  • The ASA rules for ads and advertising content when you're a RUclipsr are a bit murky sometimes, but I did my best. And no, I don't fancy an influencer box, though I'm sure it's a very kind offer.

    As an American, I am _not_ bound by the ASA, but I still think those guidelines are just generally a good thing. A transparent "I am trying to sell you a thing now" tag can only be positive.

      I think the FTC's guidance is similar, but I'm pretty sure we can get away with simply stating when we received an item for free.

      @@JamesTM There are. Basically you have to disclose when you are being paid to advertise. You also have to disclose if you are given, given a discount, or paid to use a product. Hence the reason why a lot of RUclipsrs clarify that they bought an item with their own money or state otherwise. Much of it is overlap from TV and radio advertising regulations but the FTC is responsible for the bulk of the regulations. There are guides that explain the topic in detail, RUclips provides a comprehensive guide for creators.

      @@PetrolJunkie FTC regulations regarding RUclips and other internet social media are actually far more strict than those regarding broadcast media, where a company can outright pay "news" to cover their product without ever stating it is an ad. I can't remember who covered it a couple years ago (Tom Scott maybe?) and my google fu is rather weak tonight.

      Why are they a "good thing?" Are you stating that you are incapable of making your own purchasing decisions? Do you, superciliously, believe others aren't? Unpack the entire idea of such nanny-state regulations, they have nothing to do with objectively rational safety concerns, but are presumptively intellectually insulting. We aren't children, we do not need "minding" by governmental drones and incompetents.

    Thank you for the clarity and honesty regarding ads, Ms. Bearup.
    I want my creators to be compensated for their effort and for the attention they share with others for pay. Profits must be shared with those who make those profits possible.

    I am glad that you made this decision. There's nothing worse than a well-spoken informative channel airing an ad for product that is slightly topically adjacent and of questionable quality or company.

      Yes. I actually pay for RUclips premium to watch videos without ads and to more directly pay the channels "directly" with my money since I can't afford patreon. A brand or product insert makes me feel cheated in my efforts.
      And as a person with little money I extremely dislike channels that are not content with their advertising-via-RUclips-money but want more money by wasting my precious time with brand inserts. I usually unsubscribe or jump across the ad. SciShow and Veritasium are exceptions that come to my mind. But Veritasium is borderline for me.
      My personal opinion: if you need ad inserts to finance your exclusive content - be less exclusive. I dislike the concept of continuous growth. You don't need to continue to grow. But that's just me.
      Edit: Charity is another thing but I expect the channel inserting ads to donate to good causes to be extremely transparent with what they do and why they do it.

    Say it louder! Also, they're giving you like $150 in stuff and that was written off on their side at a lot lower rate than the $150. Plus, content is basically eternal. So they're paying even less in the long run.

      Heck, if I had something I wanted her to advertise, paying the reasonable 3k for a 3 second advert might well be worth the money. It'd be memorable, if nothing else for the novelty at least.

    I have started seeing a lot more creators doing the merch plugs in exactly the same way the do sponsorship. Right down to saying "this video is sponsored by my merch". I guess this is why

    I really enjoyed this, because I'm always very impressed by entertainment workers who are willing to say "this is my job, pay me." Entertainment work in particular is vulnerable to the fact the most of the workers really enjoy doing the work and will often do the same thing just for fun, which means it's much less common to find one that's willing to say "no, pay me," than it is to find, say, a cabinet maker. (Although even there it can happen; my dad used to build houses and he had to get out of the company because his partner really liked just building things so the partner kept doing lots of extra work for free and the company was hemoraging funds.)
    Anyway, my point is that it's very satisfying to listen to a creative worker firmly and confidently say "no, *pay* me," because it helps shift the conversation towards recognising that creative work is *work*.

    As an extra point (very much not an expert) I always assumed that the value of payment in products still have to be declared for tax etc.

    You know, I recently realized that here in NZ, the national 6 o'clock news does advertizing for the tourism industry - it isn't framed as advertizing, but it absolutely is. They do a 'story' every time the skii season opens for gods' sakes! So, ironically, decades of increasing scruitiny of online content as to what qualifies as advertising and making that crystal clear to the average user is probably one of the more ethical trends of our shadowy overlords, confusing and exacting as it may be at first glance.

    Greatly appreciate the amount of transparancy and, even if it isn't legal advice, the detail you went into.
    On another Note. Never thought about hiring a RUclipsr to read your book and promote it. Though the rate for it was, just as when giving cautious pokes to artist I know for Illustrations and or covers, way beyond what I was expecting. But not unreasonably so.

    Complying with the Al Gore Rhtyhm here. Also with your implied command, but for different reasons.
    Your rates are reasonable and your reasons for them are entirely reasonable. Your disclosure of them and explanation of why you felt it necessary to share them, as well as your selection process, while possibly seeming a bit scattered is also entirely reasonable. Sometimes, in fact IMO a lot of the time these days, there just isn’t a simple straightforward way to say such things.
    Maybe it’s just that your style of exposition dovetails nicely with my ADHD, but I appreciate you covering so much legal and ethical ground with real and hypothetical examples so… what’s the opposite of “concisely”?
    Oh, and I’m particularly fond of emmenthaler.

    So interesting to see a behind the scenes, not many channels do that and it's so comforting to see how another layperson interprets that legal stuff. Be it taxes of advertisement rules, it is so easy to get the impression that this is super easy and understandable for everybody else and that you are the only one wondering if your interpretation of that paragraph is good enough not to get you in trouble.

    I appreciate the transparency. I think that the reason that Instagram and the like are so heavily featured is because there was a whole thing where celebrities got free stuff from brands and posted about it without ever disclosing that it was free.

    I'd love to see a video from you about when you decided you needed an agent, why, how you got one, and what the general rules of such things are. I'm an indie author, but have nowhere near the level of success to need such a thing. Nor the level required to request to purchase a spot from you...I'll add that to the list of goals.

    6:48 I’m reminded of a story I heard about the Mozart family: They were all very talented musicians and were beloved by the noble families of Europe; *but* said noble families often gave the Mozart family gifts rather than paying them, so the Mozarts often struggled to get enough money to eat *while* being surrounded by beautiful and expensive gifts that they dare not sell for fear of insulting their noble patrons.

    So thankful for you stating an actual rate! hope it goes around the youtube world as a known baseline so more people have more data by which to negotiate with would be advertising partners.
    This does remind me of Tom Scott's "RUclipsrs have to declare ads. Why doesn't anyone else?" though, which is just a nice reminder of wow, nigh EVERYTHING in the modern world is marked by consumerism and capital

    That's interesting. And complicated. Presumably the rules in USA are quite different as many creators seem to make whole videos out of product placement but only mark the 'sponsor thanks' section as the ad, or just say they've been sent a box of dresses and then the video is styling the dresses.

    Jill you absolutely have it correct. It's much much cheaper for a company just to send a box they say is worth x amount of dollars (which actually cost them much less to make) then to pay for an ad read. Unfortunately a lot of youtubers don't know how much an ad read is actually worth and unboxing videos are easy views. A lot of these box services just buy a bunch of cheap junk from a wholesale retailer and then put it in a box with some custom art and then sell it at a huge mark up.
    What's really scary is that mobile games have no problem throwing giant piles of money for an add read. A few youtubers have revealed that Raid Shadow Legends will pay a moderate sized channel 4-10k USD for a sponsorship deal. That's a lot of money when it's just you or a couple of people.
    Web services like VPNs and domain host also throw out a lot of money as they have basically no operating cost. So they can throw out giant piles of money which pretty much always generates more money then was spent on advertising.
    Established Titles was throwing out giant piles of money. They also had basically no operating cost so they could throw money at pretty much everyone and still make a profit.

    I never really thought about why “Influencers “ are.
    In my ignorance I just assumed it was an ego thing , backed up by desire to feel liked, listened to or important.
    Now, I’ve started thinking about it, and you are responsible. Well done and thank you, for your time and effort (and of course, your excellent content!)

    Re Nemo: when I was a kid we had a cat that would bring home frozen chicken portions - we finally worked out she was camping out on a neighbour's windowsill waiting for their chest freezer to be opened then rushing in and stealing one. We had another (more recently) that would steal Koi Carp but we never found out whose pond they belonged in ...

    Lawyers brains are like bags of cats (not an endorement of placing cats in bags, just an illustration). I don't see a problem with taking sponsors or free merch to feature on your channel, after all you need to make a living. I will still support you by watching and, once I can afford it, buying that Just Stab Me Now shirt which I dying to wear. 🙂

    It took me three minutes to realize (through direct statement) that "infuencer box" was not:
    A somewhat nice seat at a sporting event
    A section of a web page where your channel etc. would be promoted.
    A section in produced media other than a web page where your channel etc. would be promoted.
    Why is "we'll give you a physical embodiment of a loot box for free" even thought of as a marketing strategy?

    "I'm moving house" is an excellent reason not to accept a free box of anything, unless the box itself is excellent for moving your stuff. I like recycle box piles behind liquor stores as a source, since their boxes are relatively small but made for heavy contents.

    Tabby cats with white undercarriage can be quite decorative. I used to have one. She chewed a power cord while I was away for most of a day, as far as I could tell, and I’m pretty sure that that’s what killed her.
    She was orange. Orange cats tend to be insane though.
