    my thoughts on police conduct.
    1: Police should be licensed nationally whether they are employed locally, sheriff or state. the license criteria must include basic rights and conduct knowledge.
    2: Police should be REQUIRED to carry $3,000,000 conduct insurance with a minimum personal deductible of $3000. if any award is higher than the $3,000,000 then the city/county or state is liable for the balance
    3: When police go above a threshold of abuse or conduct 3 times or their conduct results in arrest of the officer 1 time or the conduct insurance is exhausted the federal license should be revoked permanently.
    4: All police conduct complaints should be investigated and reviewed externally by an independent organization.
    5: All officers should be required to carry body cams that record and broadcast to a secure place without an on/off switch which can simply be done by the camera automatically turn on when removed from a charger. The recordings further should only be able to be seen and not erased unless done by an independent organization outside the jurisdiction and only after a completed court trial AND only after all appeals are completed or appeal times have passed. The officer should be fined if the lens is covered or the audio muffled by covering the microphone.

    This sounds like every other case I've seen where police screwed up the raid by getting the address wrong and caused someone's serious injury or death. The result had typically been "oops forgive us.. It wasn't our fault". I truly hope justice is done here..

    Update: As of July 2019 a Federal Judge has said the David Hooks wrongful death lawsuit may continue. The officers in question claimed immunity from civil liability, but it was discovered that the request for a search warrant had lies and omissions made by the police. No information on a date for the trial was available. It's been over 5 years now and justice is still yet to be done in this horrible case. If anyone learns anything new please post it here.

    I think this is where we should actually hold these animals accountable for their actions... If they entered the wrong home, or had a bogus warrant this should be considered m/s at a minimum or murdered. This happens way to many times for these raids to be considered a mistake. Cops shoot first then asked questions when entering a mans home need to be cause for everyone in America to be upset. What good id having laws if they are not applied equally. .

    I am a former sworn deputy.. and today, the police work I see being done is an embarrassment to what used to be an honorable profession. So much so that if this occurred to me in my home and anyone in my family was killed in an illegal unwarranted raid without notice, I will make any person involved rue the day they came to my home and killed my family member. People need to start standing up and saying no more. And those doing the job need to get the proper training like we used to get and stop acting like they have full legal right to lethal force just because. Right now we see cops being killed on the news more and more.. Well guess what? I can tell you why. And the media is complicit in not telling the American public the truth about why it is happening... More and more police departments and hiring types that should not be wearing the badge and more and more departments are forgoing the training that used to be the norm. It used to be that lethal force was a LAST resort ONLY used under imminent threat and when all other options were tried. Not any more..

      First off, thank you for your service and courage, I respect LEO but, like you said, it is way different today than 10/15 years ago! I remember when I was a young man and was ablet to walk up and talk to any LEO of that time. The cars all had "To Protect & Serve" on them and they all spoke with professionalism. That is all gone now, thanks to the Socialist Party! I have a battle buddy, from the Iraq War who is a LEO and I guarantee he has Integrity and would not stand by if something like this happened!       The Sheriff is to make sure that “Due Process of Law” is met before any arrest or seizure by police
      enforcement within his County; and, before any executions of judgments. Even a U.S. Marshal or other
      Federal Agent cannot execute a Warrant of any sort within a county without first notifying the Sheriff;
      and, it is the duty of the Sheriff to make sure “Due Process of Law” is met before allowing a Code
      Enforcement Officer, a U.S. Marshal or other Federal Agent to proceed. He is also duty bound to
      prevent SWAT team raids against, innocent under the law, code violators.

    AN UPDATE, SINCE YOU PROBABLY WON'T SEE ONE ON THE NEWS: On February 22, 2022, after a seven year lawsuit battle against the Georgia police department, the judge refused to dismiss the case and brought both into mediation to settle the lawsuit before it was to go to trial. All appeals filed by the police department's legal team to have the suit dropped were exhausted, so it was time to pay up or it was going to the jury and the sky is the limit for a settlement then. The widow Teresa Hooks and her family reached a confidential settlement and feel that they are going to receive about all the justice they can expect to receive and move on from this failure of law enforcement and their refusal to voluntarily take accountability for their crimes against this family. This was all over a meth head informant claiming there were drugs in this couple's home, when there was NOT. Georgia loves to flaunt their "immunity" status when they destroy innocent people's lives, but they didn't get away with it this time. Georgia cops fought a similar battle after throwing a flash bang into a crib critically injuring a baby and refusing to accept responsibility or help the family. After a lot of pressure and lawsuits, it seems the "immunity" got denied and they got over $3 million in settlements against the two counties involved. Still not enough for the permanent scars that child will always have and the family being unable to trust LEO's.

    UPDATE FEB 23, 2022: 13WMAZ also reached out to Hooks' lawyer, Mitchell Shook. He sent us the following statement:
    "Teresa Hooks is pleased to announce that she won her fight for justice for her husband, David Hooks. She has successfully settled her lawsuit against those responsible for the death of David Hooks.
    She believes that her victory makes everyone safer in their homes - safer from the kind of reckless police home invasions which took the life of her husband.
    Seven years and five months ago, David Hooks was gunned down in his own home, because of the sheer incompetence and willingness to intentionally violate the constitutional rights of David Hooks by the former sheriff Bill Harrell, former drug task force supervisor agent Chris Brewer, and the members of the sheriff's response team. The long journey to get justice for David Hooks has seen the individuals responsible for his death chastised by the United States District Court and the 11th Circuit Court of Appeals. Even the Supreme Court of the United States refused to consider the Defendant's last appeal.
    With jury selection set to begin Monday February 28 at the federal courthouse in Dublin, the court ordered a mediation take place before a United States Magistrate Judge. As a result of a day long mediation conducted on Tuesday, February 22, 2022, the wrongful death civil rights lawsuit filed on behalf of Teresa Hooks has been fully resolved. The terms of the settlement are confidential, but the terms were reached only when the Defendant met Mrs. Hooks demands.

    This is a prime example of why clandestine, no knock raids should be illegal. Even if you are a criminal and some unknown person breaks into your home, your first thought is for self defense.

    Laurens County grand jurors decided that evidence didn't support criminal charges in the 2014 shooting death of David Hooks by deputies as they raided his home.
    The shooting occurred as the LCSO served a search warrant late at night, on a family who had just been burglarized the previous night - and the search warrant was based on the word of the burglar. Yes, on the word of the burglar!
    Mr. Hooks contacted the Laurens County Sheriff’s Office (LCSO) on September 23rd to report a burglary in which a vehicle, firearms, and fishing equipment were stolen from his property. Investigators were able to quickly to track down the suspect, Rodney Garrett, who had stolen another vehicle on September 19th and had been arrested for shoplifting on August 29th. However, it appears that after his August 29th arrest, Garrett was recruited to work as a confidential informant for the LCSO Drug Task Force. This meant that instead of turning himself in to the Sheriff’s Office, Garrett was permitted to contact deputies and arrange to meet them at an undisclosed location. There, he claimed that he had found methamphetamine in the vehicle that he stole from David Hooks. Less than six hours later, Deputy Chris Brewer of the LCSO Drug Task Force submitted an affidavit to Laurens County Magistrate Judge Faith Snell based on the information from Garrett and received a search warrant at 9:56 p.m. on September 24th.
    The head of the Drug Task Force, Deputy Chris Brewer, sought a search warrant for Mr. Hooks’ property right away. Based on the word of an admitted thief and Deputy Brewer’s representations, Magistrate Judge Faith Snell granted the search warrant - but NOT the no-knock provision - at 9:56 p.m. on September 24th. Within the hour, the LCSO Special Response Team (equivalent to SWAT), along with Sheriff Bill Harrell himself, headed out to the Hooks residence in full raid gear and equipment.
    Teresa Hooks, David’s wife, heard and saw at least one vehicle coming onto their property at a high rate of speed with the lights turned off. She saw men with hoods, camouflage, and weapons approaching the house. Frightened, she woke her husband, who went to the door with his shotgun. Though he never raised the shotgun from his side, and it would ultimately be found to have been unloaded, the deputies massed at the door opened fire on Mr. Hooks.
    The search warrant was left in the kitchen of the home at 10:55 p.m. The Georgia Bureau of Investigation secured a second search warrant at 1:52 a.m., and the search continued for 44 hours. No contraband was located anywhere on the property.

    PART 2 ...will state "Oh, we can not discuss this matter" because of the litigation of the lawsuit of the surviving wife. Undoubtedly the officers involved will go on paid vacations (administrative leave!!!!!). NO ONE will have the character of admitting that a colossal mistake was made. The second amendment zealots will minimize the severity of this egregious act. They city will probably try to impose a gag order or "no fault" condition on the settlement that will take years to arbitrate. This will further stifle her trying to get on with her life. My heart goes out to her. Until the police organizations begin to fear these kinds of mistakes will cause grave consequences like not only losing their jobs but people going to jail. Then and only then will they stop "white washing" these mistakes. My guess is not one officer that said one kind HEARTFELT" kind word or offer of condolences to her loss. This is just wrong on so many levels, SOMEONE SHOULD HAVE CAUGHT THE MISTAKE ON THEM GOING TO THE WRONG TO THE HOUSE BEFORE THIS HAPPENED. There should be so many precautions just so a family doesn't have to go through this. I also want to point out that this exponentially occurs more often to a person of color. The program directors don't always prioritize the occurrence of this kind of incident OR it's not the lead-in story on the news,thus the general public of not knowing how often this occurs disportionately more to people of color. I only bring this up because this will garner much more press coverage because the victim is white, but the hurt is the same. These kinds of things are occurring more and more rather than less. Until police feel that they will face enormous punishment instead of an"internal investigation of their OWN " this will continue to occur more and more and more!
