The issue is that countermeasures, which the seized funds are, must be reversible when the country they are being applied against again meet their international obligations. This complicates just handing the funds over to Ukraine. Although doesn't make it insurmountable. Especially given that reparations are part of meeting their international obligations.

Also in there is any international securities acquired in Russia through Russian brokers and cleared through international clearing systems such as Euroclear. From the European end they look like Russian state assets because they are held in those clearing systems by the National Securities Dealer (a Russian Central Bank entity). But behind that in Russia are ordinary private investors that just happen to have invested in the international markets from the Russian end. Pointless discussing legal precedents without acknowledging that. This is a non partisan technical observation.
