      @@c.2538 yes! Brandon sued Garret Smith for defamation. He got on national news and said Brandon was gay. Brandon filed a lawsuit immediately! Garret Smith settled out of court for 12 million!

    why the need to have his attorney there in the first place? makes the pawlowskis look guilty in knowing more than what they testified to in Chad's trial. It makes me to believe they are more involved than i originally thought.

    After hearing the content of the text message Chad sent Tammy describing the large "raccoon" he had shot, was burning along with limbs and yard debris, and which he buried in their "pet cemetery"....
    Other than Tylee's remains found there, were raccoon remains found in the pet cemetery as well ?

      He used that as an excuse in case Tammy noticed him burning remains of something previously alive (a helpless child). Tammy must not have cared much for raccoons, so he knew she wouldn’t press the issue.

      @@XjtBA Garrett Smith is the Cox family attorney for some reason and in divorce papers Melanie encouraged Garrett to claim that Brandon was gay and just other things which were untrue and he got sued by Brandon Boudreaux.

      Which is awesome to see. It’s a high profile death penalty case. One tiny screw up could lead to an appeal. It’s nice to see he’s taking it seriously as oppose to a moment in the spotlight, which we’ve seen before with other judges.

It's their constitutional right to appeal, and a normal part of any court process in both criminal & civil cases. However, there's only a small handful of very narrow instances where an Appeal would gain enough traction to even be heard by the first court circuit of appeals, let alone meet the burden of proof to stay a conviction, nevermind opt to overturn said conviction as the only remedy. There are hundreds of thousands of innocent people in prison as we speak. A horrifying average of 1 in 7 inmates on death row were wrongfully convicted, and yet the appeals system is so impossibly unjust that there's virtually no direct legal remedy to free an innocent person because appeals are only granted for very serious, very clear, _intentional_ Constitutional violations that have far more evidence to back them up than the burden of proof. The only semi-available remedy for actual inocent people on deathrow is being granted a stay of execution or clemency by the Governor or the President; or administratively (i.e. prison doesn't have safe means of caring out death sentence); or legislatively (i.e. state legislature pauses executions, or passes a law better protecting the potentially wrongfully convicted or bans the death penalty outright). That's it. If it's that hard to keep an innocent person alive... Why waste so much energy on the guilty? This excuse has enabled both Chud & Lori to have extrajudicial rights, and receive special treatment. The bodies were in his backyard, and his bed - he's not getting out of this no matter what. The removal of Ian's attorney is an issue with the integrity of his testimony, and Blake, Wood, et al should've been all over this and never allowed his attorney to be present during his cross, period. Even if he hypothetically was able to be "coached" thru his testimony by his own lawyer, presumably trying to protect his client who doesn't have immunity from saying something potentially incriminating towards himself or his unindicted coconspirator wife, that'd be cause to simply have his testimony strike from the record and disregard by the Jury at absolute worst... Most likely jury instructions would be given to weigh his testimony accordingly. I mean, it's not like he's a star witness or anything. He wasn't in the room where it happened, like Melanie Gibb & David Warwick. I believe Prior's intent was likely trying to get Ian's testimony thrown out by Boyce, which was denied outright. Ian didn't deprive Chad Daybell of his Constitutional or due process rights, so this 3 minute drama quite literally can't even be considered to be included in the inevitable appeal. Death sentence = years of appeals. It is what it is.
      Just expect Chud will be granted a stay of execution outright. Idaho's prison system has nothing short of a crisis going on with their executions. It took them 7 excruciating attempts to execute the last prisoner due to supply shortages... And prison corruption intentionally botching several attempts just to cause undue pain & suffering. It was so bad that it traumatized the man's victims. They actually wanted his death sentence carried out, but it was so inhumane they begged the state to stop trying! But because Idaho cares more about making a political point than carrying out any so-called Justice, they put the victims thru this, and in the end, made the Offender into a Victim.
      Most death sentences are overturned, and rightly so in my opinion, especially when they can't be carried out humanely. Nevermind the crisis of 1 in 7 on deathrow being innocent. It's better not one more state sanctioned death ever be carried out, than one more innocent person being killed. This is not how civilized countries punish their own citizens. The entire act in this country is just one more archaic "tradition" that was somehow allowed to carry over from the British Colonizers. Plus the worst punishment you can give is making the offender live a long life deprived on their freedom in a prison cell. So long as SCOTUS doesn't keep destroying our country and now overturn what's known as the "Son of Sam" law, prohibiting criminals from profiting off of their crimes, life in prison is already taking the convict's life away, for the life/lives they took. Further, it's impossible to reach people on death row, and for most killers, once they've exhausted their appeals, they're willing to speak on exactly what happened, which can bring the victims' families much closer to any type of "closure." It's better they remain alive as a reminder of what happens when law enforcement blatantly ignores pleas for help, and legislators allow DV to go unchecked. Preparing A People (PAP), and the entire radical LDS prepper movements just like it, are growing like a multi-headed hydra. The world needs to be reminded this doesn't stop at Chad or Lori, and more innocent people will be killed as a result.
      Further, it's very possible Chud might get spiteful someday, and give up the coconspirators... Like the Melanies (Melani Pawlowski & Melanie Gibb) or David Warwick, Jason Mow, etc. Gibb & Warwick were there, staying in Tylee's room when this all went down... And Gibb lied under oath during Chud's preliminary trial years ago, trying to alibi herself and her own lil Chad, Warwick, during JJ's homicide.... But her own Podcast, "Feeling the Fire," recorded with Gibb, Lori, & Chad, puts her right at the scene of the crime when it went down. Justice isn't served until all participants are charged. The only person given limited immunity thus far, is Zulema.... And she likely didn't even need it. Gibb has no immunity deal. And Melani Pawlowski continues to crime, while she's remained free & out in society for almost 4 years since her repeated homicide attempts (that we know of) went down. Not to mention her interference in the investigation, along with husband and PAP member, Ian Pawlowski. They've both been lying about when they got together. She cheated on husband Brandon with Ian, while Ian was in the midst of being charged for violating a restraining order taken out by his soon-to-be ex-wife. They both got divorced the same month... Given Melani was left "no choice" with Brandon not dying and all. Rob Wood was the prosecutor on that case as well, and the charges against Ian were dismissed right around the time the divorce was filed. Who knows, maybe Ian promised to leave the wife alone and immediately sign divorce papers without putting up a fight in exchange for her refusing to testify. Since no reporters care to cover what him & Melani were up to _together_ , we may never know. Maybe Ian cut a deal to "wear a wire" for an hour with his wife, where it's very obvious he tipped her off and stops her from saying too much. Then Nate Eaton gifted them with their own lil exclusive interview, where there was absolutely zero pushback on their lies. It painted Ian like a hero. Look at his DV record.
      Didn't mean to go on a tangent about those two... But again, who knows what an angry Chad, more terrified of going to General Population in prison (where they don't take kindly to inmates convicted of crimes against children) will start talking about, versus sitting on death row in isolation, where reporters can't get to him and even Investigators will be at the mercy of the prison. If the state would just let the death penalty go, he'd run thru his appeals much faster. He's going to be appealing for years now, on our tax dollars. As-if this Boyce circus of splitting the cases hasn't cost taxpayers enough as it is. Just glad Lori's been extradited to Maricopa County Jail where she will actually be serving hard time awaiting her next trial, and same goes for the Arizona max she ends up at. It's truly beyond belief what Boyce allowed Lori to get away with. She was allowed malinger the trial into years long delays, while hanging out at an non-locked down medical facility where she wasn't receiving any actual psychiatric treatment... And got away with a nurse giving Lori her cellphone to secretly call the LDS legal dept, who then got her Archibald.
      Clearly, there are much bigger matters at hand than inevitable appeals that'll go nowhere, except his death sentence (if convicted & given death penalty by Jury) will very likely be stayed because Idaho's state legislature and prison system is off the rails, making it unsafe and inhumane to carryout such a sentence.

Smith and Gardner are not licensed to practice law in Idaho they come from District 10, they violate the code of ethics of the District 9 Bar, and their form of justice is a mockery in the Idaho Court System. Prior and Boyce did the right thing we don't need them in this trial.

    In my opinion he has every right to have an attorney present and the right for his attorney to say whether or not his client should or shouldn't. I mean come on how long ago did this happen and the court expects the witnesses to remember everything? Isn't there cameras to see whether or not they did what they are being accused of? and was it Chad who said started it? Because who's paying attention to someone in the gallery?

    I haven’t been watching this trial bc it seems there’s always so many intense ones going on. But, I know I nod along in agreement if I’m listening to someone and probably would do that if I were listening to someone re tell their story. BUT, I’m also not a freaking lawyer and sitting in a court room with my client on the stand. I would make dang sure I didn’t do this. From some comments I’ve read it seems he did it multiple times and was kind of sketchy trying to hide behind someone else. Not a good look for a lawyer.

      @@Ruth695 not only that the council and the prosecutor also shared their concerns. Are Smith and Gardner allowed to practice law in Idaho? NO! They are licensed to Maricopa County, Maricopa is in District 10 because Arizona is split below Phoenix, and Idaho is in District 9. Prior and Wood know who they are because Smith represented Lori in her trial and was expelled and Gardner represented Melonie at her hearing before Boyce dismissed the case. The point is they should not be here and they are just stalling so Boyce can overturn Chad's sentence and vindicate Lori. Not Going to Happen! Idaho Does Not Believe in Insanity! and Idaho Supports Capital Punishment and Torture! We are not letting Chad Daybell be judged by Arizona Law Idaho Law may be cruel but we will do things our way.

    There's going to be an appeal no matter what. That's what convicted people do - especially those facing long sentences, life, or the death penalty. It's their constitutional right to appeal, and a normal part of any court process in both criminal & civil cases. However, there's only a small handful of very narrow instances where an Appeal would gain enough traction to even be heard by the first court circuit of appeals, let alone meet the burden of proof to stay a conviction, nevermind opt to overturn said conviction as the only remedy. There are hundreds of thousands of innocent people in prison as we speak. A horrifying average of 1 in 7 inmates on death row were wrongfully convicted, and yet the appeals system is so impossibly unjust that there's virtually no direct legal remedy to free an innocent person because appeals are only granted for very serious, very clear, _intentional_ Constitutional violations that have far more evidence to back them up than the burden of proof. The only semi-available remedy for actual inocent people on deathrow is being granted a stay of execution or clemency by the Governor or the President; or administratively (i.e. prison doesn't have safe means of caring out death sentence); or legislatively (i.e. state legislature pauses executions, or passes a law better protecting the potentially wrongfully convicted or bans the death penalty outright). That's it. If it's that hard to keep an innocent person alive... Why waste so much energy on the guilty? This excuse has enabled both Chud & Lori to have extrajudicial rights, and receive special treatment. The bodies were in his backyard, and his bed - he's not getting out of this no matter what. The removal of Ian's attorney is an issue with the integrity of his testimony, and Blake, Wood, et al should've been all over this and never allowed his attorney to be present during his cross, period. Even if he hypothetically was able to be "coached" thru his testimony by his own lawyer, presumably trying to protect his client who doesn't have immunity from saying something potentially incriminating towards himself or his unindicted coconspirator wife, that'd be cause to simply have his testimony strike from the record and disregard by the Jury at absolute worst... Most likely jury instructions would be given to weigh his testimony accordingly. I mean, it's not like he's a star witness or anything. He wasn't in the room where it happened, like Melanie Gibb & David Warwick. I believe Prior's intent was likely trying to get Ian's testimony thrown out by Boyce, which was denied outright. Ian didn't deprive Chad Daybell of his Constitutional or due process rights, so this 3 minute drama quite literally can't even be considered to be included in the inevitable appeal. Death sentence = years of appeals. It is what it is.
    Just expect Chud will be granted a stay of execution outright. Idaho's prison system has nothing short of a crisis going on with their executions. It took them 7 excruciating attempts to execute the last prisoner due to supply shortages... And prison corruption intentionally botching several attempts just to cause undue pain & suffering. It was so bad that it traumatized the man's victims. They actually wanted his death sentence carried out, but it was so inhumane they begged the state to stop trying! But because Idaho cares more about making a political point than carrying out any so-called Justice, they put the victims thru this, and in the end, made the Offender into a Victim.
    Most death sentences are overturned, and rightly so in my opinion, especially when they can't be carried out humanely. Nevermind the crisis of 1 in 7 on deathrow being innocent. It's better not one more state sanctioned death ever be carried out, than one more innocent person being killed. This is not how civilized countries punish their own citizens. The entire act in this country is just one more archaic "tradition" that was somehow allowed to carry over from the British Colonizers. Plus the worst punishment you can give is making the offender live a long life deprived on their freedom in a prison cell. So long as SCOTUS doesn't keep destroying our country and now overturn what's known as the "Son of Sam" law, prohibiting criminals from profiting off of their crimes, life in prison is already taking the convict's life away, for the life/lives they took. Further, it's impossible to reach people on death row, and for most killers, once they've exhausted their appeals, they're willing to speak on exactly what happened, which can bring the victims' families much closer to any type of "closure." It's better they remain alive as a reminder of what happens when law enforcement blatantly ignores pleas for help, and legislators allow DV to go unchecked. Preparing A People (PAP), and the entire radical LDS prepper movements just like it, are growing like a multi-headed hydra. The world needs to be reminded this doesn't stop at Chad or Lori, and more innocent people will be killed as a result.
    Further, it's very possible Chud might get spiteful someday, and give up the coconspirators... Like the Melanies (Melani Pawlowski & Melanie Gibb) or David Warwick, Jason Mow, etc. Gibb & Warwick were there, staying in Tylee's room when this all went down... And Gibb lied under oath during Chud's preliminary trial years ago, trying to alibi herself and her own lil Chad, Warwick, during JJ's homicide.... But her own Podcast, "Feeling the Fire," recorded with Gibb, Lori, & Chad, puts her right at the scene of the crime when it went down. Justice isn't served until all participants are charged. The only person given limited immunity thus far, is Zulema.... And she likely didn't even need it. Gibb has no immunity deal. And Melani Pawlowski continues to crime, while she's remained free & out in society for almost 4 years since her repeated homicide attempts (that we know of) went down. Not to mention her interference in the investigation, along with husband and PAP member, Ian Pawlowski. They've both been lying about when they got together. She cheated on husband Brandon with Ian, while Ian was in the midst of being charged for violating a restraining order taken out by his soon-to-be ex-wife. They both got divorced the same month... Given Melani was left "no choice" with Brandon not dying and all. Rob Wood was the prosecutor on that case as well, and the charges against Ian were dismissed right around the time the divorce was filed. Who knows, maybe Ian promised to leave the wife alone and immediately sign divorce papers without putting up a fight in exchange for her refusing to testify. Since no reporters care to cover what him & Melani were up to _together_ , we may never know. Maybe Ian cut a deal to "wear a wire" for an hour with his wife, where it's very obvious he tipped her off and stops her from saying too much. Then Nate Eaton gifted them with their own lil exclusive interview, where there was absolutely zero pushback on their lies. It painted Ian like a hero. Look at his DV record.
    Didn't mean to go on a tangent about those two... But again, who knows what an angry Chad, more terrified of going to General Population in prison (where they don't take kindly to inmates convicted of crimes against children) will start talking about, versus sitting on death row in isolation, where reporters can't get to him and even Investigators will be at the mercy of the prison. If the state would just let the death penalty go, he'd run thru his appeals much faster. He's going to be appealing for years now, on our tax dollars. As-if this Boyce circus of splitting the cases hasn't cost taxpayers enough as it is. Just glad Lori's been extradited to Maricopa County Jail where she will actually be serving hard time awaiting her next trial, and same goes for the Arizona max she ends up at. It's truly beyond belief what Boyce allowed Lori to get away with. She was allowed malinger the trial into years long delays, while hanging out at an non-locked down medical facility where she wasn't receiving any actual psychiatric treatment... And got away with a nurse giving Lori her cellphone to secretly call the LDS legal dept, who then got her Archibald.
    Clearly, there are much bigger matters at hand than inevitable appeals that'll go nowhere, except his death sentence (if convicted & given death penalty by Jury) will very likely be stayed because Idaho's state legislature and prison system is off the rails, making it unsafe and inhumane to carryout such a sentence.

I hope garrett files a complaint with the jurist bar AND the idaho bar on prior---ya know, the atty who owns the property some kids of daybell live in currently and who will testify for on behalf of his client against their mother.
