months, then you have not paid for the previous months. Hence you can be reported for potential prosecution for any unlicenced usage. TV Licence officials will [or should] clearly state that purchasing such a licence does not prevent being reported for the offence.
