Yeah she more than likely is liar. She probably wanted a roommate or needed the money but didn’t like dealing with the person so she lied to the cops because she knew they wouldn’t kick him out if she told the truth. She’s a Craigslist scammer. If he “forced” his way in, then why not call the Police that very moment. On top of that, he already gave her rent money. So she keeps a portion of it, but “pay” him off to move out.

Have to be careful for sure but met some of the best roommates I've ever had off Craigslist so can't say it's 100% shady.
I've rented rooms in my house to 3 different people from Craigslist for years. The key is to screen very well, write a lease that only benefits you, and most importantly hang out w them before allowing them to move in.

I felt so bad for that old man especially at the end when he was swishing around his mouth, that was a clear sign that he was telling the truth and that he couldnt believe this was happening to him. Poor old fellow. God is on your side.

She not being honest. Why wouldn't she have called the police the very minute the guy arrived. You don't just wait a few days then call the police. That police officer did a terrible job of questioning her.
why would she pay? why would she be willing to pay him $600, if the police were there about to enforce him leaving. I believe he has payed the 1800 and she is chuffed with paying $600 because she made a $1200 profit.
Like he said, it's a civil dispute and they can't do anything. The only reason they would get involved is if he did force his way in like she claimed.

Police officers don't deal with civil disputes. He's not really questioning anyone he's trying to find an immediate solution for that night as quickly as possible. It's not his job to deal with landlord and tenant disputes like this.

Actually it is enforcing the law, just the sucky side of the law. They can't prove where money came or went, so of course they can't help with the money tonight. They're also police officers, not judges in small claims court. The law says for amounts under x you go through small claims court to reclaim the money. Whether that's worth it or not probably depends more on your pride rather than actual monetary gain.

Yeah, he can get to small claim and get the full $1800 back. No need for a lawyer. With the craigslist ad, the testimony of the pastor and the fact that it took her 4 days to call the police after he "forced" his way in he has well enough to meet his burden of proof (which is "preponderance of evidence").
The cop saying that somebody's gonna get cheated and that he has to hire a lawyer was terrible.

Not really if he is a particularly difficult tenant its not uncommon for landlords to wave owed rent just to get rid of them to avoid the inconvenience, she might just be in such a delicate state that she will take the financial hit just to get rid of him. I live in a country where you have to have tenancy agreement in writing so the whole situation for both parties looks sketchy in my opinion.

@@alexanderpaterson9333 Exactly what I thought. She knows if he stays longer than three days she pretty much invited him to stay thus need to go through an eviction process. Both seem sketchy, who pays without receipts and or without a tenant agreement. If he indeed paid, he wouldn't just leave with a partial refund. She's omitting truth but I believe he is as well.

If I was the officer I would investigate and throw that scammer on jail. The world is full of people like her, and this kind of abuse aren’t being treated as serious as other crimes.
This is why you never do cash in hand for this stuff, unless you get them to sign something saying they received x amount from you on this date

Unfortunately this is something that happens to people who rent rooms in another person's home. They are often desperate for a place to live and agree to rental costs without a lease agreement or contract. The home owner will lie about the money they received and try to illegally evict a person through intimidation. Always get a rental agreement and proof of payments. Take pictures of the room/property before you move in. Put a newspaper with the date on it that corresponds with the day you move in for proof of the date of the pictures. Just do your best to stay safe and rent from a proper landlord.
So sad. She just stole from an old man and probably the church. There were questions to be asked, people to call, like the pastor and his wife who could probably show a withdrawal for the amount or something, but the guy was scared and intimidated.
That cop did a horrible job! I feel so bad for this man💔😣 I pray he’s in a good situation now.

Not sure how the laws work in Florida, but in New York where I live, landlord-tenant relationships are NOT purely a civil matter. If you evict someone in a residential unit without a court order, it is criminal.

Im in law 400 right now and one thing I'm learning is always have a contract, written would be best verbal is extremely hard to prove in a civil court. Also I hate college, but certain things are paying off.
If you need law 400 to tell you to always have a contract and paper trail I question if you should be taking those classes

No such thing as a verbal contract with regard to real estate, be it rental or purchase. When it comes to rental contract, it must be in writing, period.
If you let someone live 30 days consecutively in your home, you cannot kick them out without evicting through a court ordered eviction/detainer.
Look up Uniform Landlord Tenant Act for the above and more.

The problem that I've come to realize when Police are involved in landlord/tenant disputes , is the police will try to intimidate the tenant into leaving the residence (technically taking the landlord's side) so that they (Police) don't have to come back to that residence to deal with the same issue. The tenant is obviously financially strapped if they're just renting (A Room) to begin with. Many States favor the tenant in Court, which is proof that police simply side with landlord due to there inability to deescalate situations. Landlord/tenant is civil, not criminal, therefore the police have no jurisdiction nor authority to have anyone leave the residence for any reason. They can only suggest/recommend..
The police man needs to stop giving legal advice.

Andrew Gabriel The context of the post wasn’t that hard to figure out. Take a couple seconds to turn on your critical thinking and the post is fine. The guy has rights as a tenant and the cop was telling him to give those up. If he paid to stay there then she has to go through an eviction process to get him out.
