"Nobody is allowed to quash your freedom of speech." Wrong. If you're a private entity you ARE allowed to quash whatever speech you want. Unless you are the Government, or acting in some way as funded arm of the Government, you aren't required to provide freedom of speech.
This is one of the most misunderstood statues on the books. This is an issue that goes to the court rulings. Our rigged Supreme Court, holds contract law above legislative law! Corporate America only allows us to participate in the economy if we follow THEIR RULES. You either sign the contract, from fishing to credit cards, ore you don't play! This in itself is not the complete problem. You can always choose not to sign. However! The courts also consistently rule against anti-trust actions. Corporate America is concentrated into fewer and fewer hands. They control the markets, therefore you have to play in their market. There is no other place to go and the courts happily let them have this omnipotent control. If any one is interested there are two cases that show the real consequences of our rigged courts. Italian Colors vs AMEX and Ohio vs AMEX. We are all getting played, but most of us don't know it. You get what you vote for.
I’m certainly not a constitutional scholar but work for a Fortune 500 company. My employer makes it abundantly clear it’s your duty to project and carry that corporate image and not discredit them in any way at work and off the clock. Yes, discipline to including termination has been meted out for transgressors. So in regards to your employer, you don’t have freedom of speech.
I disagree. They are not customers. I may be wrong but don't they have a contract or something similar with that organization? Only a select number are chosen each year to fish in that organizations tournaments. When they accept the invite they accept the rules. And lastly, the first amendment protects speech from government interference.
The first amendment does give us the freedom of speech but it's the government or government entities that cannot squash your freedom of speech this does not apply to a private entity. They can have their own policies on what you can and cannot say and they can do what they wish within the law. For example if your employer doesn't like you or the things you say they are more than welcome to write you up or.
Private companies can make you sign an agreement to limit speech. Or, if you don't agree, you can't join the organization. The US Constitution limits the GOVERNMENT from stopping or limiting speech. Not private organizations. That being said, the fact the MLF and Bassmaster make their employees and anglers sign or agree to these limits really shows how crappy these organizations have become. In fact this type of behavior occurs is just another reason why I ignore MLF and Bassmaster. They don't treat the anglers very well. These are organizations I would never join.
Depending upon the business, nowadays, that is almost always part of your contract with your employer or company you work with. Sad, but that’s the way it is. Private entities don’t have to adhere to the constitution 1st amendment.
You've got to study up on the first amendment. A private organization is allowed to set standards of certain speach relating to their company. Anyone that goes on social media and badmouth the company they work for, is subject to termination.
You couldn’t be more wrong. There’s countless times when freedom of speech can be restricted. The military, government organizations, NDA contracts, employer policies etc.
That is not what the First Amendment says, educate yourself. It only applies to protections from the government. A private business can fire you for anything you say that they deem is bad for the business. You are free to say what you want without the government criminalizing it, but the private entity can still fire you.
You have a degree in Criminal Justice if I recall. If any police officer speaks disparagingly about their agency are subject to discipline. Conditions of employment can regulate speech. You can voice your opinion but there may be consequences. You should watch congressional judiciary confirmation hearings sometime. More take a side rhetoric Randy.
Criticism often leads to retribution by whoever is being criticized. Sad but true. If all the anglers would refuse to sign the agreement to be silent they would be better off in the long run. The anglers may need to start a new organization owne3d by themselves, or go a season or 2 fishing a different tour. Freedom is scary. Deal with it.
The anglers are not customers of the organization. It's the other way around. They don't pay the organizations - the entry fees are returned to the anglers, plus the money put in by the organization. The entity paying out the money is the customer.
@@randyblaukatintuitive why doesn't it? No one is stopping you from saying what you want. But if what you say is offensive or insulting to me, then be prepared for my reaction and my response. Another reason why I love the NPFL, Randy. The tournament director there can say anything he wants to membership without internal NPFL consequences. Expressing 1st amendment rights at a family restaurant should be celebrated. You should join & immerse yourself in that kind of freedom.
So what is your recourse when BASS or MLF tell you that you cannot fish their tourney’s any more, for simply speaking your mind. Keeping in mind that they have no obligation to accept your tourney registration. Is getting blacklisted worth it? When you agree to the terms and conditions of participation, you agree to 100% of the T’s and C’s.
Though major fishing organizations are allow to suppress anglers comments that negatively affect the organization, I do not believe that factual information discussed by members of the organization should be suppressed. Transparency among the organization, its members, and the public that the sport entertains would only serve to push the sport of bass fishing forward.
WRONG! Randy, you obviously have not read the 1st Amendment Free Speech Clause. Here it is - “Congress shall make no law... abridging freedom of speech”. The Government cannot abridge free speech. Private entities, however, are NOT bound by any requirement to allow free speech. You remove posts here on your RUclips channel, and you are allowed to do that. Same with Bass and MLF and any other private entity. The Freedom of Speech clause applies to the Government, ONLY.
@@jayplugged-in7709 It's un-American to follow the US Constitution? Randy specifically said these organizations were trying to "...quash the First Amendment Rights of these fishermen." That simply is not true. No such right exists.

Randy wrong again on anything political / legislative. If you work for a company, you can’t just come in a say whatever you want. Freedom of speech, as beautiful as it is, does not mean freedom from conscience, especially from your employer.
Instead of "conscience," in your post reply, I believe the more correct word would be "consequences." We can say whatever we want, but it may not keep us from getting fired or punched in the mouth, or whatever bad result may occur.

If they all do not like it, then they all should walk away. If they all refuse to show up to a few tournaments in a row until their concerns are dealt with, they will get back the power.
