No Karen and I fully understand your frustration. From 1993-2017 the NEC contracts always stated in the contractual wording “he” or “his” with a bit of a cop out clause to say where they say he they mean she as well. Unfortunately therefore in my presentations I have had to use those words on slides and in presentations. I was never comfortable doing that. Thankfully now NEC4 finally makes the contract gender neutral - so you should see/hear no more “he” or “his” with regards to the PM. About 20 years too late, but at least they have corrected this fundamental point. Hi their with a option A nec3 whos fault is it when theirs late issue of superdrawing and what would happen under option A if i want to make changes that the client wants . thanks
If the client is responsible for issuing the drawing, then the lateness in issuing it will trigger a Compensation Event which you as the Contractor can claim on. To your second question, Compensation Events are still effective under Option A contracts (fixed price). If the client wants a change, that counts as a change in the Works Information (aka Scope) - that is an acceptable ground for a CE to be triggered. Since a CE can be triggered by scope change, you as the Contractor can get more time and/or money to implement a client-initiated change.
