- The International Court of Justice will hand down its ruling in South
Africa's latest application for more provisional measures against
Israel for its actions in Gaza.
Last week, the South Africal legal team argued that Israel is guilty
of genocide for they way in which it has killed Palestinians in Gaza.
University of Johannesburg's Prof. Hennie Strydom says the point that
South Africa presented was the prevention of humanitarian aid from
reaching Palestinians, which he says it's a strong argument.

Israel is changing the ways to allow aid and more aid but they have to ensure that these aid are free of weapons and ammunition. Furthermore some of these aid land in the hands of Hamas and that is a big concern of Israel. UNWRA is also infiltrated by Hamas and the UN has seen working with Hamas. Israel is doing a lot for the Gazans to try and secure their safety.
SA is not in war but the SA citizens fear their lives, murder and theft, live in poor conditions, have not potable water and food with no assistance from the government.

ICJ and ICC are very smart and are limiting the West's criticizing.
Both courts KNOW top arms dealers are some of superpowers and the West like arms deals.
ICJ and ICC might only accuse Israeli leaders about outskirts and OUTSIDE CONVENTIONAL TACTICS: mass punishment, genocide, mass-carpet-bombing with "dumb" weapons, and tactics like cruel engineered famine, limit access to food, methods against barbaric human rights (Israel and Hamas.)
ICC and ICJ might not focus on what Israel has being doing a simple war crimes tactics: creating a hellish environment to push Palestinians into forced exile: creating fear, killing thousands, calculated relocations away from access to food and water, destroying schools, hospitals, mosques, cemeteries, business services, like destroying and damaging houses, mosques, cemeteries, etc), to kill, disable pregnant women and children, while limiting life-and-death supplies.
How does SA have standing in this case?
III. STANDING OF SOUTH AFRICA (PARAS. 33-34)
The Court notes that Israel did not challenge the standing of South Africa in the present proceedings. It recalls that all the States parties to the Genocide Convention have a common interest to ensure the prevention, suppression and punishment of genocide, by committing themselves to fulfilling the obligations contained in the Convention. It follows that any State party to the Genocide Convention may invoke the responsibility of another State party, including through the institution of proceedings before the Court, with a view to determining the alleged failure to comply with its obligations erga omnes partes under the Convention and to bring that failure to an end.
The Court concludes, prima facie, that South Africa has standing to submit to it the dispute with Israel concerning alleged violations of obligations under the Genocide Convention.

Yet the ANC led gov sees it fit to spend R1B (about 56m usd) to take Israel to the ICJ. Yes the war in Gaza is terrible and needs to stop soonest. What my gov can do is condemn as much as others. But to spend that mush money when we have such huge problems here is beyond me. There are richer countries who can afford to spend this money.

Most of Asia, Africa and South America have recognized Palestine, while the U.S., Canada, Australia and much of western Europe have not. ICJ is part of the Western Nations.

The notion that an accused 'doesn't have the time' (for any reason, including being @ war) is not relevant or a defence against accusations.
Neither does a court 'have prior dialogue or discussions' with an accused .... that's the function of the court proceeding.
Where the accused can present their defence, call their own witnesses, refute evidence against themselves, argue their case, & have a judge or jury assess it all before making an independent judgement, based on facts & 'beyond reasonable doubt'.
Israel's repeated dismissing of international criticism on the basis that they have or will investigate themselves .... makes as much sense as allowing any accused person to 'investigate' & exonerate themselves!
