EXPLAINED: Man City and Premier League BOTH claim victory in legal case over commercial deals
The verdict: "The Tribunal ruled that there was an unreasonable delay in the Premier League’s fair market value assessment of two of City's sponsorship transactions, and so the Premier League breached its own rules."
People are acting like City's money is what's won them this case, but it's not like the PL doesn't have its own army of highly-paid lawyers. If you actually read the statements that have been put out it's pretty clear the PL have failed to instate rules that are lawful under the requirements of UK competition law. They are in the wrong here.
Shhhh you're not supposed to make sense and be reasonable on the internet, people have agendas to push
Makes you think what will happen about city not cooperating with the premier league over the 115 . Not just unreasonable delay city with held info
@@gingermanc98that's the problem we have in this internet generation. More bait and engagement than truth and honesty
@@randyvalantino6850 May be interesting, though I'm unsure if the tribunal/court settings are the same for that case.
Additionally, with the ruling of this case, as well the PL's prior failings to keep what should be private financial info away from the public eye, City may be able to argue that their noncooperation with the PL in such a matter is justifiable.
I'm not certain this case will have much impact on the FFP charges case in general.
@@thekeccles1996 Still for city to say the premier league took time over sponsorship deals but for them not to cooperate at all when it comes to financial information is double standards, all the other clubs cooperated . I dont blame the league giving them there own medicine . Would you rush for someone with holding information you asked for .
What is interesting is the blatant oversight of the issue of shareholder loans. It appears that half the league are indebted to their shareholders after flooding money into the club via 'loan' (*cough Arsenal 200mil shareholder 'loan'). Everyone is breaching or bending the rules!
Arsenals shareholder loan is refinanced stadium debt. It wouldn't even count towards PSR rules anyway because it's classified as infrastructure spending so it's excluded.
Somehow you find a way to bring up Arsenal, when the real cheaters have been UTD for the 2000s and City in the last decade.
@jagsingh9303 yet here you are talking about United 😅 if you knew absolutely anything about football you would know we're not better off for being in debt, luckily we're the biggest club in the world so we make good money and that why we can spend.. and we actually own our stadium.

PL didn’t care less when Mike Ashley paid £0 for sports direct all over the stadium.. where was the fair market value then 🤷🏼♂️
That's the other way around, no benefit to Newcastle
Sports Direct was not an inflated sponsorship to funnel in money, it in fact was fair market value unlike them Arab companies with no workers lmao
Thank you for recognizing that this all started to purely squash Newcastle
How can the PL claim victory after being found to have acted unlawfully? Laughable
Because there were different aspects of it.
it says why in the article. If you actually read past the headlines, it's a major win for the premier league
@@ITSPROLLYAKBARI lol. It's not a win for the EPL!
@@ITSPROLLYAKBARI give us a brief explaination then. And is this a neutral 'article'?
🎉Surprising? Every 1 expected this. 😅 EPL have no balls like la liga.
It's hilarious how rivals are so desperate for City to get punished that they aren't willing to understand and make their research well on the supposed charges..They just want City out of the way so they could win something 😂
Exactly, they love to say city have cheated but when it turns out the prem have been making rules that go against competitive laws the fans back it, FFP and APT were put in place to "make the leagues competitive" note that clubs like man U have used Assosiated party transactions AIG in the past and all three of the red cartel have benefited hugely from outside investment spending more then anyone else so to have the opinion that the league was fair and competitive befor FFP is a joke and to say that FFP wasn't targeting City is delusional.
I’m sure they’re innocent of all charges just like Diddy
@@ToTheMaxGaming1 1/3 of them are for not cooperating so not all of them but you can't say we are guilty of them, don't forget this all came about because of hacked emails
Most rivals of Man City have confirmation bias that makes them believe they're definitely guilty without actually knowing that. Most supporters of Man City have confirmation bias that makes them believe they're definitely innocent without actually knowing that. I'm sure the OP wouldn't disagree with either of those statements
If city were 14th and had their worst start for years no one would care but seeing they are the greatest team in the world (well maybe 2nd) of course all the other clubs care....Oh and hahahahaha.
So they changed the rules because Newcastle got took over and they were scared? So they then changed the rules to benefit the red cartel?? This has opened up way more than the Premier League would’ve wanted.
The corruption is absolutely insane. Bringing in rules purely to stop a club spending money that they literally have. At the same time Chelsea spending over a billion absolutely no questions asked
This has been going on for years. I'm glad the 💩 has hit the fan
Would of been easier to just accept the inevitability of Newcastle 😂
Instead they've created a hell of a problem. I mean what do they expect to happen Newcastle was ran on a shoe string budget by businessman Mike Ashley. So the club was in a pretty good financial position even if Ashley lacked total ambition.
Anyway they changed the rules and hit some unsuspecting clubs. And to be honest I'm coming round to just breaching the rules. So they dock us points one season so what then we've got a mint team for at least the next 5 seasons. They are hampering our progress anywhich way, so let's just get it out the way and crack on.
PL have to claim victory because if they don't, then when they go home, the tea that Liverpool made them will be purposefully cold, Arsenal will be sat with the TV remote clutched underneath folded arms, and Manchester United will have them sleeping on the sofa tonight.
Man City and Pep are some of the most corrupt entities in football.
crying about clubs that have grown and gained success over decades.... bit odd.

Everton must really be thankful to those commercial deals or else they might have been given a 20 point deduction had City been found guilty
There was no way the Premiere league was going to win given the ripple effect a Premiere league win would have. The money that would leave the league and go elsewhere is unimaginable !
Where would the money go? Other European leagues are more strict with their rules. Only place for it to go would be the Saudi Pro League (ironically)

Kaveh's face on the thumbnail essentially means "we have nothing new to say"
Short of the long.
City failed to get anything changed apart from getting an agreement that Shareholder loans will also be included with APT calculations.
The hearing disagreed with City that APT should be scrapped and they disagreed with City that the Premier League refusing their bloated sponsorship deals was the wrong outcome.
Well done City. Big win! 😂
This ruling basically stops Arsenal and other teams from putting money into their clubs from loans and effectively stopping them from catching up with City financially!
Basically, they have a win over their rivals through a back door.
do u want some chips with that salt😂
@@simonspokeno it doesn’t. At all. Arsenal owners just say, here’s 200 million, as an interest free loan. To keep the repayments down for the sake of APT, the term of the loan is 999 years.
@simonspoke
No
They only have to put those loans on a commercial footing - and charge a standard market rate of interest on those loans.
Currently that would cost about £8-10m per year.
In short this opens the door for city to use the shareholder loan to find a flaw against the prosecution (PL) re the 115 charges. How many of the 115 charges will be admissible is now questionable. It’s not what you know it’s what you can prove. As an Arsenal fan I have no issue with what City have done over the last few years, they’ve had to, to be competitive. Fans don’t care how the incomes generated so long the clubs are kept competitive and City have been trying to catch up with the rest since 2010 and they’ve done a bloody good job of it.

You're confused over city's statement, the only big thing city won on was their 2 sponsorships got set aside... SET ASIDE. not granted lol city will still have to reapply under the same apt rules until the changes take effect n even then all it means is they'll get access to the info faster as to why it's rejected. The panel agreed with the reasoning as to why it was declined but not the time it took. Lol loss for city, bigger loss for Everton due to the loans they have.

City said when they started this process, if successful, they will sue the Premier League for damages. Given the PL’s attitude to the ruling, City should now sue the PL, as they continue to believe they are above the law
Overall the premier league won lol the apt rules are lawful for the most part. Just 2 annex that one of which doesn't involve city at all it's about shareholder loans, the second part is just about sharing info. No big win for city, the rules still exist, and they don't get their inflated sponsorships if anything the rules are just stronger now. That’s not correct. It wasn’t fair market value. It was what the prem, and the septic 6 thought they were. Not fair at all. Everyone knew this.
Let's not pretend we all know didn't know Premier league won't do anything to them.. They damn well know City is their heavy hitter in Europe, they know they're the face of prem.. They're prem's cash cow, biggest revenue generators..They couldn't even punish them even if they wanted to 😂

@jagsingh9303 know the rules before commenting. Infrastructure IS very much a Part of expenditure and revenue
Can't retroactively charge clubs for new rules introduced today
So which division do they play in next season.
So in short , APT Rules WILL STAY (with new amendments to follow), However, City will be cleared of the serious ones from 115 Charges as APT deemed unlawful in the current state! Huge Victory for City...I don't think the premier league should embarrass themselves anymore by claiming victory here when City have undermined the whole thing. City found a legal loophole. but we all know the truth
Seriously confused (as commented above). You seem pretty sure of the outcome so I ask, the court ruled that self funded sponsorship outside of market value is not allowed but PL rules need changing to include shareholder loans, which they will be now. So there doesn't seem to be any change to the rules that City broke or the one they wanted changing and in fact tighter restrictions are being brought in. From your side what but do you think city are happy with other than potential PR opportunity to say there was a mistake in the PL PSR rules that weve managed to get changed? Clubs like Everton who have the biggest shareholder loan deals may be a bit gutted with the outcome especially as they backed City to take the PL to court 😂
@@StonyK_ youll see
@@richardf766Does that mean you don't know either? I've since seen their argument is that because one bit is wrong (shareholder loans) then all rules are therefore null and void. Perhaps that's where they are going with it? Sound like the whole PL is in a mess with majority of clubs sticking within rules that potentially aren't enforceable with a few clubs ignoring them anyway. Luckily my football is non league where football and beer is allowed and there's none of this state owned sport fighting for the good of man 😂
City are victorious
Pfft wont be saying that in a few months
Can we just get back to the football please?
The actual outcome is for sure a net positive for the premier league and not Man City. The APT system stays the same with changes in the speed at which an APT decision is made (the court ruled the process took too long) and that clubs will have some access to the databank that the premier league uses to judge if the deals are of fair market value. Also shareholder loans are now accounted for in PSR decisions.
So they are not saying that the apt rules are wrong, but that they should include loans? Fair enough. Not a massive win for City, though, is it? A loss for those with interest free loans, but it’s only fair in a way that that are included.
I mean, it shows there's a vendetta against City from clubs that have hundreds of millions in loans between them and their owners, yet they have used this as deflection (blaming City) while its obvious City's owner don't want to use his club to make his bank account bigger like rivals club, in fact almost every revenue won at the pitch has been used to transform the City of Manchester plus thousands of jobs, but rivals hate that reality. Its also important to mention the League did nothing for decades while United, Liverpool and friends broke spending records after spending records and only cared about this when another club challenged them at the pitch.
@@ILoveManCity. you know the difference between the city spending and United/lfc. Pretending oil state money and self generated money is the same isn’t gonna work. City now is generating money, but got there by state sponsorship.
The APT on sponsorship and loans I agree. Either they both need to be at market value, or neither. With the principle of PSR and FFP, it should be both.
These things were only set in place in later years because clubs only really started doing this with Blackburn in the 90’s, but limited. Then Chelsea started looking limitless, and obviously with Abu Dhabi and the Saudi, it got limitless.
These actors shouldn’t be in the PL.
I’m all for a separate super league with new clubs where the oil states can do their thing, and leave the national leagues and European competitions as they are. I’m happy the Qataris didn’t get in as well.
What is the point with and English competition between Abu Dhabi, Saudi Arabia and Qatar?

For fair market value if you want a linked business sponsoring your club they should only be able to match a credible offer from another business. Sport first business second. Sport has rules for fair competition
Powerful people in this world always have the final say.
Will be interesting to see if City now seeks damages from the Premier League for illegally blocking 2 sponsorship deals.

Because this video is bias by just covering the Premier League's statement, here is Man City's statement:
""Man City:
Following today's publication of the Rule X Arbitral Tribunal Award, Manchester City Football Club thanks the distinguished members of the Arbitral Tribunal for their work and considerations and welcomes their findings:
The club has succeeded with its claim: the Associated Party Transaction (APT) rules have been found to be unlawful and the Premier League's decisions on two specific MCFC sponsorship transactions have been set aside
The tribunal found that both the original APT rules and the current, (amended) APT Rules violate UK competition law and violate the requirements of procedural fairness.
The Premier League was found to have abused its dominant position.
The tribunal has determined both that the rules are structurally unfair and that the Premier League was specifically unfair in how it applied those rules to the club in practice.
The rules were found to be discriminatory in how they operate, because they deliberately excluded shareholder loans.
As well as these general findings on legality, the tribunal has set aside specific decisions of the Premier League to restate the fair market value of two transactions entered into by the club.
The tribunal held that the Premier League had reached the decisions in a procedurally unfair manner.
The tribunal also ruled that there was an unreasonable delay in the Premier League's fair market value assessment of two of the club's sponsorship transactions, and so the Premier League breached its own rules."
