POS Rate only tells about hedging exchange risk of principal amount, Cost of hedging exchange risk in coupon payment should also be factor Right?

if the co. has not paid the dues for imported goods beyond the time limit what will be the consequences will it be considered as ECB or any other penalty.

Co. has imported services but due to some reason payment is not made within the time limit, here my query is will it attract penalty u/s 13 of the act or since the period has crossed 3 years will it be considered as ECB?
