First thing anyone should do when contacted by a HOA is contact a lawyer the very idea that they have sovereign rights over a three mile radius is ludicrous.
Only government can give them that right, for future expansion, if there is no private property within that 3 mile area and there would be a document stating as much.
The first thing is to get a lawyer on receiving the first notice and get a emergency injunction against the HOA to stop them from taking further action against owner and property. Until it is proven in court they have to right to do anything.
The one thing these stories always have in common is that the people involved (HOAs, Karens, etc.) always seem to fail to understand that they CANNOT dictate what a homeowner can do with their own property. Your bylaws are ALWAYS trumped by the law. No one can tell you how you can decorate your house, what your vehicle can look like, or how you can keep your yard other than the law. The fact is HOAs cannot tell you what vehicle you can park in front of your house. They cannot tell you what color you can paint your front door. The only place the HOA has control over is public spaces that are not already controlled by the city or state.
A good property lawyer would poke holes in every single claim the HOA made regarding Nathan's property. First, a majority of states have laws that prohibit HOAs from claiming jurisdiction over properties that predated the HOA. Additionally, HOAs are strictly prohibited from attempting to force homeowners whose property predates the HOA into joining. And finally, any attempt to collect dues, fines or place liens on said properties are also prohibited. So what the HOA was doing was flat out illegal.
After first contact engage with a Lawyer, confirm documents and go to the Police with a cease & desist. Log any future correspondence with your Lawyer and any unauthorised visits call the Police every time, then sue! I guess the above would make a good story online though!
Whatever can be seen from public access can be photographed.. so if the chicken coop can be seen from the road.. it's not protected from privacy laws.. but if one has to get into areas not accessible from public view, like trespassing, climbing fences and such, then yes..
@@bearprower Yea, why don't you talk to the two "auditors" who were shoving cameras in peoples face where I live...got their azz's beat and equipment trashed all by one guy ..........when the police got there 15 witnesses got amnesia and told the police they weren't talking. They haven't been back.

HOA first contact lawyer up! Property can not be assumed into an HOA without the property owners authorization!
