No they wouldn’t. If he wanted to buy her out and she didn’t want the house, the judge would absolutely unequivocally give him that option. They would not make him sell if he wanted to keep it and made a good enough offer.
The judge can also order her to accept his offer if its top market rate. Her friend just wants 6% of the sale price.

Actually, as a joint owner Ariana has the right to petition the court to partition, meaning force the sale of the house if Tom won’t agree. Here, while Tom could have the option to buy her out, he doesn’t appear to be liquid based on his own statements. Therefore, the judge likely would force the sale because he would be unable to buy her out, has no assets to leverage for another loan, and doesn’t have substantial enough savings.

What I don’t get it is why all of the girls were mad at Ariana for not moving out fast enough, when she had just as much right to live in that house and save her money until she found something better as he did. He cheated and broke the relationship so he should have been the one to move out from the very beginning.
It’s also really horrible advice, because if you leave your place of residence and establish residence, anywhere else willing to asset dispute, the courts will rule in favour of the person in possession of the house so by moving and even getting a temporary place, you forfeited pretty much your entire claim to the property

I finally became fed up with Lala when I realized Tom is still blatantly psychologically abusing Arianna in front of her friends, and that they won’t stop enabling his performative self pity.
Sandoval had a lot of nerve at the beach gathering where right in front of Ariana, he's yapping about the singles event he is going to attend. He knows Ariana can hear him. Does he have no shame? I guess not. He's just breaking out that salt shaker, right on the open wounds. 🧂
