Yeah, this plan no longer works due to a number of factors: 1) The bodyguard will pick up the gun, but he will still follow Robert Knox anyway. 2) The "policeman" only stops near the fountain, not near the garden, so it's now impossible to lure Robert towards the garden and kill him there. All this is probably caused by patches and updates made by IO to render this challenge impossible to complete without a contract.
Robert follows the policeman because he's the closest guard to give the briefcase to (Robert's bodyguard is already distracted). You have to time it so Robert leaves the building just as the policeman is walking past. Hope that makes sense.
