In more civilized countries, the insurance must pay to fix/replace whatever damage has been caused, and only after they have paid, if they think that you committed fraud, they can sue you - but they would have to be able to prove that you burned your own house or crashed your car on purpose. When my dad retired he took several of these cases. He loved sticking to these unethical insurance companies. Several insurance companies would immediately pay the settlement as soon as they found out my father was taking a case. He was retired and had IMMENSE amounts of free time and would flat out tell opposing council he's willing to take them all the way to the State Supreme Court just out of principle.
There has to be punitive damages as well as legal fees attached. Why would they pay out a claim when there is no punishment for not doing so? Whoever decided this was going to be the way it is in MI had some interest in doing so that had nothing to do with the well being of the public.
I'm currently fighting with a home rental company attempting to hold my security deposit. This kind of relatively low-level fraud by businesses needs to be found and prosecuted relentlessly. Government by the people for the people needs to serve people, not corporations.
Every state has tenant landlord laws that outlines how deposits work. If the lease says something more extreme than state law the deposit clauses may be void. However, you as a renter should have done a walk-in and walk-out. Taking pictures both times. I've never lost a deposit when I was a young renter. If you damaged stuff, outside of normal wear tare, most leases and laws say you pay. They're required to give you list of damages and charges... If you took time to do proper walk in and walk out, you would not be disputing much.
Did you read the lease? I be you were told.. Pet deposits are always non-refundable. Most state tenant landlord laws don't allow non-refundable deposits.
I had a car (Red '77 Formula Firebird) stolen from in front of my apartment one night. Never could get the police department (Newport News, VA) involved in looking for it and barely got a police report out of it. Insurance company (State Farm) refused at first not to pay for it. Then they undercut the value because of my apartment location. After talking with local JAG (Norfolk, VA), the insurance finally paid the vehicle off. I've never used that insurance again.
$18 million isn't shiii to an insurance company. They happily take your money every month and happily tell you to pound sand when you file a claim on your policy

I owned a home on the top of a steep hillside. When I asked my insurance agent about my home insurance policy, he said if the hillside became unstable and my home was damaged in a landslide I would get nothing- it would be considered an act of god. 30 years without a claim. Then I asked for one, on my home. I got 10 cents on the dollar for the cost of the repairs. My policy included a stipulation that if I need to protest, I was required to pay for mediation at my cost and their choice of arbitrators. I sold the house and their annuity was terminated. Ya they won.
That 2nd part isn't legal btw. They can't force you to use their arbitrators and you can sue them for that. There is plenty of case law for this already and the federal government is VERY close to outright banning it as it should be. I also feel your pain, just shared a similar story of a guy who was with the insurance company for 30+ years, no claim whatsoever, company kicked'em to the curb.

I was in an accident years ago, a young driver hit my vehicle in the side and drove me off the road. The car that caused it bolted. It was an F-150 coming out on the road we were on. I had to hire a lawyer to get my medical expenses paid and State Farm wanted to use after mark parts on a vehicle i was driving home from the dealership.
What is so wrong with after market parts? I don't want the expense for the cost of manufacturer's parts when those are just as good. Wouldn't be able to afford to repair the vehicle with manufacturer's parts.
@@animalantics5898 It had just left the dealership. The insurance from the other driver's insurance was paying for repairs. I didn't want to risk certain panels being covered over by skins. I have no problem with after market parts on anything mechanical, but I want the body on a literally brand new car right and repaired properly a year later I would not have been so upset. It had to be towed. I never got it home that day. 2 weeks in the shop and I got it home
I filed suit pro se when an insurance company refused to pay. When they finally agreed I pointed out that I still wanted to have the trial and it would cost them to pay their own attorney and asked for double. Hours before the trial we agreed to a mere $1000 over what I originally asked for.
I had an insurance nightmare with American Family Insurance last year where a woman hit me from behind. The insurance agency told me they would take 6 months before they would even start looking at reimbursement. They told me I could rent a car but then told me they couldn't tell me how much or how long I could rent it for and also that I'd have to rent it out of pocket for those 6 months. They kept asking for documentation, paperwork, images, and then they kept "losing" all of it and asking me to send it again. I shit you not one day the agent called me and while on the phone with her she claimed she didn't have my phone number. Finally my mechanic actually filed paperwork to sue them because apparently they were playing the same game with him and magically everything was resolved the next day. I have zero sympathy or patience for insurance companies.
I work for a roofing company and I hear every day about how insurance companies are cancelling or threatening to cancel everyone's policies for any reason they can think of. If people don't change around their homes, landscaping, and pay dramatic price increases, they can't get insurance. The entire state is now considered a high risk area, as much because of the high construction and real estate costs as any real risk that may have been assessed.
I had USAA insurance in Texas when my car was totalled. I was not aware that they were obligated to also pay me for sales tax on the value of my car. Years later there was a class action lawsuit and I got $40. I was essentially scammed out of thousands of dollars and they only had to pay me 40. They made off like bandits.
@@charlesslack8090 And to the Courts. I think those cases should have a cap or limit as to attorney fee's and method of expenses they incur. Most of the time they take the expensive paths to organize a class action lawsuit because they know they will get fully reimbursed.
Insurance Companies didn’t Reach their Disgraceful Size by Accident. Companies still in Business Clearly Learned what it takes to Continue Record Profits. 🤪👎
It's disgusting that insurers are not required amortize losses over several years. In Florida they can go 3 years with zero payouts, and rack up record profit. Get one year with a big hurricane and they all complain that they are losing money. They only lost money that year, but still made a huge profit over the last 3. They use that "loss" to justify raising rates.
They also make money in the year of a big hurricane. Where do you think they invest the money collected in premiums? Lumber suppliers, home improvement chains, construction equipment manufacturers, etc. So, the invested money pays out big stock profits, and the insurance companies often have record profit in the years that there are higher numbers of claims.
People are sick of corporate grift. Sick of getting the screws by rich people. Sick of a government out of control, that takes care of people in other countries and ignores Americans. The turnaround is coming.

Insurance is a form of gambling, that has been lobbied into being a mandatory requirement, not only for businesses but also for individuals. Both a casino and an insurance office do nothing but take bets and award payouts. Their only difference is that a casino doesn't force you to take them to court to claim your winnings.

My mom had a boyfriend who owned an old car that wasn't worth anything, stolen and found burned. Police said that was common, they'd steal a car, use it in a crime and then set it on fire.
There should be time limit triggers for settlement of claims - hard and fast deadlines - with escalators for failure to meet the deadline or accuracy of the claims and fines for failing to meet, say, 98% accuracy (time and amount) of the claim, along with suspension of ability to sell in that market. State Farm is famous for this...including the car theft case Steve mentioned. They're horrid. I dumped them.
$18,000,000.00 is nothing to an insurance company, but the insurance company should've paid the full cost of repairs in the first place. Any appeal attempts from the insurance company should be stopped before they get to a judge's desk.

Our prisons have a lot of people who's homes burned down, and couldn't afford a criminal attorney, while simultaneously loosing all their possessions. New Braunfels, Texas tried to do this after my home and business burned down, back in the 80s. Back then, I believe prosecuting victims of home fires was their default starting point. No other investigation was done. When I found the evidence that 3300 sq ft of the 4800 sq ft, was all on one circuit breaker, the city managed to loose the evidence. The person responsible for the bad wiring, turned out to be friends with the fire chief. Be very careful, when moving to tight knit, picture postcard towns. I know someone who to prison for a DWI. She told me how many people were sent to prison, for accidental fire in their homes. In these cases, having insurance, only made their situation worse, Thank you Steve for covering this.
Said it before and I'll say it again, have even said it to my insurance agent " The best insurance you can have is none that way you know what you have covered!" Thankfully I've had two payouts aginst my insurance in the last 50 years, and they were fairly minor ones.
I had to sue the guy who hit my car a few years ago to get USAA to stop low balling me. He did $3500 in damage to my Alfa Romeo, and they offered me $1100 to total it because it was just an old car. They repeatedly flat out lied about the valuation of the car, called dealerships and got trade in values and tried to pass them off as high retail, and used board posts from over ten years ago from someone firesaleing their collection, who as near as I can tell died a couple years later. Through all this I was dealing with cancer as well. I filed in small claims for $4500 and change, and finally they settled for $3500 the day before the court date. I felt really bad suing that guy, but that was the only option. Oh, and the Idaho insurance commission said that was all legal.
I have a major asbestos spill in my house right now and can relate to this. Insurance has delayed everything. Here I am 9 months later and work still has not started on my house. Insurance companies are setup to delay intentionally. I'm not even allowed to talk to someone who can authorize a payment. The adjuster always has to get approval from a manager and it takes weeks anytime there is a difference of opinion or you catch mistakes they made. Then they intentionally make mistakes on your personal property coverage so that it sits in limbo forever.
What an ad read, Steve. I appreciate the thoughtfulness you put into your promotion and making it an honest review. I’m not a buyer but I did listen to the whole ad because it was such a great listen. If I was on the fence about something like this I would have definitely been sold.
The actual reason that insurance companies are cancelling policies in California is that they are limited in their coverage increases. You can predict the ripple effect from there.
@@joshuahudson2170 That is up to the state and essentially what Florida did after Hurricane Andrew. The reason I brought this point forward is that I have a friend who is an insurance guy and I asked him why it is happening. From the P&C crowd, they can just make more money other places.
In Washington State, if you are forced to have to sue the insurance (car or health) company for a claim, then you can get 3x the damages + fess (RCW 48.30.015). Many people in this state have stories of getting their claim denied and when you call up the insurance company and they notice that you are from Washington, the claim mysteriously gets approved right away. I've never had one of my claims rejected.
I wish this was true. Safeco wouldn’t pay our claim when sustained winds of 45mph and wind gust up to 70mph damaged our motorhome. They said it was pre-existing. Washington state Insurance Commissioner was useless. Total bad faith. It was about a $15k claim which wasn’t enough to hire an attorney so they get away with it. Safeco just laughed at us when we asked them to look at the damage. They just decided they weren’t going to pay and that was it.

😮😮I (69f) have had the same insurance company since I was 16. Home, auto, life insurance, disability. I have always been happy with my claims from State Farm. I hear all these horror stories. I don’t why I have good results.
The problem is $100k in damage 4 years ago is more like $1m minimum with inflation, additional living expenses, damages to property that could have been recovered or mitigated at the time, attorney fees and court costs, especially in a drawn out trial. Obviously they're trying to deny the claim without showing cause, so yes, communicating in writing is obviously a problem because it might expose the bias or fraud.
I got hit by a person with State Farm Insurance and they denied that the driver had their insurance. My insurance company had to take them to court. Wish I would have sued them.
My friend who lives in California bought a house and had inspections done and closed. Less than a year later he had water show up in his floor. Turns out a pipe break in the wall. His insurance refused to pay saying it was long term damage. He appealed several times but ended up taking a second to restore the home from the damage of 60k. This is a disabled combat Vet. He didn't deserve this and he didn't sue. This guy helps people that have been screwed over by Ashley Furniture screwing people over who have lost all hope. He has helped over 2900 people for no charge. He started doing this after he got screwed by them and actually getting an email from the CEO that had a virus embedded in the email which he caught. He has recovered millions for people that have received damaged or junk furniture that fell apart in a few months.
Same problem happened to me after hurricane Maria in Puerto Rico. The insurance company offered 8,000. We went to their office and told them that we will spend the whatever time it will take to get what we need. We had all documentation,,, spent the day,,including waited while they went to lunch. They finally settled that afternoon for 65,000
Happened to us, tornado hit our home 2 weeks after we moved in. 1/3 of the roof blew off and my insurance company offered me 1000. The amount of my deductible. They would not fix it. We waited over a month for them to take care of it, then just had it done ourselves for $15,000. We had that insurance company for 25 years no claims on homes, rentals, cars, boats...not anymore.
A friend of mine was an independent insurance adjuster and used to brag about lowballing claims. An insurance company was more likely to hire him, if he came in under the true cost of the claim, on a consistent basis. The adjuster works FOR the insurance company, not you. hire an independent adjuster, if you want to know if you're being lowballed.
I believe that the losing party should always be responsible for the others' attorney fees if bad faith can be shown, either in the principal question of fact or in the execution of the case once filed. This should not be state by state. It should be federal law at the very least... But really, this is just as important as the Seventh Amendment, and ought to be considered a fundamental right. Not only would this help against unsavory insurance adjusters, but it would bring Civil Asset Forfeiture to a screeching halt!
This is now my favorite video. You sound like me when you talk about insurance bad faith. I run into the same thing about how adjusters behave time and again.I even had one testify that the one could not stick a magnetic hide-a-key under a Toyota Camry such that the insured must have lied when he said there was a hide-a-key under the car. The adjuster saw no need to ask the insured to demonstrate on a similar car int he company's parking lot.
Never give up when fighting insurance companies. Katrina gave us a true picture of how insurance companies work….if your house had water damage they said not covered. If your house had wind damage…they said not covered. Wendell pierce, actor met with his father in the father’s destroyed house who would be receiving no insurance money for his destroyed house in spite of paying premiums for years. Wendell dealt with the adjuster as his father couldn’t hear. The father asked him if he would be getting money to rebuild his house. He let the adjuster leave before telling his father that the “insurance” was paying nothing. I saw this on a documentary

There has to be punitive damages as well as legal fees attached. Why would they pay out a claim when there is no punishment for not doing so? Whoever decided this was going to be the way it is in MI had some interest in doing so that had nothing to do with the well being of the public.
I love this. I got a 38% premium increase with 0 increase in coverage. Naturally, I fired them. But this makes my day.
State Farm pulled the "you vandalized your own car" stunt on me. Took almost 2 years to get my money. All over less than $2k in damages
Apparently they pull that crap a lot. With ZERO evidence or proof to support their claim.
I'm currently fighting with a home rental company attempting to hold my security deposit. This kind of relatively low-level fraud by businesses needs to be found and prosecuted relentlessly. Government by the people for the people needs to serve people, not corporations.
Really.. I bet you VOTED a lot.. 💯💯😂😂😂
I got you one better...a community in Ok city actually collects 500 dollars non-refundable...they dont tell you that untill you pay it.

Well if you're the CEO that's your bonus that year 😅😅
Nope, but it punishes everyone else because they'll just increase rates to pay for it🤷

The structure was still there but it blew all the shingles off the roof in the rain came in pretty much drench the entire house. I owned a home on the top of a steep hillside. When I asked my insurance agent about my home insurance policy, he said if the hillside became unstable and my home was damaged in a landslide I would get nothing- it would be considered an act of god. He then laughed and told me to set the house on fire if it started slipping down the hillside. That would be the only way my insurers would pay me. He also told me that our conversation never happened. 😮
Every singe homeowners insurance claim (where covered damage is present) is underpaid. This is systemic.
It was really nice to hear you took on those cases. What they did to that elderly couple is abhorrent.

My parked truck got hit by a drunk driver. It ended up costing me over $10,000 because the insurance refused to make me whole again. I was also 21 and didn't have the wherewithal to get a lawyer
The insurance company will spend 18 billion dollars in legal fees to not pay.🙄
Legal fees are deductible as a business expense. So they don't care.
I’ve had issues with Insurance companies (health, car, and homeowners) a half dozen times over the years. Reported all of them to our state division of insurance, and like magic they all paid. But they always claim they’ve done no wrong and are paying out of the goodness I’m their tiny hearts.
So… when I have conversations with people and they say they work in the insurance industry, I tell them in no uncertain terms how I feel about their character and life choices. Scumbags…

Also, this was dragged out so EVERYTHING had become so much more expensive. I’m happy for these sisters.
This is the very definition of the word oxymoron: Honest, ethical insurance company
Yes, sales tax and pro-rated registration fees that were paid for that year. It's all part of "replacement value".
CLASS ACTION monies go to the lawyers.

Steve, there are still good sane sober moral prudent people in this world, and you Sir, are one of them.
