  • Who Owns South China Sea | Philippines DEMARKED South China Sea, CLASHED with Chinese Coast Guard: Vietnam Reacts
    The near-miss off on the Spratly Islands last week was the latest in a steady string of incidents between China and the Philippines in the contested waterway.
    A Chinese coast guard ship cut off a Philippine patrol vessel carrying journalists in the disputed South China Sea, causing a near-collision, as witnessed by the Associated Free Press team on board with another boat.
    AFP was one of several media outlets invited to join two Philippine Coast Guard, boats on a 1,670-kilometre patrol of the South China Sea, visiting a dozen islands and reefs.
    The BRP Malapascua and BRP Malabrigo were shadowed by Chinese navy and coast guard ships, and ordered to leave the waters several times during the six-day journey.
    The Malapascua and Malabrigo had broadcast their intention to sail into the shoal to conduct a site survey and asked the Chinese vessels to stay clear from its passage.
    But the Chinese coast guard responded over the radio that the Philippine boats were illegally sailing in China's territorial waters, and told them to leave.
    The incident happened after the Philippine coast guard boats approached Second Thomas Shoal, where Philippine marines are stationed in a run-down navy ship grounded to assert Manila's territorial claim in the waters. As the 144-foot Malapascua neared the shoal, while a Chinese Coast Guard vessel more than twice its size sailed into its path.
    On another occasion, Chinese and Vietnamese vessels confronted each other in recent days on multiple occasions. As a Chinese research ship, moved within Hanoi's Exclusive Economic Zone or EEZ, which experts said was likely a survey. Vietnamese Agency said, that such a survey would usually be considered hostile if conducted without notification.
    The Philippine coast guard has placed navigational buoys within its exclusive economic zone or EEZ, to assert sovereignty over the disputed Spratly Islands in the South China Sea.
    This move highlights the Philippines' unwavering effort to resolve, and protect its maritime borders and resources and contribute to the safety of maritime trade.
    As a maritime nation, it is imperative that the Philippines prioritizes the maintenance of navigational safety, to ensure the protection of its waters, and the people who navigate the area.
    These cardinal buoys will indicate the direction of safe waters, to prevent passing ships from running aground in these shallow areas.
    The Philippine Coast Guard set up five buoys carrying the national flag from May 10 to 12 in five areas within the 200-mile or 322-kilometer economic exclusive zone, including the Whitsun Reef, where hundreds of Chinese maritime vessels moored in 2021.
    The step comes amid China's increasingly aggressive actions in the South China Sea, as Philippines President Ferdinand Marcos Jr, pursues warmer ties with treaty ally, - the United States.
    However, China responded by reportedly deploying their own buoys in Balagtas Reef, Julian Felipe Reef, and Gaven Reef. China deployed three navigation beacons around the contested Spratly Islands of the South China Sea. Following similar marker placements by the Philippines earlier this month, both sides try to fortify their claims to the area.
    Meanwhile, Vietnam criticized recent conduct by a Chinese research ship and the Philippine coast guard in the South China Sea, accusing its neighbors of separate actions that were violating its sovereign rights.
    Asked for comment, Vietnamese Foreign Ministry spokesperson Pham Thu Hang told a press conference, that those vessels were violating the sovereign rights and jurisdictions of Vietnam, which was taking appropriate measures to defend its rights.
    China has said that scientific research is a regular activity in areas under Chinese jurisdiction.
    China claims almost the entire South China Sea as its territory, based on what it says are old maps, including waters that lie within the EEZ of Vietnam and the Philippines, including those with 3 other Southeast Asian countries.
    The Philippines was also rebuked for placing navigational buoys in five areas of its EEZ to assert sovereignty over the hotly disputed Spratly Islands, to parts of which Vietnam also lays claim.
    Philippine Foreign Ministry spokesperson Teresita Daza said, Manila's coast guard's installation of buoys, was consistent with the country's rights as a coastal state under the U.N. Convention on the Law of the Sea.

    1734 Murillo Velarde Map
    Published in 1734 in Manila by the Jesuit Pedro Murillo Velarde. This is the oldest map that gives a name to “Los Bajos de Paragua,” literally the shoals of Paragua. Paragua is the Spanish name for the island of Palawan. This map shows the Spratlys as part of the Philippines. This map is considered the “mother of all Philippine maps.”
    Before Portuguese navigators “named” the South China Sea, the sea was known as the Champa Sea, after the Cham people who established a kingdom in Central Vietnam from the late 2nd to the 17th century. The ancestors of the Chams spoke a language derived from the Austronesian language, from which the Tagalog language is also derived.
    As early as the 1500s, ancient maps referred to the islands in the Champa Sea as “Pulo,” which in Tagalog means an “island, isolated place.”
    China's claim of ancient ownership to the South China Sea has no basis at all. Chinese only learned to navigate the open seas after the Mongolian Yuan Dynasty commissioned Vietnamese ships into Indonesia. After the fall of the Yuan Dynasty, it had taken a couple of hundred years for the Chinese to actually sail the open seas. Ming Dynasty had recorded Ships from the Pre-Hispanic Philippines docking at their ports long before they sail the open seas too. The Nine Dash Line was adopted from 1940's map by the Koumintang of Taiwan. It was never been certified as authentic. The oldest map of the Spratlys and Scarborough Shoal is the 1734 Murillo Velarde map and was shown as part of the Philippines.
    Austronesians had been sailing the opens seas for thousand of years. Ancient Filipinos had already reached and colonized Guam Before the Current Era. How much more on reaching the Spratlys which is so near. Been sailing to ancient Champa before the Chinese ever learned to sail the open seas just about 1500's CE only .

      The United States was originally the suzerain of the Philippines, and the Philippines is a colony of the United States. The United States and China have no territorial disputes.     A) (EEZ) 200 nautical miles from baseline = sovereign rights
    B) (Territorial waters) 12 nautical miles from baseline = sovereignty
    As per UNCLOS, those islands in the region "ARE NOT" islands, just "ROCKS". Therefore, no nation can expand their territory using the EEZ. It's clear that some islands/rocks/shoals are too far from Vietnam's and china's coastline (outside of their EEZ). The Philippines doesn't expand it's territory and being aggresive (unlike some nation/s) but practicing their sovereign rights within the it's EEZ.

      Why does the Philippines like to talk about the United Nations Convention on the Sea so much? The convention divides territorial waters and other rights and interests on the basis of fully respecting historical rights and interests. Whether it was during the period when the United States colonized the Philippines or when the Philippines was founded in 1946, the territorial scope of the Philippines’ constitution did not include islands and reefs in the South China Sea. There is a conflict in China, are you slapping yourself with the convention?

      Before the 1970s, Philippine laws clearly defined its territorial scope and did not involve China's South China Sea islands and reefs. Article 1 of the 1935 "Constitution of the Republic of the Philippines" "National Territory" clearly stipulates: "The territory of the Philippines includes the scope specified in Article 3 of the Treaty of Paris concluded between the United States and Spain on December 10, 1898. all the territories within the United States, together with all the islands included in the treaty concluded between the United States and Spain at Washington, November 7, 1900, and the treaty between the United States and Great Britain, January 2, 1930, and all the islands under the jurisdiction of the present Government of the Philippine Islands Territory.” According to the above provisions, the territory of the Philippines is limited to the Philippine Islands and does not involve China’s South China Sea islands and reefs. The 1961 "Act Concerning the Determination of the Baselines of the Philippine Territorial Sea" (Republic of the Philippines Act No. 3046) reaffirmed the provisions of the Philippines' 1935 Constitution regarding its territorial boundaries.

    SCS is and still international waters as defined in the International Law. No nation or a country can own a sea or the sea. There are limits on sovereignty. Any nation can own its territorial waters within 12 nautical miles from its shoreline and had sovereign rights to explore according to UNCLOS within 200 nautical miles from the shoreline which is called EEZ.

    The fact is ancient Chinese did live on the islands of South China Sea. Ancient Chinese relics like temples, coins, porcelains, china artifacts and clay makings were found. These relics are ancient Chinese because at their same time, no other countries reached the same smelting or china/porcelain/pottery making skills. Only China could do that. China owns the 9 dash area of South China Sea. UN and most countries admit this fact. For example, it was US warships that carried China soldiers cruising that sea in 1946 to declare China sovereignty over there. But later due to navigation improvement in other SCS countries, they wanted to obtain the islands so they denied their previous admittance that the islands belonged to China.
