Okay, the thing is that when they were in Hawaii, he didn't remember anything so he would not have talked about her being roughed up and shot because of his work. He also wouldn't remember making choices to be in the mob and that he was okay with dying because he faced it knowingly for his job. So I think he's going in and out of lucidity. However, Jason knows he's dying and he's in the arms of the woman he loves more than life itself and because he is lucid at times, he knows this could be his last chance to say even though I have not acted like for the last few years, you're the one I love and Jason needed to tell her one last time.

is it just me ---did jason look like it was thinking clearly when he said i love.his eyes look clear.because it look like he held his breathe for a second waiting for sam to respond and when she did it look like he sighed.
