  • On May 5, 2020, the Wisconsin Supreme Court heard oral arguments on Wisconsin Legislature v. Andrea Palm. Case #2020AP765-OA
    The justices heard arguments related to the following questions:
    -Whether the Department of Health Services (the Department) violated Wis. Stat. § 227.24, governing emergency rules, by issuing Emergency Order No. 28 without complying with § 227.24’s procedures?
    -Even if the Department did not violate § 227.24, whether Emergency Order No. 28 exceeds the Department’s authority by closing all “nonessential” businesses, ordering all Wisconsin persons to stay at home, and forbidding all “nonessential” travel?

    “My question for you is, where in the Constitution did the people of Wisconsin confer authority on a single unelected cabinet secretary to compel almost six million people to stay at home and close their businesses and face imprisonment if they don’t comply - with no input from the legislature - without the consent of the people,” she said. “Isn’t it the very definition of tyranny for one person to order people to be imprisoned for going to work, among other ordinarily lawful activities? Where does the Constitution say that’s permissible counsel?”

    It was interesting to see this oral argument before the court. I was surprised that Atty Ryan Walsh did not have to first explain to the court what authority he had to come before the court and to speak and act on behalf of the Wisconsin State Legislature. I do not recall the Wisconsin Legislature meeting after the last DHS stay-at-home order to discuss the situation, review options, and approve the preparation of a legal case for the court's consideration. For all we know, Ryan Walsh was acting on his own behalf, but we know this is not the case as someone must be paying him for his time.

    Justice R. Bradley should be on a soap opera. She's like that annoying neckbeard in your Poli Sci 101 class who read too much Rand and wants everyone to know about it.

      She is unable to follow and inserts her own opinions as priority. Hopefully she won't be reelected.

      Yeah, those pesky malcontents, and their reading, and their dislike of circular, self-referential authorities that have unlimited scope, unlimited duration, and are the sole arbiters of how much power they have over other people and how far they can go. You're right we need less reading.

    It's pretty clear the legislative act is defective and should be struck down immediately. There's no better time to redirect this matter back to the legislature to amend the statute so that it does actually respect and comport with constitutional law. This would include establishing sure and certain limits on the state agency's scope of action and circumscribing its authority and power.

      @@5q88 , you literally cannot get this under control. The only solution is herd immunity. It's a highly contagious virus, we aren't going to eliminate it. All we will eliminate is our own economy.

      @John Duncan That is 100% false South Korea has their first case the same day the U.S. did. They have a much higher population density so it could easily effect them a lot more. Instead of fucking around and making it a political debate they went into an actual quarantine and a few days ago had no new domestic cases. They’re now getting ready to reopen their economy and lift the restrictions. Quarantining does work the U.S. just hasn’t really done it yet. Also if you open too early you risk obliterating the rest of our economy if we’re forced to shut down again.

    I'm sorry but to give one example of a crisis to another is not right. A fire is one thing, earthquake is another, flood, tornadoes and even illnesses. Sorry but each one needs to have a standard and limits!

      I think he just made the case that if the fire department wants to set up fire-breaks and they feel people are inhibiting their ability to do that, they can start double-tapping people in the head. I mean, weird flex for a fire department, but okay.

    "Orders" are no different than "Edicts".....which ARE NOT laws. The legislature gave these fools at DHS unlimited power to act as KINGS and pronounce EDICTS.
