Hello, essentially both are defences but arise out of different conditions and the outcomes if successful are also different. Insanity is caused by internal/recurring conditions, automatism is raised where D suffers with external causes that provoke a one-off/unique involuntary reaction. Automatism results in a complete defence, insanity results in treatment and a finding of not guilty by reason of insanity. Does that make sense?
hey, can you help me please in understanding differences between automatism & insanity is a more elaborated way, please.
