Even in the fucking Thor myth that involved him getting tricked into fighting Jormungander, he lost. He couldn't successfully lift the serpent. He definitely didn't dismiss it as not worth fighting.
There is a nice bit of older space wolf lore going about where space wolf stories are actually all wrong, seeing as nid like monsters didn't exist on fenris when Russ was about, showing it's actually....probably bullshit.
I think the best way to look at it is that all lore is written from the perspective of a over-zealous scribe. Even putting on a T-shirt can sound impressive when twisted through the hands of a litterate peon who both thinks you're the greatest person ever and knows that even a modicum of criticism will get them killed or worse.
@@andrewstepanek8933 i would point out there are multiple examples of Thor and the Serpent coming into conflict. at the Lifting of the Cat in his challenges by the wizard jotun king he did successfully lift one of its paws of the ground which had caused a panic among the watching jotun cuz if he managed to fully lift it he would've broken reality and the realms. another is the other story where they clash. Thor goes fishing for the beast with an Ox's head and is hauling the World Serpent out of the sea. he gets it's head out of the water when Hymir, the jotun whose boat he was using (the gods wanted his massive iron cauldron for a party they were having with some other jotun so Thor went to get it, ate 2 Oxen when he arrived and Hymir said they would have to fish tomorrow for food, hence the trip) was terrified and cut the fishing line JUST as Thor was about to haul the beast out and smash its head with Mjolnir. i think its safe to say the 2 are meant to be evenly matched in strength and the deciding factor was whether or not the Jormungdandr was biting his own tail to hold himself in place. when trying to 'lift the cat' it was, and when fishing it wasn't. heck the part of the fishing story i always found amusing was, forget Thor and Jormungandr, that damn *BOAT* AND *FISHING LINE* was holding the pulling force of both of them and staying afloat and not snapping, but being frail enough to be cut ^^. the 2 knew they were fated to clash in Ragnarok and when they did Thor kills Jormungandr, so you could say he was stronger, but then the takes 3 steps and dies from its poison so was he stronger if the poison does count.

This is my first Rimworld. Looks like a top-down Oxygen not Included whose graphics were all made by the programmer, AWESOME! Too bad it's $35 😲 (I never pay over $20, hopefully Winter Sale?)
TLDR: Your Warhammer news segment is fair use, that is rock solid, GW cannot do anything about you making a show commenting on developments in Warhammer. What GW might try to do is coopt existing shows like yours or cultivate their own influencers with special access and signal boosting to try to keep everyone on-message. Your reaction to and commentary on Warhammer news and content constitute a transformative work, which you are distributing for informational purposes, like the news. Gameplay is much more of a gray area in legal terms, most legal scholars think that if this matter did appear before US copyright law courts, gameplay itself is considered transformative, but no real caselaw on this matter in the US exists yet. So far, aside from Nintendo most games companies have not tried to challenge this, and I think Nintendo is not as interested in the revenue so much as controlling the kid friendly "disney" nature of their brand, and that's how they would probably argue it in court (rather than the claim that the gameplay itself is infringing on their copyright). In theory GW might be able to go after things that actually use their IP like TTS, but it would be PR suicide. The smarter strategy would be to start hiring influencers or coopting the existing shows and more carefully managing the messaging and content of those shows to align with their brand. They can't silence you, but they are a big company, they can certainly be louder than you if they try.
If I'm not mistaken TTS DID receive a cease and desist. As someone on the Reddit pointed out, it doesn't really matter if the suite is viable in court or not. GW has the money to draw out a case long enough that a smaller content creator simply cannot afford to maintain it anymore. The fact that this is on RUclips doesn't help matters as YT has clearly shown it doesn't give a rat's ass about protecting its creators. I don't think they'll come after things like Tom and Ben's Warhammer news, but if they chose to, it's unlikely T&B, or the Yogscast as a whole, would have the resources to realistically contest that. In reality, they probably won't come after many people at all, but the fact that they MIGHT is enough to scare most people into closing up shop or changing their content prematurely. The more people that do that, the fewer targets they'd actually have to enforce their ban on and the easier it would be to do so. It's very much still a possibility, though I hope it doesn't come to that. As for being a PR suicide, well...this is the company that famously boasted they don't ever do market research. Honestly, I only follow GW loosely and I still have no idea why people still buy from them. It seems like everything they do is a slap in the face to their fanbase and it seems like it's been this way for well over two decades.
Seems like about two people donate every stream to tell B&T that they just started buying & painting minis because of them. Only a foolish king kills the most popular jester. ... but it is GW
@@RubelliteFae Yeah I agree, I think it GW should allow fan works based on their own ethics, they have actively encouraged the community to get creative with their IP. If it wasn't for people messing with it, I don't think 40k would be nearly as compelling or popular. That said, I think the issue in a legal sense has more to do with setting their story in-universe. The Orville is a clear parody of Star Trek, the ideas taken from it are protected by fair use, but they don't run around in the star trek universe, they had to create a facsimile of it. The most I have ever seen anyone push US parody law is the "dumb starbucks" incident, while starbucks never sued, a lot of ink was spilled on whether this was protected speech under parody law. The main thing the courts are concerned with is whether a regular person could confuse the parody content with the brand being lampooned.
Can someone explain why people still buy from GW? Like...no sarcasm, no snark. I genuinely don't understand. I don't think I've EVER heard anyone say anything positive about their policies, game mechanics, pricing, or anything. The closest I've ever heard were along the lines of "good quality models, but it's a shame they're so much more expensive than they should be". Other than the models themselves, I don't think I've ever heard even faint praise for them. They're not the only wargaming company on the market. They're not even the only producers of models that work with their OWN games. So...genuinely, why do they have such a borderline monopoly on the hobby? I should clarify my only exposure to this hobby and the market is basically through Tom and Ben. I don't play the tabletop games, though I'd like to (but probably not Warhammer or 40K), I don't buy the models, or anything. So, I admit maybe there's something here that just eludes me.
Tabletop gaming is very largely dependent on what everyone around you plays. If nobody in your area plays X-Wing, it's unlikely you'll be collecting X-Wing. And seeing as Warhammer has always been one of the most popular wargames, especially in the UK, it constantly maintains a fanbase, because people who want to get into wargaming will play the one that everyone else is playing, and the people already playing it are doing that because everyone before them was playing it, and so on.
