Report:
On 2/12/2022, I was dispatched to a robbery that had just occurred Downtown Athens.
Officers made contact with the victim. The victim and his girlfriend stated they had just been robbed. The victim stated that they were walking into Cillies and he had his girlfriend's red rectangle wallet in his back pocket. He stated someone came up behind him and took the wallet out of his pocket. He stated that he tattoos downtown and because of this knows a lot of people downtown and initially thought someone was playing a joke on him. When he turned around he saw a black male roughly in his 20's that he described as being about 6'4 wearing blue jeans and a light colored hoodie with the hood up take off running down Clayton St. toward Lumpkin. He stated he observed the individual turn right onto Lumpkin towards Washington St. and lost visual.
The victim stated that the wallet belonged to his girlfriend. The girlfriend stated that she had roughly $5 in cash in the wallet along with all of her debit and credit cards, her social security card, and her health insurance card.
The victim was provided a copy of the case number. The downtown cameras were reviewed but nothing of evidentiary value was able to be observed.
A couple hours after the initial call boyfriend called back in and the officer spoke with him. He stated that there were four charges on the cards for $1.00 each. All charges were attempted on Square Inc. The times for the charges were 20:27, 20:28, 20:34, and 21:08. All of the charges were declined.
At 22:21 the boyfriend called back into 911 and officers again spoke with him by phone. He stated that at 22:19 one of the stolen cards was used at the Lazy Shopper downtown. The boyfriend stated the charge was for $7.69 and stated he believed the charge was for cigarettes. Officers went to the Lazy Shopper where the employee allowed officers to view their security camera footage. The officers told the employee that the time frame and stated the charge was for a little over $7 and he stated that it must have been for cigarettes. The footage showed a female at that time attempt to purchase a pack of Newport cigarettes but the card was declined. The employee told me she was a regular and that she worked at the Waffle House.
Officers then went to the Waffle House and spoke to a woman who worked there who stated that the woman in the picture was her sister. Officers told the employee that officers needed to speak with her about an incident. The employee texted her sister but she did not responded right away. the employee told me Janessa should be in later in the night to help out at the Waffle House. Officers checked Waffle House periodically throughout the night and was unable to make contact with the sister.

Probably because the step dad was right. At 11:00 the step dad is essentially saying that if the police have probable cause to suspect him of robbery then he needs to be advised of his rights and given the option to have council present. Any halfway decent defense attorney would be able to get *EVERYTHING* he said tossed out.
Yes, the son was wrong. It doesn't mean he doesn't have rights. Rights that's were violated by the police. There is an order to these things. Miranda v Arizona. The fact that the police had enough to arrest before showing up, and asked him questions specifically about the crime to "get his side of the story" is enough to have all their evidence, confession, statements tossed (suppressed by a judge and not able to be heard by a jury or used against the suspect). They deliberately chose to be coy and try to get a confession. That's not how that works. That's why this case was nolle prosed.

He’s actually doing the right thing. Not in the sense that he’s condoning the wrong doing but in the sense that he’s stopping the young from incriminating himself; isn’t that what layers do? A layer can take a case to defend a criminal even when he’s guilty, is the later wrong for that?….no!…. It’s his role to get that person off the charges and to guide them from saying things to incriminate themselves. The fact that the police came to the house means he’s a suspect. They haven’t proven anything yet so why would he confess to anything. He doesn’t even know if they actually have footage of him for sure. They may have been bluffing. Once you give a confession no lawyer can help you and stepdad was giving him the right advice. In fact if he’s being accused and about to be arrested; it’s his “right to remain silent”. Show me the proof. They probably do have proof but you don’t know that for sure. If they have proof beyond a reasonable doubt then they are not coming with questions; they are coming straight for an arrest. Admission of guilt means your lawyer can’t backtrack on what you’ve already admitted to.

As a parent, it is terrifying to know that society has decided your child is grown at age 18, when you know they aren't. However, it takes a real parent to recognize and acknowledge when your child is in the wrong and you must hold them accountable. Imagine if that guy had shot him for robbing him, mom would be looking for money to bury him.
