  • The story of developer Alexey Pertsev’s arrest for his involvement in Tornado Cash is a story we and much of the crypto world has been following intently. According to Dutch authorities, Alexey Pertsev is “suspected of involvement in concealing criminal financial flows and facilitating money laundering through Tornado cash. Those who defend Pertsev, namely those who believe in the right to privacy in crypto, say Pertsev merely contributed open source code that was abused for money laundering and that he isn’t personally responsible for said money laundering.
There is so much to talk about this case and its wider implications-and we can’t just fit it all into a Defiant Daily video. However, we have been working on a long form investigative report on the matter that we will publish as soon as possible- AND we just attended the first public trial on the Alexey Pertsev case, which means we have some immediate information we can share with you.

Tornado Cash is equivalent to a knife. the manufacturer isn't liable for what it cuts.

Sounds more like an invisible cloak that the manufacturer suggests they aren't liable for the thieves who use it to hide themselves.

Great recap of proceedings - you guys did a fantastic job deciphering all the Dutch! I had to string together what I could in court as a native English speaker.

Anybody know how u.s. Constitutional rights apply in the Netherlands. He was held in jail for 90 days before charges were brought. This is strictly a no-no in America. You must be charged within a business day or two, otherwise U have to be released. He was criticized in court for not making a declaration. In the u.s., the criminal defendant has the sacred right to remain silent, including the right to not have to give up your password so that your laptop can be searched.
Right to speedy trial. The prosectors have made allegations with no evidence and still want to investigate. No evidence means no case. The prosecution has already gone over 100 days. Do they get a thousand days or 10,000 days. How long is this allowed to go before there is a trial? Is it a jury trial or just a judge that would decide the case?

It's never about who's right or wrong, its about who has more power, governments fear what they cannot control, the protocol is threatening that power, while he sits in prison, the protocol continues, with or without him.
Why are we not going after those "abusing" protocol? If they had solid proof, they would of already ended this, but instead they drag the case on, hoping they find something eventually. #CodeIsSpeech

In EU they follow Roman, not English law which means you are considered guilty until proven innocent
