If you define a circle as a set of points that are at the same distance from 1 point, then this definition is depending on something external, because that center point is not part of the circle (unless the constant distance is 0). And then you are also defining something that is not straight by refering to something straight (the distance, which we also call the radius). These are both reasons to say that we are defining a circle by refering to 'what it is not'. Perhaps it is better to define it in another way: a cicle is a constant curving line; this is the path of a point that turns constant. Perhaps next time someone makes a gap in space; the circle will then not have an identity crisis.

The center point is a part of the circle. Every circle has a center you can't make a circle without one. The object you're describing is a spiral.
