    I already pointed out the birthright citizenship was being abused and needs to be carefully revised. By forcing this issue to end up in the courts, it will come out with logical limitations which make good sense!!

      I tell people you see this down in South Florida big time . They call them Anchor babies . I worked at a shelter in Miami and this is a known think for the women to have babies because they will stay . So they target American men . It’s Fraud no-matter how we want to paint it .

      @@VirgilHathaway-zj3xq You are manufacturing nuance where none exists. Explain the nuance in the words "All persons born" that extends their meaning to include the parents of said persons. The 14th is intentional in its silence on parentage. It operates only on the "persons born or naturalized" without regard to any other persons. It was kind of the point. Every argument that starts with the status of parents is invalid in its face. Even the example of children born of diplomats has nothing to do with parental lineage. They cannot become citizens because they, on their own, as individuals, are not subject to the jurisdiction of the US by operation of treaty. It has nothing to do with any imaginary constructs around parental lineage.

      @@VirgilHathaway-zj3xq I guess if the constitution said those words as you typed them you would be right. However, it doesn't, and you aren't. "A well regulated Militia, being necessary to the security of a free State..." In so far as there are no specifics defining the words "well regulated" or specifically attaching the implied membership in that militia to the right defined, the second amendment has nuance that is entirely absent in the clear and plain language of the 14th. "All persons born", and "subject to the jurisdiction thereof" are clear and unambiguous terms. You have to use your imagination to arrive at an interpretation that removes a right from a child by virtue of their parentage. The children being born are individuals. Their parents don't exist in the 14th amendment, or in this conversation.

    Not only do their children becomes Citizen's, in which the Mother automatically Becomes a Citizen. Then they can bring the rest of the Family. Like their Uncles, Aunts, Cousin's, Grand Parents. Which becomes a Large Chain of Relatives who becoming Citizen's also.

    We have the same issue here in Canada, birth tourism taking toll on our healthcare system. I read an article the local mom had to drive almost an hour away to get to a different hospital since there were so many Chinese women giving birth in Richmond, BC where she lives!

    Legal immigrants spend years and lots of money to come to the USA. In addition, stringent financial documentation, police records are reviewed as well.

    If an American couple was visiting Italy, and the wife being pregnant gave birth while on vacation there, their child does not automatically become an Italian Citizen. The child becomes a Citizen of the Country of origin of it's parents. Citizenship in another Country must be applied for and granted only upon completion of the terms and conditions required. The 14th Amendment does not apply to children born of illegal immigrants because they are not subject to the jurisdiction thereof. As an illegal migrant, you have no expectation of rights or liberties that are only afforded to US Citizens.
    There is no such thing as Birth Right Citizenship for undocumented persons in the Constitution.

      On June 16, 1866, the House Joint Resolution proposing the 14th Amendment to the Constitution was submitted to the states. On July 28, 1868, the 14th amendment was declared, in a certificate of the Secretary of State, ratified by the necessary 28 of the 37 States, and became part of the supreme law of the land.

      Very plainly it says, All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
      Doesn't mention parents, slaves, illegals, or anything it literally just says all persons born here. You cannot get clearer than this. This is the constitution of the United States of America, if you don't like it then there are ways to amend the constitution. You need a proposed amendment to be passed by two-thirds of both houses of Congress, then ratified by the legislatures of three-fourths of the states.

      Birthright was intended for the freed slaves and their children following the end of the Civil War, but like so many laws that judges and lawyers start interpreting true meanings get twisted and abused. It will soon be back in the courts and I expect the main point to debate is no matter how you look at it it was never intended to be used by anyone in the USA illegally as they are undeniably criminals.

I'd even dare to say that it's common sense that anyone born on a country's land is automatically a citizen! After the baby is born, the family can go back to their native country. Once the child is of age, they have every right to go to their birth country and exercise their rights!

    "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." The 14th amendment was implemented for the protection of freed slaves, not visitors who had anchor babies.
    The Civil Rights Act of 1866 declared: "... all persons born in the United States, and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States."
    You can't illegally come here as a citizen of another country and have a baby who's automatically a citizen. Period.

    I have always argued that, two people who are not citizens of the U.S. and having a child on U.S. soil does not make the child a citizen. Many people do so on purpose for all the benefits of this country. Look at that guy bragging on the internet, that that best thing was having a baby here, and all the monetary benefits of living off of his child's benefits, that father was laughing his ass off on social media at how stupid U.S. laws are.

      you do not understand what Birthright citizenship is or why the 14th amendment was adopted. birthright citizenship has NOTHING to do with my families history. the 14th amendment was solely directed at freed slaves. making everyone who was born here a citizen. it got bastardized much later and we will be paying the price for that until the end of time. it needs to be stopped now

      Yes, the full thing. Not just the "born here" part, but also the "under the jurisdiction" part. It is a condition of citizenship often overlooked.

      This part “subject to the jurisdiction thereof” is conveniently ignored and this is what the Supreme Court has to resolve and make it clear that children born here of illegal parents or those on tourist visas should not be entitled to birthright citizenship.

    Birthright by Soil vs Birthright by Blood. In the case of an illegal the child would instantly become a dual citizen, one of origin of the parents and one of the soil they birthed. Birth tourism is the process of creating an anchor baby who will eventually sponsor other family members to immigrate. But how do you expel the non-citizen parents if the child has a birthright of soil.

    I don't understand the issue.
    Here in So Cal, many years ago, there were many Chinese birthing houses. California actually went after these parents and shut down many of these birthing houses. No one complained like they are doing today. Where I live, you would always see pregnant Chinese women walking from apartments to the shopping areas. Today, you hardly see any.

    No non-US pregnant person should be allowed into the US until the law is changed to say that giving birth in the united states by an alien citizen does not automatically confer citizenship on the offspring..

      No, the problem here is this is another aspect of the Constitution that our resident Communists willfully abuse. Its going to court. We will see what happens there. The 14th amendment was never intended to be a rubber stamp for party crashers.

    Let's look at what is really happening here, I will say it right here; Anchor baby is a term (regarded by some as a pejorative used to refer to a child born to non-citizen parents in a country that has birthright citizenship which will therefore help the parents and other family members gain legal residency or avoid deportation. In the U.S., the term is generally used as a derogatory reference to the supposed role of the child, who automatically qualifies as an American citizen under jus soli and the rights guaranteed in the Fourteenth Amendment to the U.S. Constitution. Do they not know they are abusing that 14th amendment, they come here illegally get themselves pregnant to have that anchor baby, they are not doing it just to have a child they are doing it for what is said above. Then you also have the ones who are already pregnant coming over the border illegally and then having that child on US soil as an anchor to get to stay here. Even if these judges know this they do not care and that is because of the 14th amendment, no matter if you're abusing the system if it's in the constitution it is set in stone no matter what.

      The Constitution doesn't need to be changed, it needs to be enforced.
      If an American couple was visiting Italy, and the wife being pregnant gave birth while on vacation there, their child does not automatically become an Italian Citizen. The child becomes a Citizen of the Country of origin of it's parents. Citizenship in another Country must be applied for and granted only upon completion of the terms and conditions required. The 14th Amendment does not apply to children born of illegal immigrants because they are not subject to the jurisdiction thereof. As an illegal migrant, you have no expectation of rights or liberties that are only afforded to US Citizens.
      There is no such thing as Birth Right Citizenship for undocumented persons in the Constitution.

      There are many ways to be in our Country legally without Citizenship. For instance:
      A Green Card for employment, a Visa to attend Educational Institutions, a Visa for Travel and Vacation, a Visa to start a Company etc...
      All of which can be a starting point to Naturalization through the proper channels.
