Tech companies in California have been laying people off for a while now. It seems that those who are working from home or on some kind of leave are the first ones to be let go. While it is illegal for companies to let go of workers for taking FMLA, you have to prove that’s what they’re doing. With layoffs increasing and more pressure being put on the remaining employees to keep up or increase the output, you know companies are favoring the workers who are there rather than the ones who are on leave.

Yeah, and for companies laying off thousands of workers good luck trying to argue that you're laid off because you took time off. There was a mention of a replacement for her in her team, but was that replacement already in place because she was on leave? Or did they hire someone and essentially pay them the same after they fired her? Details matter in cases like this, and some part of me thinks this woman doesn't have a case. Besides when you lay off over 10,000 employees, it's real easy to hide some shenanigans of illegal firings if that is in fact the case, she better be willing to prove that what she did is unique and/or above and beyond what anyone else in her team can do.

I agree, unfortunately, most jobs in America are at-will, which protects the employers more than the employees. Therefore, they treat people like chess pieces. If they need you, they keep you but when they don’t need you, they kick you out. It’s not just downsizing but because of big corporations’ greeds that also comes into play to benefit, as well as keeping to maintain the top employers’ wages and salaries.

As a woman who will be child free for my whole life, this is a bad take. It’s called parental leave because having a new child creates new hardship. People take medical leave because new medical issues create new hardships. Not wanting to work is a hardship faced by most Americans for their whole lives 🤷‍♀️ there’s nothing new going on.
Your comment makes it sound like coworkers are personally responsible for your workload, but it’s your managers and C-suite executives creating more work for you - not parents trying to give their children a good start in life or individuals getting diagnosed with a life changing disease. When corporations fail to offer paid parental and medical leave, it’s we the taxpayers who are forced to bear the financial and social costs.

They couldn't get her to do any work but they knew that they would likely end up in a lawsuit if they fired her so they sat her down in an office by herself, with no work, no phone, no communication with other employees. Eventually she stopped coming into work, they considered that job abandonment. Problem solved.
