I guess it depends on the legal definition of "garden" I'm not a lawyer or judge so no idea on what or if there's a legal definition of garden. I only know I've always thought indoor = greenhouse, outdoor= garden. I'll cheer for them but my uneducated brain is saying they'll lose this case.
It will fall under the same historical laws regauding tobacco plants. Neither are considered produce products.
