  • ★ PIP ADVICE: Assessment, Mandatory Reconsideration, Tribunal (My Experience with Disabled Benefits)
In Today's Project Diary Video I will be explaining the reason why I've been too unwell to upload videos lately, as well as giving advice for people with mental or physical disabilities who are now going through the new benefits system called Personal Independence Payments (PIP). This is taking over from the Disability Living Allowance (DLA)

I used to work for DWP left in March this year. The system is a shambles, there is actually targets we were told to meet which was no more than 20% in the ESA support group and no more than 25% in the WRAG group. Almost everyone is turned down on first Mandatory reconsideration as most people don’t bother appealing the decision and as you say lee nearly 70% of people win their appeal. The Targets mean that at least over half of the claims whether sick/disabled or not need to be closed to meet targets which is one of the reasons I left. I can tell you they don’t half treat the people that work for them badly as well.

    • @ProjectDiaries
      @ProjectDiaries  6 лет назад +53

It's absolutely awful. I've had so many people in the DWP contact me over the past year saying the same thing. I'm currently working on a documentary showing people the downfall of this system. I'll hopefully finish it when I'm well enough. Thank you for speaking out on this matter from your own experience

Project Diaries your very welcome Lee. Technically I should never disclose this as I’m still under the official secrets act for another 2 years but that’s why I wouldn’t never reveal my name. People need to know what’s going on, it’s by far the most corrupt organisation I have ever worked for, Second from DWP would be the Home office. I look forward to seeing the documentary you’re working on. Good luck!

Your right about the way it's thought out they say you must be able to walk 50 meters or you won't qualify for the mobility element however the physiological say it is possible to learn to walk incorrectly which will lead to incorrect hip and knee joints being used which according to the doctors will leave you needing hip and knee replacements and more physio therapy
Looking at the conclusion of the report and your benefits being cancelled would have doctors and lawyers struck off!

I've been having such a difficult time with my ESA claim after I lost my job due to mental health issues. This government is unnecessarily cruel, especially to disabled people. Too many people don't realise how hard it is to navigate the benefits system. It is worth looking at Disabled People Against Cuts if you haven't heard of them already. Good for you for creating this video and speaking out, solidarity x

ESA and PIP assessments are a joke. It's awful how these companies are making millions off the back of the suffering :(

    • @hannahkirkman4492
      @hannahkirkman4492 6 лет назад +8

It’s worth noting that they can reschedule the ESA assessment multiple times, even when they insist they cannot. My GP left the surgery so I couldn’t get a letter saying I needed a home appointment for a long time after the initial date they asked me to attend, and they rescheduled it 4 times. One time I received a letter saying I was getting a home visit the day after I had ignored a knock at the door as I didn’t know who it was (anxiety) and they even rescheduled then.

A Freedom of Information request has forced the Tories to admit they've spent £108 million trying to deny disabled people vital benefits, in 2 years. Add this to the £153 million a year the sanctions regime costs more than it saves & you can see how much their cruelty is costing.
My neighbour can hardly walk has had his mobility vehicle taken away from him and yet he has cancer along with other medical conditions. My own man is awaiting his tribunal hearing as DWP wouldn't change their mind after his assessment and he has numerous health problems. Worked all his life until age of 55. He's now 64 has paid his dues and has to cope with this stuff which is downright degrading and cruel. Sorry to hear you are having to go this and I hope everything goes your way come your hearing.

Just had my pip cancelled. As I am in a wheelchair and can't manage buses this now means I will be totally housebound once they take the car back. Of course I will appeal, but the worst thing was, when she came to do the home visit she asked me if I could walk a little to the kitchen door, roughly 2-3 metres. I said sure, i would try, having already honestly admitted I could manage maybe 10m on a good day. As I stood, I was clearly struggling so she told me that it was ok and to sit back down, that she wouldn't ask me to do anything that wasn't safe. I said no it's ok I think I can manage but again she said no. I then had my pip removed 2 months later because she said I could walk 20-50m!!! This bitch said she used to be a nurse, so guess she must have been one of Beverly Allet's friends. (see update)

Thanks for sharing your experience, it helped me a lot. Today as in 31,October, I attended my PIP Tribunal which was pure torture because my health condition is Social Anxiety Disorder, so facing the Judge, Doctor and two other people, one by my side who was from the DWP, put me in panic, leaving me crying and shaking almost all of the time that seemed to have no end with one question after another. When the tribunal was over I was asked to wait in another room for a few minutes before being called back in and told I have won the appeal, which for both myself and my lovely wife who was my representative, left us both feeling a great relief with much emotion. Was explained that I would receive the standard rate for both Mobility and Daily living, back dated from March 2021 and would continue to receive until March 2024 before being assessed again. Still can’t believe I won, not just receiving what am entitled too, but also beating the DWP.

I've been having issues with ATOS for years.... The worst thing about it the blatant lying, obviously to help meet targets....
I've got Meniere's disease, meaning I get vertigo and balance issues amongst other things.... Upon walking in, I stumbled, fell through her desk and knocked her computer over. There was no mention of this in the report at all, simply said 'balance is fine'.... There was another part where she said she did not agree with my specialist's diagnosis and that there appears to be nothing wrong with me.... Found out later that she was just a nurse and yet felt she knew more than my specialist....
After over a year, I eventually won at tribunal, only to get it taken off me three months later after another assessment....
In the last four years, I've been paid a total of three months ESA due to getting kicked off repeatedly....
I hope you have better luck than me....

I feel for you Lee, I suffer from asthma and scoliosis as well as depression and anxiety. In 2016 my then girlfriend had been suffering from a number of physical and mental health issues that she had been dealing with for a number of years prior, we went to multiple doctors multiple times over the course of three years. It wasn't until she mentally broke down in front of a doctor that anyone started helping us. It was finally good news to get help, but unfortunately by then the damage to our relationship had already been done and shortly thereafter we decided to go our separate ways. I can't help but think that if someone had helped us out earlier we might have stood a chance. I truly hope you get the help you rightfully deserve.

Ran across your pallet shed build. I am working on a pallet project so, I have seen a few but, none clearer nor more entertaining to watch. Most are just still images being zoomed in or out or, a slow pan with some type music lulling me to sleep. No details about how they actually built the project. Just images of the stages of the structure going up.
I got a kick out of how you started to take the pallet boards off and struggled for a while just to remove one board.
I applaud your outstanding attitude of perseverance and willingness to continue to plug away at a that insidious wall of indifference that many governments enact upon the very people that they serve.
Thank you for sharing your knowledge. I learned quite a bit and will use your gift you gave to me. I wish you internal peace as you work to display resolute fortitude in the face of that adversity. You are an inspiration to me. Thank you and Bless.

Thank you so much for your video. I am just beginning the process of changing from DLA to PIP and am waiting for an assessment interview and already I have a great deal of anxiety about the whole process and have already considered just not bothering because I just want to get on with my life. To see your video and what you have had to go through has encouraged me to hang in there. I hope all goes well with your tribunal and get back the help that you had. Thank you very much for sharing your experience.

Hope to lift your spirit up a bit by telling you, that you have inspired me to start a new hobby. I am now also growing all kinds of things, just planted some seeds in a small growing container (Chilliy Peppers, mixed herbs, spring onion, coriander/cilantro). The coriander is growing fast and when repotting it the ground it has been growing in from seed smells like coriander really neat. Also been trying growing garlic from cloves, it is working very well and they surprisingly grow so fast. I have been having lots of fun growing these amazing plants.

Thank you for your post this has really been helpful
I had a stroke in 2010 and was awarded the higher rate of both components indefinitely under the DLA system.

In 2017 I was informed that I would need to have another assessment due to DLA being changed to PIP. I attended that interview on the 1st March 2017 and was awarded the standard rate of care and the higher rate of mobility.
In February of 2018 I had a heart attack . I informed the DWP as it clearly states in there letter that any time spent in hospital or change of circumstances should be reported. I was informed that another assessment would need to be done. I attended an assessment on the 3rd October 2018 and I left there feeling totally belittled, dejected and feeling worthless. Especially as her last words to me were "YOU ARE NOT GOING TO GO HOME AND COMMIT SUICIDE NOW ARE YOU" On the 23rd November I received a letter dated the 16th November informing me that I was longer entitled to the higher rate of the mobility component.. I do not have the use of my right side, plus I suffer with osteoarthritis in both knees and hips and COPD. It beggars belief how she came to the conclusion that I could walk 20-50 meters.
My doctor says there is a charge for my report £30-50.
Wishing you all the best with your appeal.

Hi, I'd firstly like to say that I love your channel. I found it when looking for advice on growing chillies here in the UK. Your help and advice has been invaluable whilst starting off this hobby. I'm really sorry to hear of your health issues from birth. I'd also like to say that I am a caseworker for Personal Independence Payment and have been for 4+ years now. The reason I took the job was to help people with disabilities and long term health conditions. I am proud of the role I play, but am ultimately not responsible for the decisions that are made. I've watched your videos regarding the mandatory reconsideration stage, and potentially the tribunal stage. I'm really sorry it took so long for it to be dealt with in your case. You're an inspiration to many, keep up the great work. :)

The DLA is *not* made up of a 'carers' part and a 'motabillity' part for people to get a vehicle FFS. It's the care component, and the mobility component, the latter decides how mobile the person is, how they can get about. Nothing to do with a vehicle unless they want a nice shiny new leased vehicle from the motability scam, in which case, they lose all that part of their benefit to pay for it. You don't *have* to lease a vehicle. You can buy your own vehicle and keep all that part of the benefit and usually end up better off financially. It doesn't cost me £250 a month to run my 14 year old car.
The care component is for how much personal help you need to go about your daily life. You can choose to pay someone to help you or not, the money goes towards things like extra laundry because of incontinence, or the cost of buying walking sticks, or handles and utensils to help using the things in your home.

Just seen your video for the first time and will definitely be subscribing. Thank you for taking the time to make it and in a way that's easy to understand. I am still on DLA and dreading the PiP assessment, not that I have anything to hide, in fact things are worse and I have been Ian hospital twice for operations since then. Good luck to anyone trying to get a home interview! I tried with a letter from my doctor and they still wanted me to attend and kept sending dates. I explained it to a very nice receptionist who told me to do it three times and they will give up. This was for ESA, as they pay my stamp not for PiP. It worked as she said! They put me in the WRAG group and they would pay my stamp and I did not have to attend. The system is bonkers and pot luck on who deals with your case. They seem to work on the principle that if they make it difficult people will give up and I sadly think this is true. I personally keep a fully written record of everything in a box file and would appeal everything. I'm hoping what I filled in my DLA form, which I copied, will be the back bone of my PiP application. Good luck to you all and shame on those behind this system for putting extra stress and strain on some of the most vulnerable people in our society.

So sorry to hear what you have had to go through and angry at this cruel, heartless government. It seems crazy that private companies from France and America can make profits from people’s struggles. I went through something similar sixteen years ago. I had a heart attack and couldn’t work. Walking up the street left me breathless but despite my doctors support and evidence saying that I was waiting for a by pass operation, the panel took away my incapacity benefit. Luckily my wife was working and supported me. I had the quadruple by pass and after three months was able to get a job again. I have worked from the age of 15 and I have just retired. I really enjoy your videos and have learnt so much from you. I now have my vegetable patch for the second year and have planted potatoes, peppers, tomatoes, onions, beetroot and strawberries. I wish you the best of luck for your tribunal and hope your pain can be eased. As my grandad used to say, “ dont let the buggers grind you down”.best wishes from Billy the geordie👍

Thanks for you video. I went to a tribunal but sadly mine was in a court setting with a judge sat on a bench with a dr. They were horrible and intimidating. The DWP hadn’t provided the medical evidence. So I offered mine. It sent the judge into a rage. He stopped the tribunal and told me I had to come back with a paginated list of the medical evidence. I didn’t even know what it was. It’s like and index and contents overview. I’m also dyslexic it was a nightmare for me to do. It took months. I felt degraded and humiliated by the whole process. The whole experience was one of the lowest points of my life.

Worked all my life in the care industry. I got crushed and made disabled by a woman driving a mobility car. Now I’m in the hell of having to depend on benefits and it’s so hard. Three years after my accident I won my appeal. I am now depressive. I struggle every day with life and getting around. I feel I paid into the system as have my family and friends. All working people, all disgusted by the system. I think it is evil and uncaring. What ever happened to the anti discrimination laws in this country. Vote UKIP people the EU and government don’t look after ordinary working people. We are treated like criminals and they work on the assumption you are a liar. Hateful disgusting system. Run by criminals. God bless all that are going through this. Stick with it don’t give up please.

What a wonderful and inspiring man you are! Just been knocked off PIP after assessment as I have well- defined legs, yes believe it but NO reference to my main condition incisional hernia that considerably hinders my movement. I had serious post operative complications after a full hysterectomy for cancer. I am still under the care of the amazing University College London Hospital with oncoming plastic surgery and eventually a serious stomach construction operation. Plenty of past and current documentation. Oh, as pretty articulate and confident that was mentioned in the the overall report. I am not claiming for mental health issues. I am a retired teacher so confidence and communication have my main stay. What a maze of nonsense. Please keep informing us and being there for us all.

All the paper filling and no one ever examines you. Its not about your disabilities its about answering the questions which is irrelevant in most cases where disabled are concerned. There is no proper legal representation for disabled now either, where DWP will supply solicitors.
I have Charcot Marie Tooth, scoliosis, spondylitis, arthritis, dislaxic and dyspatcha , the weather/cold can affect my conditions. I was not medically examined by the assessor nor the appeal which I lost. Years ago I saw a proper Doctor who put me on for life and said I will never be called again... Not till the Government changes the goal post.
All I get given is more papers and more and I am sinking in all this. Where I live I have given up on getting help, Also this is a Tory area.
I hope things get better for you. Good vid all the best. :)
