  • Landlocked property, easements, and shark attacks!!!
We had the opportunity to ask attorney David Holmes about landlocked property ...is it sellable, is it able to be financed, and how to go about getting a legal easement.
David Holmes, of Holmes & Eubanks, has been practicing law in Slocomb AL since the mid 80s. His office is located on Hwy 52 in Slocomb AL.

Also just a reminder...land, farms, homes, & homes with acreage...that’s what we do.
We have buyers looking for property in our area from all over the country. Our marketing is nationwide as well as local. This helps our sellers get top dollar for their properties. More buyers means more demand and more competition.
We have been extremely busy this year! But need listings. Our land inventory is low right now. We have buyers looking for property that isn’t currently on the market.
If you’ve considered selling or buying, give us a call today.

What if there is a planned county road connected to the property? Can make a gravel road myself?

Good luck. I'm in Ben Wheeler TX having a similar issue. I have two properties landlocked with two other owners. One which I can't find to contact about an easement. And the other which looks like has a county road going through the landlocked properties all the way to the end of mine according to Google. Has it fenced across the road according. Looks like the reason there's a county road back there is because of a utility line at a barn. But he doesnt want me to use that road. He wants me to across a forest without paperwork.

I have an easement but the local building department wants me to pay them $10,000 to use it because they lost the paper work to it. What can be done ?

Chris Montreuil I won’t be able to give you legal advice. Naturally I would recommend you speaking to a local attorney in your state. State to state laws vary in the way easements are handled.
In Alabama the neighbor doesn’t have to GIVE you an easement. They are entitled to some type of compensation.
If we can help let us know. Thanks

@@FulfordRealty the attorney wants $15,000. The property I bought it for cost $25,000. Before we bought the property we had it oked by the building dept now they are lying about it. I toke this to the state and they told me to work it out with the building dept. What a joke, how unreasonable these government workers are.
We are just private citizens at the mercy of these people in a position of power. It just isn't right.
The building department wants us to pay them $10,000 to use our easement because the building department lost the paperwork to it.

If i get an easment of necessity does the county have to cut a road.

      J.M. Harris no sir.
The county’s obligation ends at the road frontage.
The cutting of a road will be up to you to create if one doesn’t exist.
It is also your job to maintain the easement (if necessary) and not the property owner that is granting you the easement.

My grandfather purchased a house and garage in 1972. I inherited it in 2016. Now the city is claiming I only own the build and not the land. They are trying to tear down my garage that is 6ft from the house...
The house and garage were both built together in 1920. I have a lawyer involved. But I'm trying to learn more in case they miss something.
If they tear down the garage, I won't have a driveway and will be landlocked... Any help would be amazing!
